CALL TO ORDER Chairperson Carlos Vargas called the meeting to order at 3:03 p.m. A. APPROVAL OF REGULAR MEETING MINUTES OF 12/05/12 MOTION Three (3) amendments were requested prior to approval of the 12/05/12 minutes. 1St Request made by Committee member David Ramos to amend a date on Item 5. Presentations; section, A. Verterans Transportation Community Living Initiative change 12/02/12 to reflect 01 /02/13. 2nd Request made by Vice -Chair Darren Bates to amend Item 6. Staf Reports /Comments; section, A. Human Relations Division, by insertion of his request to Mrs. Wilson, Committee Saff member, to include; expantion of detailed specifications regarding the ADA Technichal Assistance, to her staff reports given to the committee. 3rd Request made by Mary Wambach to amend Item 10. Identify Items to be Placed on Next Agenda.; by insertion of a request made by Mary Wambach to place a discussion regarding ADA issues within Nueces County Airport. PUBLIC COMMENTS (LIMITED TO 3 MINUTES) Judy Telge, Interim Executive Director, Costal Bend Center for Independent Living - CIBCIL shared information regarding a grant received by Texas Department of Transportation to do a mobility options project for people with disabilities who live in rural areas. Mrs. Telge requested to return to the Committee for People with Disabilities to give a presentation with more information on the options available for people that rely on public transportation. Veterans Transportation Community Living Initiative - by Carol Weckenmann Chairperson Vargas stated Mr. Weckenmann requested to table the presentation till the February meeting, due to a conflict in his schedule. 6. STAFF REPORTS /COMMENTS a. Human Relations Division Monthly - Monthly Division Performance Report Sylvia Wilson provided the December 2012 Monthly Performance Report. Highlights of division activity provided. The item was followed by brief general discussion. (The report was previously distributed to Committee members prior to the meeting beginning) (A copy of the report is attached at the back of the minutes) b. Development Services Department - Construction Activity and Major Projects Update - by Julio Dimas Due to Mr. Dimas not being present Chairperson Vargas request to find out why Mr. Dimas or any other representation from the development services department have not been attending the Committee meetings. c. Engineering Services Department - ADA Master Plan & Bond 1012 Street Project updates - by Jamie Pyle Ms. Pyle stated the ADA Master Plan was approved by Council on 12/11/12. Ms Pyle then reported the ADA Group 3 has a contractor bid going to council 1/8/13 and should be approved by 11/15/13 Ms. Pyle stated construction should begin a month after 1/18/13 sometime in February maybe March. The item was followed by general discussion, as a result of the discussion a directive was given to Ms. Pyle to provide at next meeting a list of where expected improved bus stops will be. (A General: Cover Sheet on ADA Improvements Group 3, Bond Issue 2008& Accessible Routs in CDBG Residential Areas Phasel and Phase2, and a Master Schedule Update document was previously given to Committee members prior to meeting beginning) (A copy of handouts is attached at the back of the minutes) d. Parks and Recreation Department - Packery Channel Parking Update by Stacie Talbert Due to Ms. Talbert not being present Chairperson Vargas request Committee staff members to find out why she was unable to attend. e. Corpus Christi Police Department Parking Control — Taxicab Ordinance Changes by Marc Denson Mr. Denson reviewed with the Committee the "Red Disabled Warning Notices Cards" and Warning Notice guide sheet. The item was followed by general discussion; as a result of the discussion a directive for Mr. Denson to provide at next meeting a copy of the 681 section code at next month's meeting was given. Mr. Denson also discussed the changes to Section 57 of the Taxi Cab ordinance. The item was followed by general discussion. (A stack of padded red cards along with a guide sheet titled Use of Red Disabled Warning Notices information along with a copy of the ordinance was previously distributed to Committee members prior to meeting begging.) (A copy of handouts is attached at the back of the minute) Page 2 of 9 7. STATUS UPDATE REGARDING COMMITTEE GOALS Darren Bates stated he had been contacted by a Human Relations staff member in requesting his assistance with the 2013 Calendar of Events. Mr. Bates suggested in distributing the Calendar along with the Agendas to other organizations who hold events as long as both the Agendas and Calendar are accessible. 8. DISCUSSION AND ACTION ON VOTING FOR REAPPOINTMENTS AND NEW APPOINTMENTS Ms Wilson stated the Reappointments would be for Vice - Chairperson Bates, Sabrina Ramirez, Alana Manrow and Chairperson Vargas; by which all would like to be considered for reappointment. Ms. Wilson then stated Committee member Harvey Salinas is no longer eligible to serve any longer as his term will expire in February, however, Mr. Salinas has been asked to continue to serve until his vacancy is filed. For clarification Ms. Wilson stated there is one vacancy on the committee to fill vacancy left my Mr. Salinas due to expiration of term. Prior to Voting beginning Mr. Salinas excused himself from voting. Committee members took time to review all prospective applicants. Ms. Wilson accepted nomination for Marshall Burns made by Vice - Chairperson Bates; Nomination for Judah Hoehne made by David Ramos, Alana Manrow, Carlos Vargas, Sabrina Ramirez, and Donnie Contreras; Nomination for Larisa Ford was made by Mary Wambach. Ms. Wilson stated the Committees recommendation would be for Judah Hoehne as majority rules with a total of 5 nominations. Ms. Wilson informed the Committee the request for recommendation to the Mayor and City Council may or may not be accepted, Council may fill the vacancy with any of the seven applicants. Ms. Wambach stated with the time given to review all the prospective applicants she did not have enough time for a thorough review there for she was unable to give a fare nomination. 9. CHAIRPERSONS REPORT Chairperson Vargas reviewed an email regarding: Board, Commission & Committee Member Attendance and Quorum policy with the CFPWD and Staff members. (A copy of the email was previously distributed to Committee members prior to meeting beginning) (A copy of email is attached at the back of minutes) 10. IDENTIFY ITEMS TO BE PLACED ON NEXT AGEDNA Requested by Vice - Chairperson Bates — Expansion of Technical Assistance detail Requested by Vice -Chair person Bates — Presentation — Judy Telge • Requested by Vice - Chairperson Bates — Discussion- Creating meeting documents accessible for universal accessibility. • Mary Wambach requested to send an invitation to the Mayor and City Council members as they may not all be aware of disability and enhancement. Ms. Wambach stated it would be nice to receive insight form the Council members as to what role the Committee can take to enhance the City as public servants. It is important that they be used with specific standards that are consistent with policy. 2) Do not write on them (except where Indicated) or add your opinion on them. The one exception you are allowed to write is "No Disabled Placard" if they have no placard at all. 3) Disabled Veteran or DV plates are allowed as legal plates for disabled spots. 4) Insure that the designated disabled spot is legally marked as such. Board, Commission & Committee Member Attendance and Quorum policy TO ALL BOARD, COMMISSION AND COMMITTEE STAFF LIAISONS AND ASSISTANTS: It has come to our office's attention that many Staff Liaisons and Assistants are not calculating board member's attendance properly. The reason we have an attendance policy in effect is so that it will enforce the Importance of member's attendance, and so aboard CAN MAKE A qUORUM to hold the meeting. Please see the excerpted paragraph below from a Legal opinion from former Assistant City Attorney, Jimmy Bray, in 2009. "An individual is automatically terminated if he/she misses more than 25% of the regularly scheduled meetings in a term year. Attendance rates are calculated per term year based on the number of regularly scheduled meetings. if meetings are cancelled due to lack of a quorum and the individual was not present, lie/she is counted absent. If a meeting was cancelled it is not subtracted from the meetings which were regularly scheduled for calculation of the 259 attendance rule." Please see two "Frequently Asked Questions' which will be placed in a Board Staff Liaison Orientation Manual, coming out to you soon. What determines a quorum in a Board meeting? Now does not meeting a quorum affect the Board Member's Attendance Policy? Answer A quorum is the minimum number of members needed to officially conduct business. It is a simple majority of the membership (50%+ 1), unless stated otherwise by ordinance or by-laws, If meetings are cancelled due to tack ofa quorum and an individual is not present, he/she is counted absent When calculating the attendance of a member for a term year, you continue to count the regular number of meetings held annually, even if a quorum is not met to hold the meeting. You then calculate the number of 'excused' or 'unexcused' absences. What determines an "excused absence" from Board meetings? Answerz The Attendance Policy states "An absence shall be deemed unexcused unless excused by the board for good cause no later than its next meeting after the absence. Each board must review and grant excuses only for good cause. Each board may want to establish its own internal policy as to what constitutes good cause to provide a consistent, rational procedure for granting excuses. Examples we have seen are illness or hospitalization, immediate family emergencies/deaths, planned vacations (with advance notice), and out-of-town business trips (with advance notice). When a member seeks reappointment to a board or commission, we ask to see the attendance records for the past Term Year, which is defined as that annual period after which a term is normally scheduled to begin. Many of you are only calculating the number of meetings held WITH a quorum. That is incorrect. You need to calculate the number of ALL regularly scheduled meetings. If the meeting cannot be held due to not making a QUORUM, then those who do not attend are counted absent, unless excused by the board for good cause no later than Its next meeting after the abseme. Absence at meetings that are postponed and held on days that are not regularly scheduled (special called meetings), should not be counted in determining whether an individual has missed more than 25% of the meetings in a term year. When a member isgetting close to missing 25% of theyear's regular meetings, you should Inform your board members, and apprise them of the attendance policy. if any of you are unclear about these policies in place, please feel free to call me, or write me back.
