Regular Meeting
Thursday November 1 , 2015
I. Call to Order: 3.17pm
11. Roll Call: Present: Vernon Wuensche, PE, Steve Deases, PE, Robert Aguilar, Jesse Gatewood,
Robert Sandate, Michael Douglas and Alfred Tristan
Not Present Marylou Herrera-No reason given, William Pitchford-No reason given
Staff. Gene Delauro, Michelle McCollum, Norman Walters, Jessica Gonzalez
III. Approval of Absences: August 27, 2015, Regular Meeting
Steve D. motioned to approve the absence for Michael Douglas only;absences for Mary Lou
Herrera and William Pitchford not approved by the board. Vernon W. second the motion. Motion
carried 5.0
1V. Approval of Minutes:August 27, 2015, Regular Meeting:
Jesse G. motioned to approve the minutes from the regular meeting of August 27, 2095. Robert
A. second the motion. Motion carried 5:0.
V. Discussion and presentation of a formal citizen complaint against Benito Muniz and Muniz
Electric.
Gene D. discussed the details regarding the citizen complaint brought forth by Ms. Gallagher
against Muniz Electric. Board was presented with documentation from Ms. Gallagher submitted
to the city to review.
Norm W. discussed the procedures that AEP follow, contractor follow, then procedures city
inspectors follow regarding electric work for residential properties. it was determined that Muniz
Electric did not call in/follow up with AEP Electric regarding reconnect/disconnect of electrical
services of property address;this action taken by Muniz Electric is considered criminal. Due to
Muniz Electric not properly following up with AEP Electric, one year passed before AEP
discovered the property owner was not legally receiving electric service to his home and were
accused by AEP of stealing electricity of no fault of their own. Homeowner informed Muniz
Electric of the current situation with AEP and pointed out their responsibility regarding this issue.
Homeowner believes they are not at fault but instead Muniz Electric should be held accountable
for any damages, incurred expenses and other misc. expenses pertaining to this situation.
Homeowner has also taken action with TDLR(State of Texas)regarding this situation. Norm's
assessment, as an inspector, is that there was no code violation.
Alfred T. discussed the possibility of assessed fines by AEP regarding situation such as this that
the homeowner may be responsible for.
Board decided on a special meeting to take place on Jan 21, 2016, Spm, third floor of 2406
Leopard. Required in attendance at this meeting will be:Sandra Gallagher and her father, Muniz
Electric and any representatives, Norma Walters, Frank Briseno, City legal representatives, and
Chris Wright from AEP.A separate memorandum regarding the board's decision is to drafted by
Gene Delauro, Building Oficial and sent to homeowner and Muniz Electric.
Steve Deases motioned for a special meeting to take place on Jan 21, 2096. Robert Sandate
second the motion. Motion carried 5.0.
VI. Discussion and possible action regarding the board voting process and Robert's Rules of Order.
No action taken, only discussion by board members.
VII. Discussion and continued presentation of the significant changes from the 2008 National Electric
Code to the 2014 National Electric Code, slide 91 of 134.
No action taken, only presentation given to board members by Norman Walters.
VIII. Building Official's Report
A. Department Updates:
INFO R mgo live"date set for Jan 19, 2016. Adoption of building, plum ing/mechanical, fire,
property maintenance and the NEC Code in Jan 2016.
B. Permit recap 2015 to date: 85 new homes, 210 additions and remodels, 22 new
commercial buildings, 47 remodels to commercial buildings, 20 demo permits, 24 signs.
$41 million of construction, to date for the calendar year$540 million

> The Open Meetings Act limits Board response to only three options:
1. a statement of specific factual information in response to the inquiry;

3. advising a citizen that the matter will be placed on an agenda at a later date.
