Hines, Recording Secretary • Chairman Budd called meeting to order at 3:14 p.m. in the Committee Room on the first floor of City Hall. The next item of business was roll call. Mr. Homer, Mr. Carranco were absent for the February 20, 2003 meeting. Motion made by Mr. Adrian, seconded by Mr. Tomo to approve the minutes of the previous meeting with the necessary corrections(page 1,paragraph 4, second sentence; page 2) February 20, 2003 The next item of business was discussion on the International Residential Board. Mr. Adrian asked a question if we have any power or say so that we do not want to done away with? Comments by Mr. Hernandez, Mr. Adrian & Mr. Sebbert. The board is asking for a clarification on reference to the Electrical Board? What happens to the electrical board? What is given to the Technical Board? Is there going to be an Electrical Advisory Board, and what power will be given to the Technical Board? The board is asking staff to bring back a description of the duties for the Electrical Advisory board and based on Article II and how it will coincide with the Technical Appeal Board reference 63, Section 14.226 of The Technical Construction Appeal Board, seconded by Mr. Salazar,Mr. Sebbert,passed unanimously. Mr. Conolly would like to go on record that the Electrical Board opposes the elimination of the Electrical • Board and replacement of this board by the Technical Advisory Construction Board P.O. Mr. Adrian made a motion to have Legal draw up a letter opposing Section 14.226 and send it to Legal, Building Official, second by Mr. Salazar prior to next meeting with signatures. The item of business was the Building Official Report: There was none. The item of business was board member and staff discussion of any pending, old or new items to be put on a future agenda. The board discussed the possibility of moving the electrical advisory board meeting to another date, possible to March 26, 2003, Wednesday, 3:00 p.m. The next item of business was petitions from the audience. None were present. • Motion made to adjourn the meeting, seconded by all and passed unanimously . Building Official-Fire Protection Specialist Chief Electrical Inspectors(4) • V 1111. • 105.2. Electrical advisory board. 105.2.1. Appointment. There is hereby established the electrical advisory board which shall consist of nine (9) members. The board shall be appointed by the city council. This board shall have the guidance and assistance of the building official and the chief electrical inspector. 105.2.2. Membership and terms. 105.2.2.1. Membership. Persons who serve on the electrical advisory board as members shall be qualified as follows: 105.2.2.1.1. Two (2) persons, each of whom shall have had at least five (5) years active experience as a master electrician; 105.2.21.2. One (1) person who shall have had at least five (5) years active experience as a journeyman electrician; 105.2.2.1.3. Two (2) engineers; one (1) shall be a • licensed professional engineer in the State of Texas, and the other shall have a bachelor of science degree in electrical engineering and a minimum of five (5) years experience in the practice of electrical engineering; 105.2.21.4. One (1) person who shall have had at least five (5) years experience in the commercial building industry; 105.2.2.1.5. One (1) person who shall have had at least five (5) years experience in the home building industry; and 105.2.2.1.6. Two (2) persons, residents of Corpus Christi, not connected with the electrical industry. 105.2.2.2. Terms. Members shall be appointed for staggered terms of two (2) years. The term of each member shall continue until his successor is appointed, subject to limitations of the City Charter or a term limitation established by ordinance. Any member of the board may be removed by the city council for cause. A vacancy shall be filled for the • unexpired term in the same manner in which original V V • appointments are required to be made. Absence of any member from regular meetings of the board shall be cause for removal from office in accordance with the City of Corpus Christi Code of Ordinances. 105.2.2.3. Quorum and voting. Five (5) members of the board present at any meeting shall constitute a quorum for the transaction of business. The concurring vote of not less than five (5) members of the board shall be necessary to constitute an official action of the board. No board member shall act in a case in which he or she has a personal or substantial interest in violation of the City of Corpus Christi Code of Ethics. 105.2.2.4. Secretary of board. The building official or his authorized representative shall act as secretary of the board. The secretary shall make a detailed record of all of the board's proceedings, which shall set forth the reasons for its decision, the vote of each member, the absence of a member, and any failure of a member to vote. A record of all business conducted by the board shall be maintained in the offices of the inspection division. • 105.23. Powers. The electrical advisory board shall review grievances filed against any licensed electrical contractors, shall review grievances within the scope of the electrical code, shall concur on a proposed alternative material, alternate method of construction, or technical ruling prior to such alternative or ruling becoming effective, and shall recommend changes of the City of Corpus Christi Electrical Code to the City Council. 105.2.4. Appeals of rulings and decisions regarding alternative materials/methods of construction 105.2.4.1. Both the building official and the electrical advisory board must concur with a proposed alternate material, alternative method of construction, or technical ruling prior to such alternative or ruling becoming effective. The appellant shall have the right to appeal a decision of the building official or the electrical advisory board to the city council, and the building official shall have the right to appeal a decision of the electrical advisory board to the city council. 105.2.4.2. Notice of appeal. Notice of appeal shall be in • writing and filed within ninety (90) calendar days after the decision is rendered by the building official. V J • 105.2.4.3. Unsafe or dangerous buildings or service systems. In the case of a building, structure or service system which, in the opinion of the building official, is unsafe, unsanitary or dangerous, the building official may, in his order, limit the time for such appeals to a shorter period. 105.2.5. Procedures of the board. 105.2.5.1. Rules and regulations. The board shall establish rules and regulations for its own procedure not inconsistent with the provisions of this code. 105.2.5.1.1. Organization. The board shall elect a chairman and a vice chairman during the first meeting of each calendar year. Members elected chairman and vice chairman shall serve for the calendar year in which elected. If a vacancy occurs in the office of chairman or vice chairman, the board shall elect a replacement to serve out the unfilled term. 105.2.5.1.2. Frequency of meetings. The board shall • hold one (1) regular meeting per month. The regular called meeting shall be held on the third Thursday of each month, except when there are no transactions or business for the board to address, in which case the meeting may then be canceled. The board shall meet on call of the chairman for such special or called meetings as necessary for the board's proper performance of duty. 105.2.5.2. Decisions. The electrical advisory board shall, in every case, reach a decision without unreasonable or unnecessary delay. 105.2.6. Appeal to city council. The building official and the person requesting a decision from the board shall have the right to appeal a decision of the electrical advisory board to the city council; provided that if the decision is not appealed the decision of the board shall become final in thirty-one (31) days. •
