Chairman Lippincott called the meeting to order at 3:03 p.m., in the Committee Room
on the first floor of City Hall.
The first item of business was the approval and correction of the minutes. A motion was
made, seconded and passed unanimously to approve the minutes of January 19, 1995.
The next item of business was to discuss the Electrical License Provisions for Electrical
Contractors, Section 108.2.9.
Sally Farris, Assistant City Attorney, discussed her fmdings regarding the Staff Leasing
Services Act and the City Electrical License Provisions. She explained that the Act allows a
manpower providing company which provides professionals, or licensed/certified people that
have a disciplinary specialty to lease personnel. This includes anyone that is either licensed or
certified by law. The structure of an organization provides for a client company to contract
through a licensee (assigned employee) under contract from a Leasing Service. Ms. Farris
provided copies of the Act and reviewed various sections. She explained an arrangement as one
in which a licensee is assigned to work at a client company and in which employment
responsibilities are in fact shared by the licensee and the client company, with the employee's
assignment intended to be of a long-term or continuing nature, rather than temporary or seasonal
in nature. She added that Contract Requirements are further defined as:
Section 7. (a) A contract between a licensee and a client company must provide
that the licensee:

(1) reserves the right of direction and control over employees assigned
to a client's worksites;
(4) retains the right to hire, fire discipline, and reassign the assigned
employees; and
(5) retains the right of direction and control over the adoption of
employment and safety policies and the management of worker's
compensation claims, claim filings, and related procedures.
She stated that the effect of Other Law in Section 19 states that the Act does not exempt
a client of a license or any assigned employee, from any other license requirements imposed
under local, state, or federal law. An employee licensed, registered, or certified under law and
who is assigned to a client company is considered to be an employee of the client company for
the purpose of that license, registration, or certification.
Ms. Farris suggested revision of the proposed amendments to address the leasing statute,
so that at a minimum, there is disclosure if a master is a leased professional, or if he is actually
controlled by another employer, regardless of where that employer is located.
Mr. Lippincott suggested that an amendment be made to the Boards proposal to
incorporate the use of a leasing service. He added that a leasing service that leases out a master
of record should submit disclosure or a qualification statement that states that the master of
record is working for one client company at a time.
The next item of business was the receipt of petitions front the audience. Mr. Robert
Shake, stated that many cities do not recognize the Block tests on the 1993 NEC code taken in
Corpus Christi, therefore, not allowing local electricians to work in those cities. He explained
the scenario as one in which electricians from other cities may work in Corpus Christi, but local
electricians cannot work in other cities. He requested equal treatment.
Mr. Phil Benavides suggested that all electricians in Corpus Christi be surveyed regarding
their position on the matter.
Mr. Lippincott suggested a check of testing policies in other Texas cities that are the
same size or larger than Corpus Christi.
The meeting was adjourned at 4:50 p.m.
