W Ha en, Chairman; Jack Bell; Method Snapka; Robert Ard; Melody Cooper MEMBERS ABSENT: Edward Dominguez; Fred Kuddes STAFF PRESENT: Dr. Sisley; Leon Decker; Jim McFarland 7,44v) GUESTS PRESENT: Malcolm DeShields, President /Restaurant Association; Virginia Brody and Steve Golin of Channel 6 CALL TO ORDER: By Mr. Haven at 2 : 00 p.m. May 1992 minutes approved. ATTENDANCE REVIEW: All in good standing. Mr. Dominguez and Ms . Cooper were reappointed for 3 year terms . DIRECTORS REPORT: Mr. Decker reported ( 1_) vacancy. For the first .11 months of Fiscal Year 1991-92 revenues were $244, 082 & expenditures $198, 313 . Mr. McFarland & 3 Inspectors went to Food & Drug Adm. meeting locally. Dr. Sisley received a letter from Texas Department of Health indicating that the state-wide accreditation of Del Mar' s 15 hour Food Manager Certification Program was withdrawn on 7-7-92 . The course is good locally, but not transferrable to other cities . NEW BUSINESS: The City Manager' s ( 9 ) Proposed Amendments to the Smoking Ordinance were reviewed. Mr. Haven will present them at Restaurant Assn. meeting 7-23-92 . Health & Welfare Board will review them 8-19-92 . Change #4 removing bars from list of exemptions may concern bar operators as more of their patrons smoke. Change #5 increasing nonsmoking section from 25% to 50% is a concern. Motion approved to recommend instead of dealing with a minimum percentage of nonsmoking seating, it should be made clear that the restaurant operator should apportion smoking and nonsmoking seating according to customer requests. Change #6 disallowing any smoke into nonsmoking areas (effectively prohibiting all smoking in small restaurants) is a concern. Motion approved to recommend that owners/managers to whom this would be a hardship or a great expense should be allowed a reasonable time to comply or be given grandfather clause exemption. Change #7 prohibiting requiring an employee to work in smoking areas could result in Americans with Disabilities Act grievances . Not proposed for change, but a concern to members is the language of the enforcement section. Motion approved to clarify to whom the violation applies , whether the smoker or owner/manager. . DISCUSSION: Every council member gets 15-20 smoking related complaints . Restaurant operator is responsible for enforcement, but does not eject patrons . Members agree compliance is good. H.D. had less than 50 complaints last year. ADJOURNMENT: At 3 : 00 p.m. Next meeting 9-15-92 at 2 : 00 p.m.
