CALL TO ORDER: By Mr. Haven at 2 :30 PM. January 1993 minutes approved.
ATTENDANCE REVIEW: All in good standing. Melody Cooper is a City Council
candidate, which disqualifies her from serving on this committee. Vacancies
now exist for (1) food industry and (1) at-large member. Motion approved to
recommend Joe Gaytan of Wallbanger's Restaurant for food industry vacancy.
DIRECTORS' REPORT: Mr. Decker reported he has a full staff. He hopes to have
each food establishment inspected on a weekend or evening at least once each
year. He is trying to reduce response time to food complaints. During the
first 6 months of FY 1992-93, 81% of food complaints were investigated within
24 hours and all complaints were investigated within 72 hours.
SMOKING ORDINANCE: The City Council and City Manager reviewed proposed
changes to the smoking ordinance. They concluded that more stringent
revisions are desired, and that deletion of the 25% minimum for nonsmoking
seating in restaurants without replacing it with a higher percentage would
weaken the ordinance. At the City Council 's request, a survey of Texas
cities was conducted. Responses indicate that none of these cities totally
banned smoking in public places; 13 cities provided copies of their smoking
ordinances. Members were sent a packet of these ordinance. Mr. Haven felt
our ordinance is the best in the state; he noted that only 2 other cities had
a minimum percent of nonsmoking seating stipulated. Members agreed that
increasing the percentage of nonsmoking seating takes away the restaurant
operators flexibility to accommodate his customers, and that if the percent-
age is increased the Director of Public Health needs to be granted the
authority to make exceptions based on recommendations of this Committee.
Motion approved to state that this Committee still favors their prior
recommendation to delete reference to a minimum percentage of nonsmoking
seating and to allow the restaurant operator to apportion smoking and
nonsmoking seating according to customer requests; however, they feel they
can accept an increase from the present 25% to no more than 50%. Motion
approved to recommend that the Director of Public Health be granted authority
to make exceptions to the 50% rule upon recommendation of the Food Service
Advisory Committee. This Committee wants to look at the proposed ordinance
changes again after it has been rewritten. A smoking bill is before the
Texas Legislature, however it is felt it will not pass.
COMMITTEE REPORTS: Mr. Haven reported that each Del Mar Restaurant Manage-
ment student accompanies a Health Inspector on a restaurant inspection during
the class year. He asks students to observe attitudes of inspectors and
those being inspected. Students report that inspectors place much emphasis
on their role as educators, attitudes of those being inspected range from
cooperative to fearful, and that this is a very beneficial experience.
