Motion approved to excuse Mr. Snapka's absence at May meeting. Current term for Mr. Ard and Mr. Snapka will expire 6/24/93 ; Mr. Snapka desires reappointment; Mr. Ard does not. Motion approved to recommend reappointment of Mr. Snapka. DIRECTORS' REPORT: Statistics for 1st 5 months .of 1993: Activity Report Inspection Score Summary Food Establishments Permitted 1,589 Score % Inspections Food Establishments Permitted 1,589. :- 90-100 58% Food Establishment Inspections . . . . 2,727: 80-89 33% Complaints Investigated 283 70-79 8% Persons completing Food Handler Course 4, 654 Below 70 1% Figures are about the same as last year. We have a full staff. The Health Department sets its own objective of 4 inspections per year; inspections are currently running a little ahead of this objective. Things are being done a little different than other areas of the state because we feel we are ahead in such areas as temperature violations. The Food Handler Classes cover the importance of temperature control. Food Managers in good standing are allowed to teach classes. They are provided with a video and a lesson plan. 10% of their classes are audited. SMOKING ORDINANCE: Mike Scanlon of the City Legal Dept. was present to answer legal questions. On 6/7/93 the City Council passed a ban on smoking in all restaurants on the first reading. At Mr. Haven's request, they postponed the 2nd reading until 7/6 to allow the proposed :ordinance to go before this Committee and the Health and Welfare Board. There was much discussion about government intrusion, the economic impact on restaurants, the impact on tourism, and enforcement problems. There was also much discussion about exemptions for bars, bingo parlors, bowling 'alleys, etc. and about how to define bars vs. restaurants. The Committee's prior recommendation to increase the nonsmoking minimum from 25% to 50% was rejected by the City Council. Motion approved unanimously by rollcall to favor acceptance of the existing smoking ordinance with modification of the minimum nonsmoking seating from 25% to 50%, including stricter requirements for new and remodeled restaurants as previously recommended at the March 1993 meeting. The Health Department keeps a record of complaints that are not in compliance with the current smoking ordinance. For over 2 years the City Council. has been getting complaints that are in compliance, but which citizens wish to have changed in the ordinance. COMMITTEE REPORTS: None AUDIENCE PARTICIPATION: Malcolm DeShields, President Coastal Bend Restaurant Association, spoke about the smoking ordinance as it relates to bowling lanes, shopping malls, bars, bingo halls.
