Summary of Minutes for January 3, 2013
1. CALL TO ORDER
Vice-Chairperson Abel Alonzo called the meeting to order at 5:00 p.m.

2. REQUESTS FOR EXCUSED ABSENCES

3. APPROVAL OF REGULAR MEETING MINUTES OF 1216112
One (1) amendment was requested prior to approval of the 12/06/12 minutes. Request
made by Commission staff member Ms. Wilson to amend Item 1. Call to Order; section A.
MOTION Roll Call, indicates Commissioner Myers was present, amendment request is to allow the
minutes to reflect Commissioner Myers as absent. Motion to approve the minutes as
amended by Elias Valverde Second — Joel Mumphord Passed
4. PUBLIC COMMENTS (LIMITED TO 3 MINUTES)
The Public Comments was opened with no one coming forward the public
comments were closed.
5. PRESENTATIONS
None
6. DISCUSSION/ ACTON TO DRAFT A RESOLUTION TO PROMOTE CITY
PARTICIPATION WITH THE TEXAS DIVERSITY COUNCIL OF THE COASTAL BEND
Ms. Wilson stated the item was placed on the agenda for the Commission to discuss a
possible resolution to be presented to the City Council's attention in reference to
recommending the City take part of becoming a member of the Texas Diversity Council.
The item was followed with a brief discussion, as result of the discussion Mr. Alonzo
request that Ms. Alvarado give a brief synopsis of the Texas Diversity Council, a brief
discussion with Commissioners followed.
Mr. Alonzo appointed a subcommittee to draft the resolution with his nomination for
Commissioners Cooper, Mumphord and Valverde. Mr. Alonzo nominated Commissioner
Cooper to be chair of the subcommittee. Ms. Wilson requested to note the City's Human
Resources Director and Jennifer Knox-Walker, Human Resources Administrator were

present last month during the Texas Diversity Council presentation. Mr. Alonzo requested
Ms. Knox-Walker to approach the podium to give her opinion on behalf of the Human
Resource Department. Ms. Knocks stated the being a member of the Texas Diversity
would be an asset to the City and would like to see the Council approve the partnership to
help the city become more diversified.
7. DISCUSSION/POSSIBLE ACTION ON COMMISSION VACANCY
Ms. Cooper stated the subcommittee reviewed all prospective applicants and stated the
recommendation to the Mayor would be for Jamie Contreras.

Ms. Wilson stated the commission does have a youth vacancy and informed the committee
that the Mayor would review all the youth bio's and give her selected recommendation to
the council without any recommendation from the Human Relations Commission.
8. CHAIRPERSON'S REPORT -
a. Commission and Committee Member Attendance and Quorum Policy
At the request of Vice-Chairperson Alonzo, Ms. Wilson read an email that was sent to
the Human Relations Division regarding the attendance and quorum policy.

9. SUBCOMMITTEE REPORTS
a. Housing Subcommittee — Nothing to Report
b. Committee for Persons With Disabilities - Update on 01/02/13 Meeting Update
CFPWD Chairperson Vargas gave a brief update on the 01/02/13 Committee Meeting.
c. Education Subcommittee — Update
Commissioner Cooper stated due to the holidays she currently has no update.
d. Disparity Subcommittee — Nothing to Report
Ms. Wilson stated Mike Barrera will have a report for the 02/07/13 meeting.
e. Goals Update — Update by Edna Arredondo
Commissioner Arredondo announced the Oscar Award Winner Patty Duke will be a
featured guest speaker for an event benefiting MHMR of Nueces County April 18,
2013. Item was followed with brief discussion along with Mr. Alonzo's request to
create name badges for Commissioners should they attend the event to.

10. HUMAN RELATIONS ADMINISTRATOR'S REPORT
a. Department Monthly Performance Report Review
Mrs. Wilson provided the December 2012 Monthly Performance Report with highlights
of division activity provided.

11. DENTIFY ITEMS TO BE PLACED ON NEXT AGENDA
• Update on Resolution
• Requested by Vice-Chairperson Alonzo - Presentation - by City of Corpus Christi
Human Resources Department regarding how the city is prepared to handle a bill that
may be signed by President Obama indicating that entities who receive government
funding will need to hire a 7% of disabled people.

To ALL BOARD,COMMISSION AND COMMITTEE STAFF LIAISONS AND ASSISTANTS:
It has come to our off ices attention that many Staff Liaisons and Assistants are not calculating board member's
attendance properly. The reason we have an attendance policy in effect is so that it will enforce the importance of a
member's attendance,and so a board CAN MAKE A QUORUM to hold the meeting.
Please seethe excerpted paragraph below from a Legal Opinion from former Assistant City Attorney,Jimmy Bray,in
2009:
"An individual is automatically terminated if he/she misses more than 25%of the regularly scheduled meetings in a term
year. Attendance rates are calculated per term year based on the number of regularly scheduled meetings. If meetings
are cancelled due to lack of a quorum and the individual was not present,he/she is counted absent. if a meeting was
cancelled it is not subtracted from the meetings which were regularly scheduled for calculation of the 25%attendance
rule.'

out to you soon.
What determines a quorum in a Board meeting? How does not meeting a quorum affect the Board Member's
Attendance policy?
Answer: A quorum is the minimum number of members needed to officially conduct business. It is a simple majority of
the membership(5(Y%+1),unless stated otherwise by ordinance or by-laws. If meetings are cancelled due to lack of a
quorum and an individual is not present,he/slue is counted absent. When calculating the attendance of a member for a
term year,you continue to count the regular number of meetings held annually,even if a quorum is not met to hold the
meeting You then calculate the number of"excused"or"unexcused"absences.
What determines an"excused absence"from Board meetings?
Answer: The Attendance Policy states"An absence shall be deemed unexcused unless excused'by the board for good
cause no later than its next meeting after the absence. Each board must review and grant excuses only for good cause.
Each board may want to establish its own internal policy as to what constitutes good cause to provide a consistent,
rational procedure for granting excuses. Examples we have seen are illness or hospitalization,immediate family
emergencies/deaths,planned vacations(with advance notice),and out-of-town business trips(with advance notice).
When a member seeks reappointment to a board or commission,we ask to see the attendance records for the past
Term Year,which is defined as that annual period after which a term is normally scheduled to begin. Many of you are
only calculating the number of meetings held WITH a quorum. That is incorrect. You need to calculate the number of
ALL regularly scheduled meetings. If the meeting cannot be held due to not making,a QUORUM,then those who do not
attend are counted absent,unless excused by the board for goad cause no later than its next meeting after the
absence. Absence at meetings that are postponed and held on days that are not regularly scheduled(special called
meetings),should not be counted in determining whether an individual has missed more than 25%of the meetings in a
term year.
When a member is getting close to missing 25%of the year's regular meetings,you should inform your board members,
and apprise them of the attendance policy.

guest for the event benefiting MHMR of Nueces County,the local behavioral health
community center in our community. 'rhe evening will include live music,dinner and a
silent auction.
Four award recipients will be honored for their support of our Center and for working to
improve the lives of persons with mental illness and intellectual disabilities.
