Eight members requested excused absences—as reflected above. Those present elected to stay for an informal discussion on up-coming issues and non-voting related items. . APPROVAL OF THE MINUTES The May 6,1999 minutes were pending—staff member who prepares them has been out on FMLA. The May minutes will be submitted for approval at the next scheduled meeting. • ' CHAIRPERSON'S REPORT—Rev.Willie Davila • • COMMISSIONERS/COMMITTEE REPORTS • Housing Committee/Revision of City Ordinance—Commissioner Olga Tamar . • Mayor's Task Force for Persons with Disabilities—Commissioner Toni Tamez - • NEW BUSINESS • OLD BUSINESS • ADMINISTRATOR'S REPORT • PUBLIC COMMENTS-Limited to two(2)Minutes As there was not a Quorum and this was an informal meeting,no reports were presented for the above referenced categories. GENERAL DISCUSSION Introduction of two(2)new Commissioners and current Commission Members to public and other Commission Members who were present: Commissioners are encouraged to ask questions or for clarification on any issues,when there is a need. Tentatively plan to have a training workshop in September or October— all new Commissioners can then attend the workshop to understand the scope of their duties and responsibilities. There was a brief review of duties and responsibilities, opportunities in service areas within the Commission. Additionally,there was discussion on how the Commission reaches out to the community in areas of potentialconflict and offer an opportunity,to mediate and resolve concerns and issues. Dr.Gurley gave a brief review on the current standing of the Disparity Study and the request by UT-Austin,for an extension on their contract to ensure a good study. (Dr.Gurley explained the City was conducting a study regarding public contracts with the City.) The City is trying to determine if minorities and women are receiving equitable opportunities,as others are within the community. Because of some changes made to the investigative processof the study,Dr.Wainwright at the UT- LBJ School of Public Affairs, requested an extension. The City Manager assigned Dr. Gurley the responsibility of 1 SCANNED monitoring the contract and ensuring they completed it on time. As Dr.Gurley had not signed the contract,'she needed to go back to the Council with the request. The.City Council unanimously granted the extension,until October 19t,at which time the University,Researchers are to give their final report to the City Council. The report will provide information on whether or not there is disparity within the City of Corpus Christi's contractual process(inclusive of professional services contracts;engineering contracts;purchasing and supplies contracts—involving every type of contract entered into by the City). In the past ten(10)years,we have had something like 300,000 contractors come through the City. We are trying to find out how many of those were minorities or women owned businesses. It didn't matter what size of the contract. If there is a finding of disparity within the City,then we will recommend to the.City Council the possibility of an Affirmative Action Plan or a Set-Aside Program(one or the other or possibly both)to ensure that business men,women,and minorities have an equal opportunity.The City stopped the Set-Aside Program they had in place as of last April,because they could not prove discrimination existed within the City. Therefore the City needed to look more closely at recent Supreme Court , decisions,i.e.:Crossen vs.the City of Richmond,VA. That's what we are developing and working under. Also,under Adaran vs.Denver,CO,a couple of years ago-the law says in order for a City to have a Set-Aside Program or Affirmative Action Program,they need to show that past discrimination has existed..That is why they are going by"strict scrutiny"and on October 19th,we will know. If there is disparity,the Program will be monitored by the Human Relations'Department. There was further discussion on the criteria to be used during the investigation to determine if discrimination exists—the type of statistical category breakdown. The service area does extend beyond the Corpus Christi area. The information will be reviewed by the members of the Disparity Study Committee(various City,Department Heads;who let out the various contracts),the Assistant City Manager of Administrative Services and City Council. If there is no disparity,then we will be looking at how we can ensure that we will not have problems in the future.and steps we can take to ensure it. Annual Quality Training Conference—copy of departmental memorandum was issued to those present. This was distributed to City employees. Mass mail-out of conference brochure will be mailed out next Monday. General discussion about special guests/speakers and miscellaneous conference details. Dr.Gurley touched upon Housing grant and Housing Assessment Project that is in the works. Chairman Davila raised a question about testing? Dr.Gurley explained that the City does not currently have a qualified individual to oversee the testing,which is a requirement. Dr.Gurley reviewed the Agenda,doing very well with our speakers—certificates for Attendees and Speakers. Dr.Gurley .discussed the role"of the Commissioners. She requested they notify her the best time in their schedule for them to be Moderators groups for mornings and afternoon—2-3 each group. The Mayor,City Council and City Manager have been invited to attend and/or provide some introductions at the Conference. The duties of the Moderators are to introduce session speakers—we will have their bios'and materials in the manual for the conference. Commissioners are welcome to come and attend the entire conference—there is a lot of valuable information that is shared. It is also a good opportunity for Networking with the community,and introduction of all the Commissioners.' Human Relations Budget—there was a request for the Department to cut back$25,445,but Dr.Gurley explained that her supplies don't even equal that—this kind of cut would requirelosing a staff member. After discussion with the City Manager,it was to reduce$3,609 from Travel/Training(HUD related cancelled). Will need to wait for HUD monies. There was anticipation that with all the changes and new intake processes,it is hoped that we could send at least 2 staff members. Clarification that the revenue the Human Relations Department/Commission generate for the City—those funds" will go into the General Fund,and the City designates what budget funds will be given each year—the revenue does not come to the Department. HUD contract=once housing cases are taken and case closures'occur the City will receive $1,750 per case. EEOC contact case intakes are reimbursed at$50 for each intake-for case closures$500 for each closure. Dr:Gurley mentioned intention to plan a new Commissioner workshop—training session. She gave a general overview of the Human Relations Departmental Monthly report.
