Special Called Marina Advisory Committee

Call to Order: Mr. Davidson called the special called meeting of the Marina
Advisory Committee to order at 1:00 p.m.
Presentations and/or Public Comment: There was no public present. Mr.
Davidson provided a brief history of the Marina, Marina operations, Water/Shore
Advisory Committee accomplishments and establishment of the new Committee.
Discussion Items and Possible Action Thereto:
Determine Meeting Schedule — Mr. Davidson opened the floor for discussion
relative to establishing a regular meeting schedule. Discussion followed. The
motion was made and seconded to set the first Monday of each month on which to
schedule Committee meetings which will begin at 5:30 p.m. in the Lawrence
Street T -Head Boaters' Facility. The motion passed unanimously.
Discussion followed regarding: budgeting issues; advertising/marketing Marina
via periodicals/boat shows; need to elect Committee officers, establish Committee
rules/regulations; Mr. Adams, Ms. Adams, Mr. Patel, Mr. Stolzlechner and Mr.
Suter being required to complete Open Meetings Act training by March 17, 2008;
determining Committee (staggered) term expirations; training sessions for required
Open Meetings Act training with other new Committee members; using list of
priorities established by Water/Shore Advisory Committee and Facilitator as a
place from which to start; planning a retreat and/or using subcommittees to address
Committee's plan of action; Bond 2008 projects including new Marina Office;
new Marina Patrol Boat and Marina Security System being funded through
Homeland Security; etc. (Note: Mr. Cagle left at 2:03 p.m.)
Adjournment: As there was no further business, the meeting was adjourned at
2:09 p.m.

Due to several years of increased expenditures for power, water and garbage services
to the Marina, it has become necessary for Marina management to implement an
increase in the basic charges for Marina utility services.
This notice is to provide each Marina tenant the required thirty (30) days advance
notice of a rate increase which shall become effective on March 1, 2008.
The rate increase is as follows:

Prior to construction of the new Peoples Street docks, Marina Tenants were
advised the City/Marina would not raise Boat Slip Fees for two years. We are
now going on year three and wish to leave slips rates the same so as to attract
more/new customers.
Due to increased utility/electrical costs to the Marina, it is prudent to raise the
monthly utility recovery fees 25% [including electrical, water and garbage
collection seven days a week AND the three boaters' facilities and three sets
of public restrooms now in operation). (See attached spreadsheet/history)
Marina utility costs at the Corpus Christi Municipal Marina are inexpensive.
City Ordinance requires that Marina Tenants be advised 30 days in advance of
a rate increase. Therefore, the February 2008 billing statements (mailed
01/25/08), included a flyer announcing the proposed March 1, 2008 utility rate
increase.
The increase, based on currently leased Marina slips, is expected to bring in
approximately $ 1,237.51 per month.
Marina tenants may voice their concerns. To date, the Marina has received
only one complaint/comment from a Marina Tenant specifically relative to
the amount assessed relative to the overall length of his vessel.

MARINA ADVISORY COMMITTEE
DUTIES: To advise and make recommendations regarding development, use, or preservation
of the marina, including the following: (1) assist the City Council in providing for
the orderly, planned development and use of the marina; (2) review the annual and
capital improvement budgets regarding the improvement and maintenance of the
facilities upon the marina; and (3) review and recommend to the City Council the
feasibility of development, improvements, maintenance or proposed uses for the
marina.
COMPOSITION: Nine (9) members appointed by the City Council for two-year terms. The
membership shall include one (1) Scientist, i.e. Marine Biologist, one (1) Engineer,
and one (1) Environmentalist; one (1) shall be a representative of a restaurant located
within the boundaries of the marina. The Chairperson of the Marina Advisory
Committee shall act as an advisor to the Park and Recreation Advisory Committee
and vice versa. In the initial appointment members will serve an initial two-year
term, in the succeeding term, 5 members will serve a two-year term, and 4
members will serve a one-year term, as determined by drawing. Thereafter, all
terms will be two -years.

A RESOLUTION
AMENDING COUNCIL POLICY 14 "BOARDS, COMMISSIONS,
AND COMMITTEE PROCEDURES" TO PROVIDE FOR
ELIGIBILITY FOR REAPPOINTMENT TO THE SAME BOARD,
COMMISSION, OR COMMITTEE; TO PROVIDE FOR TIME OF
CONSIDERATION OF APPOINTMENT; AND TO PROVIDE FOR
A PERIOD WHEN NO APPOINTMENTS ARE TO BE MADE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION'1. That Council Policy 14 "Boards, commissions, and committee
procedures," adopted by Resolution No. 021901 on March 22, 1994, is amended
to read as follows:
"14. Boards, commissions, and committee procedures.
"All individuals considered for appointment by the City Council to a Board,
Commission, or Committee must have a resume or biographical
information sketch on file in the office of the City Secretary. All vacancies
must be listed on a City Council agenda in order for appointments to be
made. Any Council Member can nominate persons to fill vacancies,
except where the law requires nomination by the Mayor or City Manager.
Each appointment must receive a majority vote of the Council Members
present and voting.
The following rules and procedures will govern standing City Boards,
Commissions, and Committees:
m. No person may serve as a voting member of a board, commission, or
committee of the City for a period longer than six (6) years
consecutively unless such service is required by virtue of the person's
position or title as the result of employment or to complete an
unexpired term. No person may be reappointed to the same board,
commission, or committee after having been appointed to terms that
would provide for six (6) consecutive years of service as a votin4
member unless the person has not served on that board, commission,
or committee for a period of twelve (12) months. No person shall be
appointed by -the Mayor or City Council to serve on more than one
board, commission, or committee of the City at the same time unless
required by charter, statute, or other ordinance or when such service is

required by virtue of the individual's position or title as the result of

The foregoing limitations do not apply to the appointment of advisory,
nonvoting members to a board, commission, or committee of the City.
Any such advisory, nonvoting member appointed to a board,
commission, or committee of the City is prohibited from serving as an
elected or appointed officer of the board, commission, or committee to
which such person has been appointed.

SECTION 1. That Chapter 2 "Administration," Article IV "Miscellaneous boards,
commissions, and committees," Division 1 "Generally," Section 2-67 "Limitations on
appointments," of the Code of Ordinances, City of Corpus Christi, Texas, is amended to
read as follows:
"Sec. 2-67. Limitations on appointments.
(a) No person may serve as a voting member of a board, commission, or
committee of the city for a period longer than six (6) years consecutively
unless such service is required by virtue of the person's position or title as
the result of employment or to complete an unexpired term. No person
may be reappointed to the same board commission or committee after

SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance shall be held invalid or unconstitutional by final
judgment of a court of competent jurisdiction, it shall not affect any other section,
paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the
definite intent of this City Council that every section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance be given full force and effect for its purpose.
SECTION 3. That all ordinances or parts of ordinances in conflict with this ordinance
are hereby expressly repealed.
SECTION 4. That upon written request of the Mayor or five Council members, copy
attached, the City Council finds and declares an emergency due to the need for
immediate action necessary for the efficient and effective administration of City affairs
and suspends the Charter rule as to consideration and voting upon ordinances at two
regular meetings so that this ordinance is passed upon first reading as an emergency
measure on this 22nd day of January, 2008.

Rules and Regulations of the
Corpus Christi Marina Advisory Committee
Article 1— Authority.
The Corpus Christi Marina Advisory Committee shall function in accordance with
the ordinance(s) of the City of Corpus Christi to include the Marina Advisory
Committee Ordinance adopted on September 11, 2007. The Rules and
Regulations of the Committee are binding on its members; however, the
Committee has no binding authority or decision making power on matters external
to the Committee.
Article 2 — Function
The Corpus Christi Marina Advisory Committee serves as an advisory body to the
City Council on all matters pertaining to the delivery of leisure services to the
citizens of Corpus Christi. Specifically, the Committee shall advise and make
recommendations regarding development, use, or preservation of the Marina (see
"Definitions"), including the following:
a. Assist the City Council in providing for the orderly, planned development
and use of the Marina.
b. Review the annual and capital improvements budgets regarding the
improvement and maintenance of the facilities upon the Marina.
C. Review and recommend to the City Council the feasibility of development,
improvements, maintenance or proposed uses for the Marina.
Article 3 - Membership, Officers, Attendance, Duties.
a. MEMBERSHIP. The Committee consists of nine (9) residents of Corpus
Christi appointed by the City Council. The standard term of office is two
years with a maximum term limit of six years. Membership on
subcommittees shall be by appointment of the Committee Chair. The
Corpus Christi Parks and Recreation Department Director or his/her
designee is recognized as the ex -officio member of the Committee.
b. OFFICERS. The Officers of the Committee are the Chair and the Vice
Chair. Each shall be elected from the membership of the Committee at its
first regular meeting September or as soon thereafter as a full Committee
membership has been appointed by the City Council. The term of the
Chair and Vice Chair will be for one year. The Chair and the Vice Chair
may be re-elected.
c. ATTENDANCE. Members of the Committee are expected to comply with
City Code Section 2-61 that attendance will be regular. The Chair will
notify the City Secretary's Office in writing when a Committee member is
no longer in compliance with City Code Section 2-61.
1. Excused Absence Policy of the Marina Advisory Committee. A
member will be allowed three absences (25% of meetings) per term
year. No excuse will be necessary. If a member finds that he/she
will be absent more often than three times per year, the member
should consider resignation from the Committee. A member, who
exceeds the prescribed number of absences, but would like to
remain on the Committee, may claim extenuating circumstances.
The member must petition the Committee immediately following
the fourth absence or subsequent absences with a written
request for reinstatement on the Committee. The Committee,
with a quorum of members present, shall vote (simple majority)
at a regularly scheduled meeting to reinstate or not reinstate
the member.
d. DUTIES. The duties of the Committee are cited in Article 2. The duties of
the Chair are to preside over all meetings of the Committee, to ensure that
all matters before the Committee are handled appropriately, to appoint
members to subcommittees as necessary, and to meet with the appropriate
ex -officio members to develop the agenda for all meetings. The Chair shall
act as an advisor to the Parks and Recreation Advisory Committee. The
duties of the Vice Chair are to assist the Chair as needed, and to act a Chair
in the absence of the elected Chair.
e. CODE OF ETHICS. Rules of conduct apply to all Committee members
including special privileges, gifts, conflicts of interest, and actions adverse
to the city.
Article 4 - Meetinis, Agendas.
a. REGULAR MEETINGS. Regular meetings of the Committee will be held
on the first Monday of each month at 5:30 p.m. in the Lawrence Street T -
Head Boaters' Facility, 400A North Shoreline Boulevard. Each member
will be mailed a written notice of the regular meeting which will include an
agenda as well as materials related to the agenda items. A meeting will not
be held if there is no business for the Committee to address. All regular
meetings shall be held in accordance with the Open Meetings Act.

SPECIAL MEETINGS. Special meetings may be called by the Chair or
upon request of two members of the Committee. When time permits an
agenda shall be prepared and distributed in accordance with the provision
cited in paragraph (1) above. Special meetings shall be conducted in
accordance with the Open Meetings Act. 01
C. SUBCOMMITTEE MEETINGS. The Chair of a subcommittee will notify
the Committee Chair of the date, time, and place of subcommittee meetings
at least three days prior to the meeting.
d. AGENDA. The Committee Chair will develop the agenda with the
appropriate ex -officio members and insure its proper distribution as
stipulated above. The format for the agenda will be:

IV. Presentations and/or Public Comment
V. Discussion Items and Possible Action Thereto
VI. Executive Session
VII. Committee/Staff Reports
VIII. Director's Report

Members of the Committee wishing to place an item on the agenda for
presentation, discussion or action must submit their request, in writing, to
the Chair at least six business days prior to the required posting. Citizens
wishing to place an item on the agenda for presentation or discussion must
submit their request, in writing, to the Chair at least six business days prior
to the required posting. Citizens wishing to address the Committee may do
so during the "Public Comment" section or during the discussion of an
agenda items if they are recognized by the Chair.
Article 5 - Subcommittees, Voting, Option.
a. SUBCOMMITTEES. Subcommittees shall be appointed by the Chair as
needed.
b. VOTING. All votes will be voice votes. If the Chair is uncertain of the
decision as a result of a voice vote, he/she may request a (re)vote by show
of hands. Members of the Committee must be present to vote. The Chair
and Vice Chair may vote on all issues. Should a tie vote occur the Chair
may call for additional discussion or a motion to table the issue.
If a member must disqualify himself/herself due to a conflict of interest
he/she must state this at the beginning of discussion. The minutes of the
meeting must reflect this disqualification.
1. QUORUM. A majority of the Committee membership holding
office will constitute a quorum.

Article 6 — Minutes.
The City Manager shall appoint a staff member to keep minutes of the Committee
and prepare such assistance as the Committee may request. Subcommittee Chairs
are expected to provide minutes to the Committee in the form of Subcommittee
Reports.
Article 7 - Staff Support.
The duties of the Committee make it necessary that staff members be available to
discuss agenda items as needed. Requests for staff support should be directed to
the ex -officio Committee members. When a Committee has a major document to
present, the Chair may request staff support in its preparation.
Article 8 - Committee Handbook.
The new members of the Committee will be provided a Handbook containing the
Ordinances, Rules and Regulations, informational materials, and policies as they
are developed.
Article 9 - Changes to the Rules and Regulations.
Changes to the Rules and Regulations of the Corpus Christi Marina Advisory
Committee may be made by a two-thirds (2/3) vote of the full membership of the
Committee.
Article 10 - Rules of Order.
Except as noted in the Articles of the Rules and Regulations of the Corpus Christi
Marina Advisory Committee, Roberts Rules of Order will be followed.
Article 11— Definitions.
"Marina: All structures, waters, and lands within the area enclosed by the
breakwater fronting Shoreline Boulevard from the breakwater terminus at north of
South (McGee) Beach to its junction at the foot of Breakwater Avenue.
