Better Future VARIANCE TO THE PLUMBING CODE
On July 25, 2005, Mr. Jack Taylor requested that the Plumbing/Mechanical
Advisory Board vary the application of Section 701.3-Chapter 7 described as
Separate sewer connection.

History on Presentation given by Mr. Jack Taylor:
• Gary Martin, owner of the land talked him into purchasing 10 acres
• A verbal agreement was made to purchase the lift station from Mr. Martin
• Asked for permission from City to tie into the sewer line
• In September 5, 2002, Mr. Taylor was handed an agreement
• Had to generate easement agreement letter for the utility line
• City will not allow the Lift Station to have a septic system
• Someone was left out of the loop
• Cannot obtain a certificate of occupancy from the City of Corpus Christi
• Cannot change rent or occupancy
• Been tied into the lift station for 2 years
Mr. Taylor provided the following documentation all board members:
• Letter to City of Corpus Christi and Nueces County that states that MTM Northwest
Management, Ltd. agrees to share responsibilities of expense and maintenance along with
Gary Martin and Romel Gregorio of the lift station located at 14317 Northwest Blvd.
• Letter from Romel Gregorio of Bay Area Athletic Club that states the club currently uses
the lift station located at 14317 Northwest Blvd. The letter also states that Mr. Gregorio
agrees to share responsibility of the lift station with Gary Martin and MTM Northwest
Management, Ltd.
• Letter from Gary Martin that states that he agrees to share in the expense and
maintenance of the lift station located at 14317 Northwest Blvd.
• Easement Agreement for Utility Line Doc#2004007992
• Use privilege agreement between the State of Texas and the County of Nueces that states
the Martin's have privilege for the right to install, operate, maintain. And remove a 3 inch
diameter PVC force (wastewater)main.
QUESTIONS ASKED BY BOARD MEMBER
Do you have everything tied to septic right now?
Response: No,Jack Taylor is the only one tied to it.
Is the property platted for two separate owners?
Response: Yes it is.
Comments by Director, Barbara Holly:
• Private system
• The City is helping to facilitate the situation
• The City's legal office has given their approval
• Correcting the connection of the lift station will take a series of steps through City
Council
• There are three independent parties and three co owners involved

History given by Joseph Elliott, Chief Plumbing Inspector:
• Gary Martin subdivided the property
• After the property was subdivided, he sold back half of it to Bay Area
• Not asking the board to grant a code violation, asking for three owners to come to an
agreement(Dr.'s Office, Bay Area Athletic Club, and Jack Taylor's Lift Station)
• All investigation have been completed
• Plumbing Inspectors were left out of the loop
• Chapter 7 of the commentary states that owners should not cross property lines
• Mr. Taylor is at the Certificate of Occupancy stage and is on hold until a decision is made
by the board.
• Mr. Taylor and other parties have agreed to share the responsibility of maintenance on
the lift station.
QUESTIONS ASKED BY BOARD MEMBER
Why don't you buy your own lift station?
Response: We can, but we still have to connect to the force main.
How much capacity are we at?
Response: Will handle 60 under one pump before second pump kicks in. The max is 38 gallons
per minute.
Are we setting precedence?
Response: No. No precedence is being set. The board would be granting alternate means on a
temporary basis. There will be no value and there can be amendment to the property records.
If approved,how can he get a certificate of occupancy?
Response: If the board rules favorably, a release will be made and a certificate of occupancy will
be issued.
Comments by Joseph Elliott, Chief Plumbing Inspector:
• The original use privilege agreement is being modified by the City of Corpus Christi's
legal department.
• Staff recommends that the board grant Mr. Taylor the alternate means to the Plumbing
code by its original agreement to have shared responsibility and common connections.
A motion was made by Ray Johnson to approve the variance to the Plumbing/Mechanical
Advisory Board. Appeal No. PM 0805-01 as presented by Chief Plumbing/Mechanical Inspector,
Joseph Elliott. The motion was seconded by Scott Corliss. The motion was approved at 2:56 p.m.
