Chairman Miller called the meeting to order at 2:00 p.m. , in the Committee
Room on the first floor of City Hall.
The first item of business was the approval and corrections of the minutes
of the prior meeting of August 12, 1993. A motion was made by Mr. Lew Larson,
seconded by Mr. Zernie Smith, and passed unanimously to approve the minutes.
The public hearing was opened on Appeal No. P93-7. The appellant was
Eugenii. C. Urban, representing Kmart Corporation appealing interpretation of
Plumbing Code, Sections 704.2.3 and 1303.3 regarding Pipe Cleanout Spacings and
Drainage Pipe Installation Slopes.
Fir. Lelland Kirbow, Chief Plumbing Mechanical Inspector described the
Q appeal to the board. He stated that it was not in compliance with the code in
regards to the spacing of cleanouts which was not to exceed 75 feet and a
LJLJ drainage installation slope of (1/8") one-eighth inch per foot. He also stated
that the staff recommended code compliance.
Mr. Chuck Urban of Urban Engineering made a presentation on behalf of the
QKmart Corporation. Mr. Urban requested that the 75 foot cleanout spacing
Urequirement be modified since an alternate use requiring manholes spacing would
co be used at 300 foot centers maximum. Mr. Urben submitted calculations addressing
pipe sizing and flow parameters for the Boards review. He pointed out that
pipe size and flow on a calculated basis would satisfy State and engineering
design criteria.

%./v/ '. Lew Larson made a motion, seconded by Mr. Murray and passed unanimously
to allow the alternate method of construction based on the design calculation,
flow and pipe sizing as submitted to the board.
The public hearing was opened on Appeal No. P93-8. The appellant was John
Neugebaure, representing 3uilders Square requesting the Boards Concurrence for
an alternate material and method of construction as per Plumbing Code Section
103.7.
Mr. Lew Larson abstained from the discusssion and voting due to a possible
conflict of interest and excused himself from the board.
Mr. Lelland Kirbow, Chief Mechancial Plumbing Inspector explained that the
proposal submitted by Builders Square was short in toilet fixtures therefore it
did not comply with the Plumbing Code. He added that staff recommends full code
compliance. Mr. Kirbow pointed out that at the time the project was permitted
a code complying design had been approved. He explained that upon inspection it
was noted that the required facilities had not been constructed field correction
notice was issued. Subsequently, an alternate proposal was submitted which was
non code complying.
Mr. John Neugebaure, made a presentation on behalf of Builders Square. He
stated that based on a survey conducted they did not see the need for additional
fixtures and therefore were not proposing any additional fixtures.
Mr. Neugebaure then requested that the board consider a variance of their
appeal based on the survey calculati.or;s as presented, and that the board consider
Builders Square a warehouse and not as a retail store. He added that certain
parts of the code consider the use a warehouse, and a lumber yard.
Mr . Rector made a motion, seconded by Reed Glendenning and passed
unanimously that the proposal alternate as requested be denied and full code
compliance be required.
The public hearing was opended on Appeal No. P93-9. The appellant was
Thomas E. Ferrell, representing H.E. Butt Grocery Company requesting the Board's
concurrence for an alternate material and method of construction as per Plumbing
Code Section 103.7.
Mr. Lorenzo Gonzalez, Building Official informed the board that Mr. Ferrell
had withdrawn appeal P93-9 and stated that H.E. Butt Grocery would be in full
compliance with the City Plumbing Code.
The meeting was adjourned at 2:40 .m.
