Julian Grant, Legal Dept. *Absent 1, Meeting was called to order by Staff Liaison, Neoml R, Ramirez at 2-103 p.rn, 11 Roll Call of Members—Quorum present II board members present Ill. Selection of Board Chair and Co-Chair—Robert Gutierrez nominated Bill Stein for Board Chair, Valerie Gray second nomination Vote for Chair was unanimous, Bill Stein nominated Robert Gutierrez for Co-Chair, Margie Rose second nomination, Vote for Co-chair was unanimous. Let the record reflect Chair is Bill Stein, and Co-Chair is Robert Gutierrez. IV. Designate regular meeting schedule—Margie Rose motions to have Regular Meetings scheduled on the 31d Thursday of each month at 3:00 p.m.,Valerie Gray second motion. Regular meetings will be conducted each month unless there are no appeals to be heard, in that event regular meetings will be cancelled by board chair. V. Valerie Gray motion to adopt Roberts Rules of order, Gus Gonzalez second motion. Vote was unanimous, it directed staff too tin copies of Robe 's rules of order for all Board Members before next meeting. Meetings will proceed as a Quasi-Judicial setting is excludes public comments,with Robert's rules of order for Street Maintenance Board of Appeals. V1. Review draft of Board Rules—Legal Department will present at next meeting. Summary of Draft of Board Rules will include description of type of motions, burden of proof necessary for re-designation, standards and procedural matters that are necessary for a Quasi-Judicial forum. Also,subject matter to follow ordinance, describe authority of the board,type of actions that ran be taken. Margie Rose motioned to table review of draft of Board Rules ton meeting. Valerie Gray second motion. to was unanimous it to table unfit next meeting. VII. Review and approval of December 19,2013 minutes, Chair request to receive minutes in the future prior to meeting for review. Margie Rose motions to approve minutes Robert Gutierrez second motion. Vote taken, motion passes to adopt minutes as written without changes. VIII. Old Business—Presentation of Appeal Cases—Discussion and Possible Action Page 1 of 2 A. SMF-0003 1C0 District 37A&York Rite Masonic Lodges 0 Corpus Christi Lodge 189,4114 Weber Road & Oso Naval Lodge 1282, 3215 Reid Drive 0 Independence Lodge 1337, 1442 Shely Street a Del Mar Lodge, 1350, 1305 Woodlawn Drive ® Sunset Lodge 1388, 1814 Lodge Lane a York Rite Masonic Temple, 2638 Terrace Street 1 Mrs. Ramirez presented case findings and research on the various Masonic Lodges is did not indicate any different usage of properties other than private lodges with minimal traffic patterns Based on the information provided for the appellant properties staff supports land use change to either appellants request of general office building or to staff recommendation to corporate headquarters building. Z Mr, Vincent Muscarello presented their case that the 6 local masonic lodges have specific is in it by laws that prohibit them from serving alcohol and renting these facilities a) Discussion by board and their concerns on the submission of consolidated appeal case this particular instance was allowed because of the similar usage and traffic patterns butt y are all separate appeals and will be motioned and voted on as separate cases. b) Additional concerns by board is that if this re-designation is granted what keeps others from this designation coming forward requesting same change. Also,what happens if change is made to land use how we are monitoring any future changes to the business? Staff stated each appeal is researched on a case by case bases and any designation change is not automatically going to change others in this category, Also, Certificates of Occupancy issued by the City of Corpus Christi are monitored by SMIF staff to determine any re-designation changes necessary based on revised land use for properties. C) Gus Gonzalez makes 6 motions to re-designate all presented locations to 714 Corporate Headquarters, Robert Gutierrez second all 6 motions. Vote was unanimous and re-designation is granted, Ix. Identify items to be placed on next agenda A. Meeting packet will be distdbuted to board members on Monday prior to meeting. B. Board Rules from Legal Department X.
