CALL TO ORDER Vice Chairman Karm called the meeting to order at 6 :30 P.M. , and described the procedure to be followed. , Mr. Gunning stated that Mr. W.L. Tagliabue has requested that Application 192-5 Bishop Rene H. Gracida be postponed. Motion by Hall, seconded by Taylor that this application be tabled. Motion passed with Hall, Meinrath, Taylor, Wickham and Karm voting aye, and Sanchez and Mims being absent. PUBLIC HEARING NEW ZONINGS Shell Development Company: 292-2 REQUEST: From "B-4" General Business District and "A-2" Apartment House District to "R-1B" One-family Dwelling District on 33 .3 acres out of Lots 17, 18 and 31, Section 6, Flour Bluff and Encinal Farm and Garden Tracts, located between Yorktown Boulevard and Oso Parkway, and between Everhart Road and Club Estates Drainage Outfall. Mr. Gunning described the land use and zoning in the surrounding area, and stated that the applicant is requesting a * Chairman Mims arrived at 6 :35 P.M. ** Commissioner Sanchez arrived at 6:38 P.M. SCANNED Planning Commission Meeting February 12., 1992 Page 2 change of zoning to develop 110 single-family lots . The property is currently vacant. Mr. Gunning summarized the Staff Report, informing the Commission of applicable Policy Statements, and quoted from the Southside Area Development Plan. The applicant proposes to develop 110 single-family residences on a 33.3 acre site. A preliminary and final plat for a single- family subdivision has been submitted concurrently with the zoning application. The single-family development can occur within the existing zoning classifications, however, the requested "R-1B" One family Dwelling District would protect the future residents from residential properties converting to commercial or apartment uses. The proposed residential development can occur within the `•'exiting "B-4" General Business District and "A-2" Apartment House District as a matter of right, provided the "R-1B" requirements for a minimum lot area of 6 ,000 square feet and a minimum lot width of 50 feet are met. The front yard setback in the existing "B-4" and "A-2" Districts is 20 feet, whereas the front yard setback in the requested "R-1B" District is 25 feet. Commissioner Mims arrived at this time. Overall, the proposed physical layout and development of single-family residences under the existing zoning is comparable to that in an "R-1B" District except for differences in the type of uses permitted. On the 15. 2 acres zoned "A-2" , a property owner could legally convert their residence to an apartment, boarding house, hospital, or nursing home. On the 18 . 1 acres zoned "B-4" District, a property could be legally used for general business such as an auto repair, or a bar. These types of uses in the middle of a single-family development are detrimental to the surrounding residences and inconsistent with City Council adopted policy statements . Rezoning the subject property to an "R-1B" District is appropriate in order to protect the proposed single- family development. Mr. Gunning read to the Commission the pros and cons of this application from the Staff Report (copy on file) . Eight notices were mailed, three were returned in favor and none in opposition. Staff recommends approval. Commissioner Sanchez arrived at this time. Mr. Gene Urban, Urban Engineering, appeared, representing the ,applicant. He stated that they recognize that they can build. Planning Commission Meeting February 12, 1992 Page 3 without the requested zoning, but the existing zoning would not protect the home owners in the future. He felt that the existing zoning is not the highest and best use of the land. No one appeared in opposition, and the public hearing was ' declared closed. Motion by Karm, seconded by Wickham, that this application for "R-1B" One-family Dwelling District be forwarded to the City Council with the recommendation that it be approved. Motion passed with Hall, Meinrath, Sanchez, Taylor, Wickham, Karm and Mims voting aye, and Sanderson being absent. NEW PLATS „,Consideration of plats as described on attached addendum. TABLED ZONING 1) 192-5 Bishop Rene H. Gracida: "B-4" to "I-2" Located on the northwest corner of Morgan Street and Virginia Avenue Chairman Mims indicated that this application has been tabled at the request of Mr. W.L. Tagliabue, and will remain on the agenda. OTHER MATTERS None. MATTERS NOT SCHEDULED Chairman Mims asked if a new Planning Commissioner was appointed by the City Council, and Mr. Gunning replied that the City Council tabled that item at their last meeting. * * * * * * * * * * * * Chairman Mims stated that there are numerous signs located at Doddridge and Ocean Drive, and asked if they are legal. Mr. Gunning responded that he would investigate the matter. * * * * * * * * * * * * Commissioner Hall asked that the zoning case heard previously at this meeting be put on the agenda of the next Planning Commission Workshop for discussion. No one appeared in favor or in opposition, and the public hearing was declared closed. Motion by Taylor, seconded by Hall, that this plat be approved as submitted. Motion passed with Sanderson being absent. 2 . 019204-P3 Pontiac Tracts, Tract H (Final replat - 2 . 064 acres) Located north of Huisache Street between Interstate Highway 37 and Buddy Lawrence Drive Owner - Southwestern Refining Company Engineer - Govind & Associates, Inc. Mr. Gunning stated that there are no conditions remaining on this plat, and Staff recommends approval as submitted. No one appeared in favor or in opposition, and the public hearing was declared closed. Motion by Karm, seconded by Taylor, that this plat be approved as submitted.
