December 7, 2000 Members Present: Frank Beck,Alan Dinn(Chairman) (3),Dr. Oscar Garcia, Dr. Joseph Horvat(2), Steven Moody(Vice Chairman) (3), Terri Nicolau (1), Roy Pell (1) and Richard Poremba(2) Members Absent: Dr. JoAnna Mott (1) Staff Present: David Ondrias, Assistant Director of Operations, Peter M. Davidson, Marina Superintendent, Rene Garza, Marina Maintenance Technician and Benita Brunner, Marina Management Aide Call to Order: Chairman Dinn called the regular meeting of the Water/Shore Advisory Committee meeting to order at 5:30 p.m. in the Basement Training Room, City Hall. He welcomed Mr. Ondrias who replaced Mike Gordon in the Park&Recreation Department. Action on Minutes: The motion was made by Dr. Horvat, seconded by Dr. Garcia, to approve the 11/2/00 Minutes as presented. The motion passed unanimously. Public Comment and/or Presentation: Valerie Gray, Stormwater Superintendent, distributed informational materials and gave a brief history of the department's operations, areas of responsibility and how their operations affect the Marina environment. Sheldon Love, Stormwater Foreman, who tends two downtown pump stations and Jay Reining,First Assistant City Attorney, assisted during the presentation and answered the Committee's questions regarding general operations, capture systems, outfalls that flow directly into the Marina, designating Marina Staff to issue citations for violation of code enforcement,working with TNRCC, etc. No public comment was offered. Discussion Items: Director's Report - Mr. Davidson, Mr. Ondrias and/or Mr. Garza commented/reported on the: (1) Landry's closing on the purchase and beginning renovation of Joe's Crabshack at the Lighthouse Restaurant; (2) Bill Harrison continuing fuel operations while until the City negotiates with a new fuel operator; (3)month-to-month fuel operations during RFP process seeking new fuel operator; (4)removing the 20%cap of fuel prices; (5)new Marina Office; (6)inability to establish a separate revenue accumulation account for the new Marina Office; (7) urgent need to address Lighthouse/Landry's issue due to imminent bank foreclosure; and(8) fund balance. Discussion occurred regarding concerns about eliminating the fuel price cap; local fuel prices being comparable to those at other local marinas; weighing concerns against operability of fuel station; Committee again not having opportunity through special called meetings to address issues prior to their going to Council; and negotiating separate leases of valuable real estate for fuel and restaurant operations which do not also require provision of fuel operations and/or Marina offices as was the Water/Shore Advisory.Committee Meeting Minutes 1 scAN N EDDecember 7,2000 • original intent. Discussion followed regarding removing exclusivity; operator's requirements; anticipation for better fueling operations; fuel cap making it difficult to attract interested parties; Landry's paying past-due on temporary offices rental and continuing payments through June 2001; possibility of purchasing temporary buildings; Committee members meeting with City Manager to address issues that City Staff can not resolve; having City Staff attend meetings to address unresolved issues; what is called for per Ordinance for Committee responsibilities, not occurring; having special called meeting to address emergency issues; and providing fuel lease terms to Committee at next meeting. Committee Reports: None offered. Current Concerns: The motion was made by Mr. Beck, seconded by Dr. Horvat,to have a standing pledge of allegiance prior to each Water/Shore meeting. The motion passed unanimously. Discussion followed regarding pending subcommittee reports on slip feesand funding of electrical meter installation, costs associated with retrofitting/installing additional electrical meters Request for Information Agenda items: None offered.
