Water/Shore Advisory Committee
February 4, 1999
Members Present: Alan Dinn, David Krams (Vice Chairman), Steven Moody, Mercedes Salinas,
Trian Serbu (Chairman) and Roger Wright
Members Absent: Robert Forest, Dr. Horvat, Dr. JoAnna Mott
Staff Present: Marco A. Cisneros, Director of Park& Recreation,Mike Gordon, Assistant Director
for Operations,Peter Davidson,Marina Superintendent,Todd Jensen, Marina Operations Supervisor
and Benita Brunner, Marina Management Aide.
Call to Order: Chairman Serbu called the Water/Shore Advisory Committee meeting to order at
5:30 p.m. in the Committee Room at City Hall.
Action on Absences: The motion was made by Ms. Salinas, seconded by Mr. Dinn, to excuse Mr.
Serbu's absence from the 1/7/99 meeting. The motion passed unanimously.
Action on the Minutes: The motion was made by Mr. Krams, seconded by Ms. Salinas, to approve
the 1/7/99 Minutes as submitted. The motion passed unanimously.
Mr. Gordon introduced Marco A Cisneros, the newly appointed Director of Park & Recreation to
the Committee.
Discussion Items:
Sylvia Dancer's Request to Operate a Concession Stand in the Peoples Street T-Head Bandshell -
Mr. Gordon reported Ms. Dancer has operated the concession for the last two seasons selling
concession items and allowing entertainment. Mr. Gordon stated he will work with Ms. Dancer to
restrict noise levels to within the bandshell area and to secure a better schedule of events/activities.
Staff recommended approval of a use permit for less than one year at a rental rate of$300 per month
during the tourist season and$60 per month off-season. Ms. Dancer commented she will control the
noise levels to the best of her ability. She plans to operate the concession and/or provide an
entertainment opportunity for interested parties between the hours of 10:00 a.m. and 10:00 p.m.,
seven days a week. The motion was made by Mr. Wright, seconded by Ms. Salinas, to accept staff's
recommendation. The motion passed unanimously.
Public Comment and/or Presentations:
Clark Flato distributed a written presentation and commented on concerns if live aboards are
allowed, the bait stand lease and committee ethics. Dennis Fria commented on boat brokering
regulations. Discussion followed. Mr. Gordon reported that he and Mr. Davidson are interested in
improving brokerage in the Marina. Andy Ficken commented on concerns if live aboards are
allowed. Dean Whitsett commented on live aboards. Dr. Ed Bonner commented on concerns if live
aboards are allowed and committee ethics.

Mr. Wright commented that he moved aboard his boat with the knowledge of the previous Marina
Superintendent(Cook). The conflict of interest issue was discussed at that time and he was told there
would be no problem because it was a pilot program. He reported that since he has more recently
been informed that the live aboard issue may be a conflict of interest, he will excuse himself from
discussion of or voting on the issue in the future.
Mr. Gordon reported that the extensive research and evaluation going into the live aboard issue is
providing beneficial information. The policies have become extensive and are still in a draft stage
due to the magnitude of this issue. The new Marina Office and bait stand will provide some
facilities; however the Marina does not currently.have adequate infrastructure to support Live
aboards. There are several more steps that must be taken before live aboards can be considered i.e.
fee structure, revision of the slip rent agreement, etc. Mr. Davidson commented that in researching
the live aboard issue,other areas were found to require revision as well (compliance with zoning and
building codes, length of stay of visiting vessels, etc.). Mr. Gordon responded to questioning that
Staff has known about those currently living aboard the vessels and have taken that fact under
advisement. The steps to next be taken will be discussed with the Legal and Zoning Departments
and will be discussed with the City Manager as well. Discussion followed. Mr. Gordon responded
to questioning that current facilities may support a 2-3% overall live aboard allowance. The live
aboard issue will be a continuous process and once infrastructure is in place it would be more
appropriate to have a live aboard ordinance. Mr. Whitsett commented that the Bay Yacht Club
facilities were not being considered. Mr. Ficken commented about sanitation devices and the
apparent under use of the pump out facility. Mr. Moody commented about boats that have never
moved from their slips and the need for a log book for use of the pump out facility. Mr. Fria
commented that the TNRCC will investigate violators. Mr. Gordon commented that the live aboard
policies will come back in the future for the Committee to discuss.
Committee Reports: Mr. Moody reported that the Long Term Goal Subcommittee has met twice
to discuss numerous issues but were not ready to report at this time.
Director's Report: Mr. Davidson commented/reported on: (1) new Marina Office (barge and land
concepts); (2) piling project; (3) relocation of tenant only signs; (4) staff working to keep
bicycles/skateboard etc. off piers (also in newsletter); (5) no violation found with fuel costs; (6)
improving relations with local yacht clubs; (7) planned regattas; (8) request to locate windsurfing
school; (9) fire protection (Todd Jensen); (10) plans for relocation of water toys,Nina and shrimp
boats. Mr. Gordon commented/reported on City Manager's 1/27/99 tour of Marina.
Current Concerns and Events: Bill Harrison commented that the Lighthouse rent, which doubled
from$35,000 to $70,000 in 1995,was to have gone toward paying for a new Marina Office and that
the Lighthouse has paid$40,000 for the temporary Marina offices. The Lighthouse pays $168,000
annually to the City and ground has yet to be broken for the new Marina Office. He inquired as to
when the new Marina Office will be started/completed, if the additional rent has been set aside for
the new Marina Office and for how much longer he will be paying for the temporary Marina offices.
Discussion followed. Mr. Gordon responded to questioning that the Lighthouse rent goes into the
Marina Fund and is not specifically earmarked for the new Marina Office. Mr. Harrison commented
that he has provided the Marina free office space as required in the 1984 contract. He will be
renewing the lease for the temporary offices for which he has been paying for over the past two
years. In view of his financial difficulties, he asked for an idea of how long the rentals would be
required. Mr. Gordon assured Mr. Harrison Staff were moving forward with the new Marina Office.
Placing the Marina Office on a barge was discussed. There are three proposed sites to locate the
facility: (1) at the Wayward Lady site; (2) adjacent to old jet plane site on Lawrence Street; and (3)
in the corner of Lawrence Street between B-Pier and the stem. Discussion followed regarding
hurricane plans, etc. Mr. Davidson commented that using the barge facility will allow funds to
accumulate to build a proper Marina Office and the barge could be resold.
Mr. Gordon responded to questioning that Staff would be meeting with Jane Stubbs and her attorney
on 2/5/99. Plans could be contingent upon discussions at that meeting; however, consultants are
working on design and engineering. The plans in the location recommended by the Committee could
be modified. Ms. Stubbs responded to questioning that she had a letter of commitment from a bank
several years ago. She has a verbal commitment and will provide a written commitment from the
bank. Mr. Gordon responded to questioning that the engineering firm has a design on the pier, they
have cost estimates on piers and a slab and others have been contracted to do design work.
Discussion followed regarding the prices charged for fuel in the Marina. Ms. Stubbs, Mr. Harrison,
Randy Wolfe and Frank Beck participated with Committee and Staff members during this
discussion.
Adjournment: As there was no further business, the meeting was adjourned at 7:33 p.m.

All samples taken February 3, 1999 from sixteen sampling locations were well within Texas
Department of Health standards of 200 coliforms per 100 ml. for recreational waters.
