MEMBERS PRESENT: Quenten Cook, Chairman, Frank Beck, Charlene Forest, Robert Gross, David McKee, Vic Menard, Scott Skinner, Patricia Suter and Randy Thompson. There were no absences. STAFF PRESENT: Malcolm Matthews, Director of Park & Recreation, SiSu Morris, Marina Superintendent, Angel Escobar, Assistant Director of Engineering Services, Alison Gallaway, Assistant City Attorney, Lou Hilzinger, Marina Harbormaster and Benita Brunner, Secretary. CALL TO ORDER: Chairman Cook called the regular monthly meeting of the Water/ Shore Advisory Committee to order at 5:00 p.m. in the Committee Room at City Hall. ACTION ON ABSENT MEMBERS: The motion was made by Mr. Menard, seconded by Mr. Gross, to excuse David McKee's and Randy Thompson's absences from the October 1, 1992 meeting. ACTION ON MINUTES: The motion was made by Ms. Suter, seconded by Mr. Skinner, to approve the October 1, 1992 Minutes as presented. Motion passed. COMMITTEE REPORTS: Marina Facility Use Subcommittee - Mr. Beck reported that his subcommittee met once briefly to discuss non-water related businesses operating in the Marina. The subcommittee had expressed a preference to disallow such businesses. Mr. Beck requested direction from the Chairman on how the subcommittee should proceed and what final product was desired. Water Toy Concessions Subcommittee - Deferred to Discussion Items below. New Marina Office Facility Subcommittee - A handout describing key elements of the new Marina Office was distributed to the Committee. In the interest of time, discussion was postponed until the December meeting. DIRECTOR'S REPORT: Jack Dunphy of Genesis Environmental Services, Inc. (GESI) briefed the Committee regarding findings which resulted after a fuel shortage was reported to them by The Keepers Locker. Their procedures included removing all product from both the diesel and gasoline tanks. The fuel piping/tanks failed GESI's tests which prompted them to drill five monitor/test wells. Only diesel was found in any of the test wells. To date, 2,394 gallons of Free Phase Product (diesel) had been retrieved from the immediate area. GESI has recommended, to the Texas Water Commission, that a pump system be installed to retrieve any remaining product which will be removed in 50 gallon drums. They have also recommended that the fuel tanks be filled with inert material and covered; this fuel site will remain permanently out of service. It was felt that a different fueling site might need to be considered. Mr. Matthews reported that the General Land Office will hear public input regarding the Coastal Management Plan at a public meeting at the Sandy Shores at 5:00 p.m. , November 16th. Update on Replacement of Piers A, B, C and D: Angel Escobar gave a brief presentation regarding the complete demolition and subsequent replacement and/or. repairs of A, B, C and D piers on the Lawrence Street T-Head. Water/Shore Advisory Committee Minutes November 5, 1992 DISCUSSION ITEMS: Rules for Contractors Working on Boats in the Marina Complex: Ms. Morris briefed the Committee regarding the need for insurance requirements for contractors working in the Marina. She reported findings of a survey Marina staff performed to determine what marinas around the state require of independent contractors performing maintenance on their marina premises. Comments were made by several boat service operators in attendance. Discussion followed. The draft requirements were distributed to the Committee and audience and will be distributed to other interested paries to solicit comments to be considered in the final document. The final document will be brought back to the Committee before it goes to City Council. Boat Repair/Haul Out Facility on Coopers Alley L-Head: Mr. Matthews reported that the City Council felt Thomas Pollack's proposal to operate the boat repair/haul out facility changed the current lease significantly enough to require a new lease. Discussions are currently on-going with Marine & Industrial Supply regarding how they will deal with the lease terms or requirements imposed by the City to allow them out of the lease. In the interim, the Marina is responsible for providing haul out services. Discussion followed. Water Concession Bidding Instructions and Permits: Mr. Gross presented the Water Toy Concession Subcommittee recommendation for the 1993 season. The present bidding procedures, number of sites, site locations, types of crafts, and conditions and terms prescribed in the current permit will be retained. The new permit provides for a one year permit with two one year options. The annual rate for each option shall be the successfully bid amount plus ten percent the first year and an additional ten percent the second year. Failure to exercise the option opens the space for bid, at the City's option, at the original minimum bid. Mr. Gross added that the subcommittee had no objection to their recommendation being considered as a multi-year permit which will require City Council approval. Ms. Gallaway stated that the one year permits should be negotiated and then the negotiated permits, including the two one year options, could be presented for City Council approval. Hans Schultz of Executive Wet Set stated their business would be more profitable if they were allowed to operate all their equipment from one site. Ms. Morris stated the new permits will include additional safety issues i.e. chase boats must able to overtake water. toys. Discussion followed regarding requiring concessionaires to actually operas a sites they occupy. Tony DeAmico stated that Beach Boat Rentals opened the second location only when there was actually a demand in order to reduce staff costs; and, one motorized location would not be able to accommodate the number of crafts required to meet the demand. The motion was made by Mr. Thompson, seconded by Ms. Suter, to advertise for bids, based on the subcommittee's recommendations and additional safety concerns. Motion passed unanimously. Rental of Water Space and Docking Facilities for Non-Traditional, Private Businesses in the Marina: Ms. Morris briefed the Committee regarding historical use of Marina facilities and Dan Barber's request to temporarily office on a ferry at the L-Head. Discussion followed. Mr. Barber was agreeable to being required to remove the ferry within 24 hours notice from the City and definitely on/before March 29, 1993. The motion was made by Ms. Forest, seconded by Dr. McKee, to allow Mr.. Barber to keep the ferry at the L-Head for not more than six months while he renovates his downtown office.
