Introduction of new committee member- Mr. Green welcomed Mr. Joe Ortiz to the Transportation Advisory Committee. II. Approval of Minutes — Motion made by Mr. Jones, seconded by Mr. Rock to approve minutes for September 22, 2008 and Special meeting minutes on September 26, 2008. Motion passed. Ill. Presentations and Discussions a. Monthly Traffic Fatality Report — Capt. Mike Pena reported (13) thirteen fatalities to date. Sgt. Pena informed the committee that there have been several accidents where people have died within (30) thirty days of the accident. In addition, Mr. Cardenas, mentioned that Traffic Engineering goes out to investigate the sites past history on any accidents or any records. b. John Kelley's presentation on: Regional Pedestrian Oriented Transportation and Development — Mr. Kelley, member of the Bay Area Smart Growth Initiative, stated that this is a citizen's group. Mr. Kelley mentioned that Bay Area Smart Growth Initiative is dedicated to safeguard our local economy and quality of life. Mr. Kelley explained that the intend of this presentations is to spur dialogue and planning to improve the efficiency and availability of pedestrian-oriented transportation, to increase the efficiency of our existing bus system, to decrease the expense and pollution associated with growing road infrastructure and auto-dependent development. Mr. Kelley informed the committee about the benefits of the pedestrian-oriented transportation for example; lower public and private cost per user, higher efficiency means lower pollution, reduced long-term maintenance, foster transit-oriented development and infill, etc. In addition, Mr. Kelly mentioned some of components of this transportation system such as expanded bus service, regional passenger rails, local light rails, water taxi and ferry service, bike trail and travel lanes, commercial taxi service, zipcar and personal vehicles. Mr. Kelley communicated that the next step on this issue will be to find funds, establish routes, select a managing agency or entity, conduct feasibility and cost studies, create a construction timetable, award contracts, and a regional coordination of the RTA, MPO, Regional Rail Commission, TxDOT, LRA, municipalities and counties. Mr. Green commented that political support for any kind of initiative like this is going to be critical to the under taking of this project. In addiSCr ED Page 1 of 5 questioned if there have been any conversations with the Nueces County and San Patricio County road rail districts because they have the ability to secure the right-of-way and easement, but they do not have any funding authority; although, money can be raised through taxation. Mr. Green commented that he doesn't know if this initiative has been explored. Mr. Green mentioned that there are some studies by MPO to look at some of those opportunities in the railroad quarters that have been mentioned. Also, Mr. Green encourages conversation with those agencies. Mr. Kelley indicated that two of the members of that agency have been involved with their group. Mr. Green urged BASGI to outreach to the Corpus Christi Chamber of Commerce and the Hispanic Chamber of Commerce because these agencies can provide some contacts and networking. Mr. Kelley wanted to bring this presentation and information to the City first, before outreaching to other agencies. Mr. Green encouraged Mr. Kelley to visit ,with the Development Service Department and with the City Traffic Engineer for future planning discussions. c. Mr. Cardenas discussion on: • Attorney's General Opinion- Mr. Green stated that the attorney general has ruled that if a public meeting is going to take place, everything that will be discussed at the meeting needs to be posted (72) seventy two hours in advance prior to the meeting. This will make the public aware of the meeting and will avoid any appearances of using general description to hide any discussions on specific items on the agenda. Ms. Ocanas confirmed the statement made by Mr. Green. • Update on MMA-Tabled for next meeting. • Bicycle Subcommittee-Tabled for next meeting. • Red lights Cameras-Tabled for next meeting. IV. Staff Recommendations Requiring Committee Review/Recommendations — a. Johnny Perales presentation on street abandonment and vacation of South Oso Parkway, .a portion of Dunn Lane and a portion of Texaco Road — Mr. Green asked if the description on the agenda was sufficient for the closure application on behalf of the Port of Corpus Christi. Ms. Ocanas affirmed that the description was sufficient. Mr. Veteto introduced himself as the representative of the Port of Corpus Christi on the road closure proposal. Mr. Veteto distributed two maps to the members of the committee to complete the package. Mr. Green,wondered if there will be any problem receiving the maps. Ms. Ocanas replied that there is no problem in receiving the maps as long as the City Secretary's Office has a copy at the end of the meeting. Mr. Page 2 of 5 • Veteto then explained that the fist exhibit shown was called the right-of-way Ownership and that there are three different types of ownership: 1. Ownership that the City has documented. 2. City right-of-way that is claimed, but can't be documented. 3. County owned right-of-way. Mr. Veteto stated that the county has closed their right-of-way. In addition, the court is requesting to close the City's right-of-way that is claimed, but can't be documented as well as the one that has been documented. The reason for this closure is to upgrade the Port of Corpus Christi's security capabilities at multiple locations. The budgets for these upgrades are as follow: $1 1/2 million to do repairs, $2 1/2 to $3 million to move the security area to the north of Joe Fulton Corridor and to build a new gate on the west end of Navigation Boulevard. Mr. Green commented that these expansions will be a savings to the City of Corpus Christi because the Port will oversee the maintenance of the operation. Mr. Veteto confirmed that the Port will take over the maintenance of Navigation Blvd. and Texaco Road. Mrs. Beard questioned the disadvantage of having these closures. Mr. Veteto explained that there are no disadvantages for these closures; in addition, Mr. Veteto stated that the Port of Corpus Christi will give the City of Corpus Christi an easement for the water land and for other utilities. Mr. Jones questioned the admission for the public as well as for the emergency services while construction of Joe Fulton is taking place. Mr. Veteto informed that any emergency can go through the gate because it is a 24/7 operation. Mr. Green mentioned that there are other conditions and arrangements between the Port of Corpus Christi and the City of Corpus Christi. Mr. Frank Brogan, Deputy Port Director of Engineering, explained that the City has asked for an easement on Resaca Avenue as a requirement for the new sewer treatment plant and the expedition of the right-of-way of legal on Port Avenue improvements. Motion to approve these street closures was made by Mrs. Beard, seconded by 'Mr. Jones. Mr. Perales continued with the presentation on the other two street closures. Mr. Perales informed the committee on the closure of a small portion of undeveloped and unsurfaced South Oso Parkway dedicated public right-of- way, out of the Botanical Gardens Park, located north of and adjacent to the South Staples Street (Farm to Market Highway 2444). Mr. Perales explained that as of last tear this parcel was donated to the City of Corpus Christi with the purpose of expanding the Botanical Gardens facility. In addition, Mr. Perales has looked at the proposed donation to consider both the positive and negative impacts of accepting this portion of land. Mr. Perales expressed that there has been some concerns about the proximity of the proposed intersection of South Oso Parkway and the existing horizontal curve edge and some problems with sight distance along the curve. Mr. Perales stated that they are considering moving the alignment a little farther to the south along the edge of this new piece of property for a parkway cross section. The Page 3 of 5 parkway cross section is not intended to have residential development on both sides of the street. Mr. Perales considered that an amendment to the transportation plan is not required because is a minor change on the alignment; unless, the Transportation Advisory Committee provides a different input. Mr. Perales informed the committee that this is City sponsored and the right-of-way is unimproved;therefore, there will be no fee values involved and no utilities in that section. Mr. Green questioned the proposed right-of-way section for the Oso Parkway. Mr. Perales stated that an off set 80' ft. right-of- way width and that the pavement width itself is 40' ft., but it is off set to provide a linear park on one side. Mr. Green asked if this will be a problem with the residents and their backyards backing in against this arterial. Mr. Perales has sent out notifications and has not received a negative response. Mr. Green inquired if this closure on the property conveys to the botanical gardens and nature center. Mr. Perales responded no because the property belongs to the City and the arrangements between the City and the Botanical Gardens is a long term lease arrangement with stipulations that needs further review. Motion made by Mrs. Beard, seconded by Mr. Jones. Mr. Perales continued the presentation on the last street closure. A portion of the Dunn Lane public street right-of-way, located just south of its intersection with the Up River Road public street right-of-way. Javalina Refinery is trying to establish a buffer zone adjacent to the refinery for security reasons to blend in better with the community and to do so it requires closing a portion of Dunn Lane. Mr. Perales indicated that Dunn Lane is paved; therefore, there will be a fare market value assessment involved in this street closure that is approximately $54,000 plus. The conditions will require filling and abandoning an 8" waste water line that exists in Dunn Lane at their own cost because if the line stays in place it will be a liability to the City of Corpus Christi and it can contribute to the inflow and infiltration into the City's waste water system. Mr. Perales stated that the right-of-way will remain as a utility easement because AEP has a line thatwill remain at that location. Mr. Green questioned the ownership of the lots around Javalina Refinery. Mr. Perales indicated that there are (2) two or (3) three lots in the area that will need to be verified before moving forward with this closure. If the ownership can't be verified this closure will be put on hold. Mr. Green mentioned that it will be good to add to the conditions to require the applicant to remap the properties so that there will be no more ownership questions. Mr. Perales agreed that is not currently on the conditions but it can be added. Mr. Green mentioned that if is added it will ensure proper protection. Mr. Perales added that they have requested documentationof those properties from Javalina Refinery before proceeding any further. Mr. Green quoted, "These street closures went to the Traffic Advisory Committee on October 27, 2008 and was approved"; this language was used in the package before the committee took action on the item. Mr. Green recommended being more cleaner and careful about what we say in the package that goes forward as part of the public record for future reference. Motion made by Mrs. Beard with the stipulation of a property ownership clarification, seconded by Mr. Rock. Mr. Cardenas wanted to Page4of5 clarify that the items presented were still in a draft form since it has not been signed on the agenda items. Mr. Perales clarified that the stipulation is a verification of ownership and a required cladding. V. Issues for next scheduled Transportation Advisory Meeting — None VI. Public Comment— None VII.
