The exception and reservation of all mineral interests as set out in Patent Deed from the

incident to the owners and lessees of the minerals
Restrictive Covenant as shown in Spemal Warranty Deed with Restrictive Covenant
dated November 16, 2001 and recorded as Document #2001049550 in the Official

An Option and Right of First Refusal as shown in Memorandum of Option Agreement

4. Rights of parties in possession.
Grantor, for the Consideration and subject to the Exceptions to Conveyance, grants, and
conveys to Grantee the Property, together with all and singular the rights and
appurtenances thereto in any way belonging, to have and to hold it to Grantee and
Grantee's successors, and assigns forever. Grantee, by accepting delivery of this Deed,
aclmowledges that Grantee had the opportunity to independently and personally inspect
the Property (including the environmental condition of the Property)_ The Property is
granted, and conveyed by Grantor to Grantee, and accepted by Grantee, "AS IS" and
"WHERE IS", WITH ALL FAULTS, IF ANY, INCLUDiNG, WITHOUT
LIMITATION, THE ENVIRONMENTAL CONDITION OF THE PROPERTY AND
WITHOUT ANY WARRANTY WHATSOEVER, EXPRESS OR IMPLIED_
