KNOW ALL BY THESE PRESENTS:

THAT. Diamond Shamrock Stations, Inc., a corporation ("Grantor"), ofP. O. Box 1494, San
AntOnIo. Bexar County, fexas 78295, In consideration of $10.00 (TEN DOLLARS), and other
good and valuable consideration, paid by the City of Corpus Christi, ("Grantee") of 1201 Leopard
Street. Corpus Christi, Nueces County, Texas 78401, the receipt of which is hereby acknowledged,
has conveyed, and does convey to the City of Corpus Christi, a Texas Home Rule municipal
corporation, Its successors and legal representatives, the free and uninterrupted use, liberty,
privilege. and easement of going in, on. over, under and along a certain tract of land situated in
Nueces County. Texas and being described as follows:
See the metes and bounds property description for the Utility Easement
attached and mcorporated as "Exhibit A" (Premises)
A map showing the location ofthe UTILITY EASEMENT is attached and
incorporated as "Exhibit B".
SPECIAL PROVISIONS:
1. Cimarron Boulevard. Driveway: No utility poles, obstructions or above ground appurtenances
of an)> type may be placed on the surface that lies wIthin the existing 40' wide driveway on
Cimarron Boulevard.
2. Imgatton system: PrIor to construction of the Cimarron Blvd. street improvements, the City of
Corpus Christi agrees to cap the existmg irrigation system at the east boundary ofthe new Utility
Easemem.
3. Restoration: The City of Corpus Christi agrees to restore the land and landscaping within the
easement area to the same condition as existed prior to construction. All construction is to be done
in a prudent and workmanlike manner
Together with the free ingress. egress and regress to and for the CIty of Corpus Christi, Texas, and
its franchisees to construct, service, repaIr, maintain, inspect, lay, operate and keep public utility
lines under, on and along saId easement.
TO HA VE AND TO HOLD, ALL AND SINGULAR, the rights and privileges aforesaid to the City
of Corpus Christi. Texas, its successors, legal representatives, and franchisees for the use as a
UTILIT'{ EASEMENT and right-of-way for so long as used for such purpose, and ifthe use of said
easement and right ofwav is ever abandoned, then the aforesaid nghts and privileges shall cease.

Belinning at a point for the north comer of Lot 4A, Block 13, Brighton Village Unit 2, a map of
which is recorded in Volwne 64, Page 252, of the Map Records, Nueces County, Texas, for the
west comer of this tract, from which comer, a 5/8 inch iron rod for the west comer of said Lot 2
bears, North 610 20'50" West, a distance of 11.50 feet;
Thence, North 280 39' 10" East, a distance of 56.25 feet, to a point on the southwest boundary
line of an existing 1 0 foot utility easement, for the north comer of this tract;
Thence, South 870 54' 44" East, with the southwest boundary line of said easement, a distance of
