Additionally, this letter is to communicate the fact that our original contract for engineering services was signed in 2001, labor rates and expenses have increased significantly, and those contract fees For professional servicesateed to be amended due to project delays. During the bid phase of the above referenced project, HDR, at the request of City staff, made significant efforts beyond normal reference checks to contact entities that the apparent low bidder, Salinas Construction Technologies, Ltd. had performed work for. The original contract for professional services states that HDR will "attend bid opening, analyze bids, evaluate, prepare bid tabulation, and make recommendation concerning award of the contract". Since Salinas was the only bidder on the project and they had a negative history with the City of Corpus Christi, HDR was able to receive comments from nine entities that Salinas had worked for in order to determine if Salinas was a qualified contractor for the proposed work. The work performed to make contact with the submitted references was above and beyond the expected scope in the original contract and warrants a review of the scope and fee for the project bid phase services. Since the start of construction HDR. has absorbed many of the construction phase project management responsibilities of this project. The original contract states "HDR is responsible for making site visits to observe general progress and quality of work and this will not be confused with the project representative observation or continuous monitoring of the progress of construction". There has been numerous 'contractor related issues that HDR has had to resolve on site that have warranted multiple site visits outside the definition of "observe general progress". NDREnpineodnp,lnc. 1555NCarencahua Phone106g857~2111i AMD.NOi4 $uiio 1650 Fax X3511051-R34 EXHIBIT A Corpus CNisli, TX 7&1780010 swxehdrinaeom pa e 1 of 3 Mr. Kevin Stowers ~nsnoos Page 2 of 3' The issues that have resulted in additional site visits include: • Storm water inlets constructed at the incorrect grade and incorrebt location (Reference Attachment 1). • Sanitary sewer manhole constructed at the incorrect location (Reference Attachment 2): ' • Driveway conflicts with homeowners and the contractors (Reference Attachment 3). • Location of site utilities and driveways for the proposed child development center (Reference Attachment 4).. • Several survey-related grade and alignment issues with the layout ofthe streets, curb.8c gutter, and utilities. • Incorrect placement of reinforcing within the curb 8c gutter (Reference Attachment 5). • ~ Conflicf with AEP utility poles. and. the tjmely removal of the poles within the project limits (Reference Attachment 6). • Proposed sidewalk ramps, conflicted. with. the actual locations that AEP installed their new poles (Reference Attachment 7): ~. . • An alternative sidewalk' drain was requested to be designed (Reference Attachmertt 8). The original contract also states that "HDR will provide interpretations and clarifications of the contract documents for the contractor and authorize minor changes, .which do not affect the contractor's price-and are not contrary to. the .general interest of the. City under the contract". During construction HDR has received seventeen requests for clarifications to the contract documents, six. of which would authorize maJor changes. All, of the requests have been confirmed and communicated with-the `City personnel however all of them have resulted in significant additional time and expenses. . Bidding and construction of this project was delayed between 2002 and 2007 due to final." design changes in the alignment of Marguerite Street,. issues .with the removal of acquired houses and the Marguerite Child Development Center, and availability. of funds to begin construction. Construction began in August 2007. During the intervening five years, salaries and benefits have increased approximately.21% (4%/ year compounded) leading us to request an adjustment in the' original fees for bid and construction plisse services.'. Applying the 21•% increase to'the original fees for these services results in an increase'of $785.00 for bid phase services and $1,623.00 for construction phase services. The'above related bid phase services, additional site visits, interpretations and clarifications, and the fact that the original contract is approximately six years old, warrant a review of the scope and fee for the project.. We request that the contract be amended to increase the fee for these changes (Attachment 9). The changes in fee are shown on the below table end includes ' the current fee antathe amended fee. We have also attached a statistical summary of the man- ., hours and expenses applied to making the scope changes. AMD. Design of proposed catch basin conversion Timeline for CI B-6: a. Unknown: Contractor installed curb inlet (CI) B-6 directly across Marguerite Street from B-5. Plans show 18" STRM at an angle across Marguerite Street to accommodate for small lots and proposed driveways along south side of street. b. Week of March 18`h: Construction Services requested HDR to meet at project site to look at possible courses of action. c. March 18th: Marty Schmitt sent sketch of proposal to move driveways due to the contractors' error (Exhibit A). HDR concurred with course of action to move driveways and adjust driveway flazes to accommodate incorrect storm inlet. d. Unknown date during March: Property owner contacted City to request a larger than proposed driveway be constructed in front of his property. Larger driveway would again conflict with March 18`h plan to modify driveways around the incorrectly placed storm inlet. e. City Construction Services requested HDR to provide a design to modify the proposed storm inlet into a catch basin that would located within the concrete driveway. After second site visit to take photographs and measurements, HDR provided design on April 17t (Exhibit B). 4. Storm water manhole placed at incorrect grade at Mazguerite Street STA 3+40. 5. Additional work: a. 1-site visit b. Submittal approval 6. Timeline for STRM MH at STA 3+40: a. April 6`h made a site visit to project to look at subject manhole. Manhole was place at correct flow line however rim of manhole was constructed approximately 18" above grade shown on plans. HDR requested that the Contractor provide a sketch showing their method to repair the manhole. b. July 1 S` HDR received sketch (Exhibit C) and approved the submittal on July 7`h with "no exception taken". Contractor installed the manhole along the curb line of the street within the extents of the gutter. Plans show on Sheet 26 that the proposed manhole is to be constructed 8' west of the centerline of the street. b. March: Construction Services requested HDR to meet at project site to look at possible courses of action. HDR requested that the contractor provide a sketch of how he was going to fix/ remove/ or relocate the manhole. c. April: Numerous adjustment methods were discussed over the phone. Additional site visits were made to look at courses of action. d. Apri124`h: HDR received letter and sketch (Exhibit A) from Salinas Construction on a method of adjusting the manhole. HDR concurred with course of action to move the upper portion of the manhole in order to move the top away from the gutter line. I recommend that the contractor remove and replace any curb and gutter that does not meet the spacing requirements as shown in the 6" Curb & Gutter Detail on Sheet 19 of 97 (City of CC Standard Street Details). Basically, the detail shows three inches of cover. This can vary +/- 1" but still cannot be within 1" of the surface.
