IN THE ORIGINAL CONTRACT, COMPENSATION shall be modified as shown in the attached Exhibit A for an additional fee not to exceed $18,990.00 for a total restated fee not to exceed $452,520.00. All other terms and conditions of the April 10, 2018 contract between the"CITY" and "ENGINEER"and of any amendments to that contract which are not specifically addressed herein shall remain in full force and effect. E., Director of Engineering S- SUBJECT Request to Authorize Emergency Design and Construction Work at Everhart Lift Station Declaration of Emergency OATS December 27, 2019 SUMMARY: The Everhart Lift Station is located near the intersection of Everhart Road and Staples Street behind the CVS store. The lift station is currently programmed for major upgrades as part of the Citywide Lift Station (LS) Repairs program that was scheduled to bid in 2020. The Everhart LS is in an advanced state of physical obsolescence and is experiencing frequent mechanical breakdowns and odor excursions. The situation is negatively impacting the businesses and residents in the surrounding areas. This emergency declaration will allow expediting the construction contract for repairs to the Everhart LS. ACTIONS TAKEN: 1. On April 10, 2018, City Council authorized Contract for Professional Engineering Services with Urban Engineering for Project E17086 Citywide Lift Station Repairs in the amount of $385,650 for upgrades to four major lift stations including the Everhart LS. 2. On February 8, 2019, City authorized Amendment No. 1 for $47,880 for additional civil design, structural design and electrical design for additional scope items. FUTURE ACTIONS: 1. Authorize design amendment with Urban Engineering to assist with the development of a separate contract package for the Everhart LS. 2. Authorize an emergency construction contract for LS repairs to include pumps, electrical, building modifications, HVAC system, odor control, crane and wet well cleaning. CONTRACT AUTHORITY: The City Manager is authorized to approve contracts in excess of $50,000 by Charter Art. X, Sec. 2(a) in case of an emergency, but such action must be reported to the Council. Additionally, The Local Government Code 252.022(a) exempts this contract or procurement from State's competitive bidding requirements because it is necessary: 1. to preserve the property of the municipality; and 2. to preserve or protect the public health or safety of the municipality's residents. EXHIBIT A Page 1 of 3 FUNDING: The proposed engineering and construction services preliminary cost are estimated not to exceed $2,000,000 with appropriations from: 4257-500030 Reserve Appropriation $2,000,000 RECOMMENDATION: It is recommended 1. Staff be authorized to administratively secure new contracts and/or amendments for this project; and 2. Emergency be declared and the City's Charter Art.X,Sec.2(a)be invoked to protect the public health or safety of the municipality's residents, preserve the property of the municipality and to avoid undue additional cost to the City.
