Box 271148 Corpus Christi,Texas 78427-1148 RE: Letter Agreement to Permanent Easement Agreement Project Name: Dean Expansion Tract#TX-NU-0070.20100,,Nueces County, Texas This letter agreement is in response to your request for Dean Pipeline Company, LLC ("Dean") to furnish a letter memorializing the agreement between you and Dean in connection with the Permanent Easem nt Agreement (the "Easement Agreement") between MVR Construction Company and Dean ontunty al , 2020. You and Dean have agreed as follows with respect to the property burdened by the Easement Agreement: 1. Dean acknowledges that MVR Construction Company will be installing multiple utility lines across the easement as described in the Easement Agreement. 2. Dean agrees,acknowledges,and does not object to MVR Construction Company installing these lines across the easement agreement with the following understandings: a. MVR construction company agrees to keep the separations and angles generally shown on exhibit"A" b. MVR agrees to install all utility lines by August 31,2020 3. Dean Pipeline Company,LLC hereby licenses and permits the City of Corpus Christi and MVR Construction Company to encroach upon its Easement over and across the above mentioned lands owned by MVR Construction Company, for approximately Thirty Feet (30') in width,as depicted in the attached Exhibit"A",incorporated herein for all purposes, for the purpose of erecting,constructing,installing,laying,replacing(in the same location and to the same specifications), servicing,repairing,using,maintaining, inspecting,modifying,removing, operating and keeping the Public Improvements. If this letter agreement accurately reflects the parties' agreement, please sign in the place provided below and return same to me.
