HUMAN RESOURCES CONFERENCE ROOM April 18, 2018 at 9:00 a.m. Commission Members Present City Staff Present Guy Nickleson, Chairperson Sylvia Guzman Robert Judkins, Member Sherri Eldridge Chairperson Nickleson called the meeting to order at 9:04 AM. Chairperson Nickleson read Item #1 from the agenda. Item # 1: Review and approve the minutes of the 509th Civil Service Commission meeting held July 28, 2017. Chairperson Guy Nickleson made motion to approve the minutes and Board Member Robert Judkins seconded. All Members agreed. Sylvia Guzman read Item 42 from the agenda. Item 42: Review and consider the appeal submitted by Firefighter 1I, Randy Lopez and Firefighter II, Daniel Poncik for question #7 from the Firefighter II Engineer examination administered on March 27, 2018. Sylvia Guzman read the question being appealed, all possible answers for the question, and the recommended action given by the test creator to deny the appeals. Chairperson Nickleson asked if anyone would like to make a staternent in support or against the appeal. Firefighter II, Randy Lopez presented his argument for the appeal, he presented his argument for the appeal which was answer choice c. storage tank does not specify what type of storage tank which the textbook states "technically an elevated tank is not a static source" therefore, the keyed answer D. All of the above cannot be correct if answer choice C is not a static source according to the textbook. Firefighter 11, Daniel Ponsik presented his argument for the appeal, he presented his argument for the appeal which was answer b. lake, should be the only correct answer because it is the only answer that is actually a static water supply. Chairperson Nickleson asked if anyone else would like to make a statement for the record in support or against the appeal. Firefighter Il, Fermin Chapa presents his argument opposing to change the correct answer citing the correct answer comes from the textbook word for word. Keyed answer D. all of the above should remain the correct answer. No other arguments are given for/against Agenda Item #2. Sylvia Guzman read Item 43 from the agenda. Item #3: Review and consider the appeal submitted by Firefighter II, Mauricio Quintero Jr. for question #60 from the Firefighter II Engineer examination administered on March 27, 2018. Sylvia Guzman read the question being appealed, all possible answers for the question, and the recommended action given by the test creator to deny the appeal. Chairperson Nickleson asked if anyone would like to make a statement in support or against the appeal. Firefighter II, Mauricio Quintero Jr. presented his argument for the appeal which was to allow more than one answer because a sawtooth roof is exactly the same as a monitor roof which both of which were answers that could be chosen on the exam. Chairperson Nickleson asked if anyone else would like to make a statement for the record in support or against the appeal. Firefighter II, Jon Dodge supports Firefighter II, Mauricio Quintero's argument that more than one answer should be allowed for question #60. No other arguments are given for/against Agenda Item #3. Sylvia Guzman read Item 94 from the agenda. Item 44: Review and consider the appeal submitted by Firefighter 1I, Randy Lopez and Firefighter II, Jon Dodge for question 469 from the Firefighter 11 Engineer examination administered on March 27, 2018. Sylvia Guzman read the question being appealed, all possible answers for the question, and the recommended action given by the test creator to grant appeals allowing Choice A, B & D as correct answers. Test creator acknowledges this item was incorrectly keyed D as the only correct answer and apologized for the error. Chairperson Nickleson asked if anyone would like to make a statement in support or against the appeal. Firefighter 11, John Dodge presented his argument for the appeal, he presented his argument for the appeal which was to have the questions thrown out because the question does not quote the textbook word for word. Firefighter 11, Oscar Medina agrees with Firefighter 11, John Dodge the questions should be thrown out. Firefighter 11, Walter Garcia states all three answers should be correct, Choices A, B and D as stated by test creator. Firefighter II, Fermin Chapa opposes the questions be thrown out. States test takers are not to use work experience, but what is clearly written in the resource materials. Firefighter 11, Daniel Poncik supports, Firefighter 11 Walter Garcia's argument that all three answers Choices A, B and D as stated by test creator be counted as correct. No other arguments are given for/against Agenda Item #4. Sylvia Guzman read Item #5 from the agenda. Item #5: Review and consider the appeal submitted by Firefighter II, Randy Lopez, Firefighter I1, Jon Dodge, Firefighter II, Daniel Poncik, Firefighter I1, Justin Dredla, Firefighter II, Walter Garcia, Firefighter II, Oscar Medina and Firefighter I1, Joseph Rocha for question #76 from the Firefighter II Engineer examination administered on March 27, 20I 8. Sylvia Guzman read the question being appealed, all possible answers for the question, and the recommended action given by the test creator to grant appeals allowing Choice D as the only correct answer. Test creator acknowledges this item was incorrectly keyed as C and apologized for the error. Chairperson Nickleson asked if anyone would like to make a statement in support or against the appeal. Firefighter II, Justin Dredla presented his argument for the appeal, in which all answers should be counted as correct. The textbook states all the answers word for word. Firefighter 11, Walter Garcia disagrees with Firefighter 11, Justin Dredla stating answer choice "A" should be the only correct answer because e it is the only choice quoted word for word from the text book. Firefighter II, Fermin Chapa argues the question should be thrown out. States Answer choice "A" is not a complete answer, answer choice "C" is lacking the word investigator therefore the answers are not verbatim from the text book and all answers cannot be accepted as correct. Firefighter II, Oscar Medina supports Firefighter 11, Walter Garcia's argument stating answer choice "A" should be the only correct answer since it is the only answer verbatim form the text book. Firefighter II, Daniel Poncik agrees with Firefighter 11, Walter Garcia and Firefighter 11, Oscar Medina stating answer choice "A" should be the only correct answer because it is the only answer word for word from the text book, the other possible answers lack wording from the text book thus should not be counted as correct. Chairperson Nickleson asked if anyone else would like to make a statement in support or against the appeal. No other arguments are given for/against Agenda Item #5. Chairperson Nickleson announced that the meeting went into closed session at U7 AM pursuant to the authority Section 551.074 of Texas Open Meetings Act to discuss the appeal. At 10:05 AM Chairperson Nickleson announced that the meeting was back on the record. Chairperson Nickleson asked the Commission Members if there is a motion. Commission Member Robert Judkins made a motion to deny the appeal for Items; # 2 and 43. Item # 4, allow answers A, B, and D as correct answers. Item # 5, allow answers A, B, C, and D as correct answers. Chairperson Guy Nickleson seconded. All Members agreed with the decisions. Chairperson Nickleson announced the following: Item # 2- Appeals Denied Item # 3- Appeal Denied Item # 4- Grant Appeals- Allow Answers A, B, and D as correct answers. Item 4 5- Grant Appeals Allow Answers A, B, C, and D as correct answers. Chairperson Nickleson adjourned the meeting at 10:08AM.
