513th CIVIL SERVICE COMMISSION MEETING
CITY HALL, 1201 LEOPARD ST.

April 4, 2019 at 9:00 a.m.

Chairperson Guy Nickleson called the meeting to order at 9:00 AM.
Chairperson Guy Nickleson read Item #1 from the agenda.
Item # 1: Review and approve the minutes of the 513th Civil Service Commission meeting
held February 1, 2019.
Chairperson Guy Nickleson made motion to approve the minutes and Board Member Gerald
Avila seconded. All Members agreed.
Kelly McNabb reads Agenda Item#2.
Item #2: Review and consider the appeal submitted by Firefighter II, David Lopez for
question # 3 on the Fire Captain promotional examination administered on March
21, 2019.
Kelly McNabb reads the question being appealed, all possible answers for the question, and the
recommended action given by the test creator to deny the appeal.
Firefighter II David Lopez agrees with the correct response after looking over the textbook.
Chairperson Guy Nickleson ask City to read Item #3.
Steve Viera reads Agenda Item #3.
Item #3: Review and consider the appeal submitted by Firefighter II, Joshua Brunemeier,
Firefighter II, Patrick Frost, Firefighter II, Patrick Garcia, Firefighter II, Joseph
Rocha for question # 83 on the Fire Captain promotional examination administered
on March 21, 2019.
Kelly McNabb reads the question being appealed, all possible answers for the question, and the
recommended action given by the test creator to deny the appeal.
Firefighter II Joshua Brunemeier reads his appeal and states that there are six (6) steps before
identifying potential risk and Firefighters should identify as many risks as possible. Firefighter
II's Patrick Frost, Patrick Garcia and Joseph Rocha agree with Firefighter II Joshua Brunemeier.
Firefighter II Walter Garcia, did not appeal but agrees with Firefighter II Joshua Brunemeier.
Firefighter II Bryan Sayles agrees with the test publisher's response that C is the best answer to
question #83. Firefighter II Audrey Alvarez agrees that C is the best answer.
Steve Viera reads Agenda Item #4.
Item #4: Review and consider the appeal submitted by Firefighter II, Bryan Sayles for
question # 85 on the Fire Captain promotional examination administered on March
21, 2019.
Kelly McNabb reads the question being appealed, all possible answers for the question, and the
recommended action given by the test creator to deny the appeal.
Firefighter II Bryan Sayles states that more than one answer is correct, that the two unsafe acts in
the question are not only visible, unsafe acts but also poor decisions.
Firefighter II Joshua Brunemeier did not appeal but agrees with Firefighter II Bryan Sayles.
Steve Viera reads Agenda Item #5.
Item #5: Review and consider the appeal submitted by Firefighter II, Joseph Rocha for
question # 95 on the Fire Captain promotional examination administered on March
21, 2019.
Kelly McNabb reads the question being appealed, all possible answers for the question, and the
recommended action given by the test creator to deny the appeal.
Firefighter II Joseph Rocha states that the answer is not verbatim in the book, however, he
believes answer B is more distinct than answer C.
Firefighter II's Bryan Sayles, Joshua Brunemeier and Patrick Garcia all spoke in opposition to
the appeal. Stating that the answer is word for word from the source and answer C is the correct
answer.
Chairperson Guy Nickleson announced that the meeting went into closed session at 9:30 AM
pursuant to the authority Section 551.074 of Texas Open Meetings Act to discuss the appeals.
At 9:50 AM Chairperson Guy Nickleson announced that the meeting was back on the record.
Chairperson Guy Nickleson made a motion to deny the appeal for Item #2.
Commission Member Gerald Avila seconded. All Members agreed with the decision.
Chairperson Guy Nickleson announced the following: Item # 2- Appeal Denied
Chairperson Guy Nickleson made a motion to deny the appeal for Item #3. Commission
Member Gerald Avila seconded. All Members agreed with the decision.
Chairperson Guy Nickleson announced the following: Item # 3- Appeal Denied
Chairperson Guy Nickleson made a motion to deny the appeal for Item #4.
Commission Member Gerald Avila seconded. All Members agreed with the decision.
Chairperson Guy Nickleson announced the following: Item # 4- Appeal Denied
Chairperson Guy Nickleson made a motion to deny the appeal for Item #5. Commission
Member Gerald Avila seconded. All Members agreed with the decision.
