I. Call to Order, Roll Call
Chairman Baugh called the meeting to order and a quorum was established with
Commissioner Miller absent.
II. PUBLIC COMMENT: None.
III. Approval of Absences: None.
IV. Approval of Minutes
1. 21-0722 Regular Meeting Minutes of June 9, 2021
A motion to approve the minutes listed above was made by Commissioner Schroeder
and it was seconded by Vice Chairman Dibble. The motion passed.
V. Consent Public Hearing (Items A & B): Discussion and Possible Action
Chairman Baugh informed the Commission that Consent Agenda items "5. 7, 8 & 9" will
be pulled for individual consideration and then asked Staff to present the remaining
Consent Agenda items. Senior City Planner. David Stallworth. read the Consent Agenda
items into the record. New Plat items "2, 3. & 4" satisfy all requirements of the UDC/State
Law and the Technical Review Committee recommends approval: Staff recommends
approval for Time Extension item "6". Staff also recommends approval for New Zoning
item "10" as stated in Staffs report.
After Staffs presentation. Chairman Baugh opened the public hearing for the Consent
Agenda items. The public hearing consisted of individuals speaking opposition to New
Zoning item "10". Upon hearing this testimony, Chairman Baugh asked Staff to do a full
presentation of this item and it was pulled for individual consideration. Full summary for
this item is below in sequence. With no one else coming forward for items "2, 3. 4 & 6",
the public hearing was closed. A motion was made by Commissioner Schroeder to
approve items "2, 3,4 & 6" and it was seconded by Vice Chairman Dibble. The motion
passed with no abstentions.

Dibble opened the public hearing. With no one coming forward, the public hearing was
closed. A motion to approve item "5" was made by Commissioner York and it was

Located north of Up River Road and east of Sharpsburg Road.
Commissioner York abstained from items "7 & 8" and removed himself from the dais. Mr.
Dimas read New Plat item "7" along with the accompanying Variance item "8" into the
record as shown above. Item "7" satisfies all requirements of the UDC/State Law and the
Technical Review Committee recommends approval; Staff recommends approval for the
Variance as stated in Staffs report. After Staffs presentation. Chairman Baugh opened
the public hearing. With no one coming forward, the public hearing was closed. A motion
was made by Vice Chairman Dibble to approve both items "7 & 8" as presented by Staff
and it was seconded by Commissioner Salazar-Garza. The motion passed with
Commissioner York abstaining from both items "7 & 8".
B. New Zoning
9. 21-0736 Public Hearing - Rezoning Property at or near 4606 Gulfbreeze
Boulevard
Case No. 0621-04, Date Tree Holdings, LLC: Ordinance rezoning property at
or near 4606 Gulfbreeze Boulevard (located along the east side of Gulfbreeze
Boulevard, south of Gulden Street, and north of Beach Avenue) from the "RM-AT"
Multifamily AT District to the "RM-AT/PUD" Multifamily AT District with a Planned
Unit Development.
Mr. Dimas presented item "9" for the record as shown above.The applicant is proposing
a planned community that will consist of 10 single-family townhouse lots and one common
area. For location purposes. he presented an aerial view of the subject property along
with the Existing and Future Land Use maps. He went over the history of zoning patterns
as well as available municipal facilities.
Mr. Dimas also went over the UDC requirements for the rezoning. He presented a table
comparing the proposed PUD development standards with the UDC standards for the
"RM-AT" and "RS-TH" districts, noting all requested deviations from the UDC by the
applicant. The deviations include maximum density. lot area. minimum lot width and
street yard. He presented a master site plan noting the areas for trash and off-street
parking.
He informed the Commission that of the 57 public notices mailed, zero public notices
were returned in favor and 21 notices were returned in opposition. The proposed
rezoning is consistent with the Future Land Use Map and is also consistent with the
guiding principles of the Comprehensive Plan (Plan CC). Based on this analysis. Staff
recommends approval of the change of zoning with the following conditions:
1.Planned Unit Development Guidelines and Master Site Plan: The Owners shall develop
the Property in accordance with the Las Casitas del Mar Development (PUD) Guidelines
and Master Site Plan and the satisfaction of all Technical Review Committee (TRC)

requirements.
2. Pedestrian Access: Sidewalks shall be provided along the frontage of the subject
property shared with Gulf Breeze Boulevard in accordance with the Unified Development
Code (UDC).
3. Private Solid Waste: A formal request must be made to the Solid Waste Department
of the City to exempt the subject property from public refuse collection.
4. Other Requirements: The conditions listed herein do not preclude compliance with
other applicable UDC and Building and Fire Code Requirements.
5. Time Limit: An approved development plan shall expire 24 months after the date that
the development plan was approved, unless a complete building permit application has
been submitted or, if no building permit is required, a certificate of occupancy has been
issued.
After Staffs presentation. the floor was opened for Commissioner comments/questions.
Discussion took place regarding the hammerhead design and the alley which will be
constructed by the applicant. After discussion concluded. Chairman Baugh opened the
public hearing. Developer for the subject property. Gordon Awsumb. 1 Virginia Hills
Drive, addressed the Commission in support of the rezoning request. He said the project
will be a high quality, net zero energy star certified development; believes the
development is consistent with the density in the area. He did his due diligence and
made outreach efforts with the North Beach community as well as the council member for
this district. Commissioner Schroeder asked about emergency vehicle access. Mr.
Awsumb stated Assistant Fire Chief Randy Paige reviewed and approved the design
and there is adequate access for emergency vehicles; addressed parking. He stated
they have provided parking in excess of what is required. He said the objective of this
development is for long term rentals. To address flooding issues on North Beach,
proposals have been submitted for a short-term/long-term mitigation plan. Regarding
density. he said the difference is eight buildings with 14 units as opposed to eight
separate units.

flooding and the increase in density.

Mr. Dimas concluded the public comment by reading the returned public notices into
record (attached). With no one else coming forward. the public hearing was closed.
Discussion continued regarding denisity, short-term rentals (overnight accommodations)
versus long-term rentals with respect to residential/commercial development; discussion
regarding access from the alley (paving). After discussion concluded. a motion was
made by Commissioner Schroeder to approve item "9" as presented by Staff and it was
seconded by Commissioner York. The motion passed.
10. 21-0737 Public Hearing - Rezoning Property at or near 6002 Greenwood Drive
Case No. 0621-05, MVR Construction Company: Ordinance rezoning
property at or near 6002 Greenwood Drive (located along the west side of
Martin Street. south of Holly Road, and east of Greenwood Drive) from the
"RS-6" Single-Family 6 District to the "RS-4.5" Single-Family 4.5 District.
Mr. Dimas presented item "10" for the record as shown above.The applicant is
proposing a single-family residential subdivision. For location purposes. he presented al
aerial view of the subject property along with the Existing and Future Land Use maps.
Two proposed "Cl" Minor Collector Streets (Lands Road & Martin Drive) border and
cross through the subject property. As part of the platting process, the developer will be
responsible for constructing and installing public improvements. As part of a grant project
to expand absorption capabilities, a proposed drainage ditch will run through the subject
property; the ditches will connect and run to La Volla Creek.
Mr. Dimas went over the history of zoning patterns. He also went over the UDC
requirements for the rezoning as well as available municipal facilities. He informed the
Commission that of the 79 public notices mailed, zero public notices were returned in
favor and three notices were returned in opposition. Staff recommends approval of the
change of zoning request.
Herbert and Lucy Rubio. 1713 Citation. addressed the Commission during the public
comment period and stated their opposition to the rezoning request. They cited major
flooding issues that exist in the neighborhood. They stated La Volla creek cannot absorb
enough water to help the situation and the existing ditch also does not absorb enough
water. They felt that the change to the "RS-4.5" district is too dense and will only
exacerbate the flooding issues. They felt that the flooding issues need to be addressed
before any further development takes place.
Chairman Baugh reopened the public hearing for the applicant to have an opportunity for
comment. Representing the owner, Bart Braselton at 5337 Yorktown, addressed the
Commission in support of the rezoning request. He said the construction of the two
Collector streets will help traffic and the new ditch will help with flooding issues. He said
the "RS-4.5" district is typical throughout the City: mentioned the adjacency of another
subdivision to the north of the subject property with the "RS-4.5" district. He said the
"RS-4.5" district does not necessarily mean that all lots will be built at exactly 4,500
square feet but that lots cannot be any smaller; some lots will be over 4.500 square feet.
Most of the lots in the neighborhood are 5,000 square feet or higher.

With no one else coming forward. the public hearing was closed. Commissioner
Zarghouni felt that public improvements for stormwater have been an ongoing issue in the
City and said there is a critical need for consistent procedures moving forward as the
City is growing quickly. Staff informed the Commission the Stormwater Master Plan is
currently being evaluated and the City plans to establish and appoint a Capital
Improvements Advisory Committee. Discussion took place regarding how the potential
use of impact fees will contribute to the rate at which public improvements are done in the
future. The City has also discussed implementing more low impact development policies
to find alternatives to reduce the amount of runoff into receiving bodies of water.
Commissioner Schroeder felt that the City is making strides with public improvement
procedures. A motion was made by Commissioner Schroeder to approve item "10" as
presented by Staff and it was seconded by Vice Chairman Dibble. A roll call vote took
place and the motion passed with Commissioner Gonzalez abstaining.
VI. Public Hearing (Item C): Discussion and Possible Action
The following Public Hearing items will be considered individually.
C. New Plat with a Variance (Waiver)

Located south of St. Bartholomew Avenue and west of Windward Drive.
12. 21-0734 21PL1043 - SIDEWALK

Mr. Dimas read New Plat item "11" along with the accompanying Variance item "12"
into the record as shown above. Item "11" satisfies all requirements of the UDC/State
Law and the Technical Review Committee recommends approval: Staff recommends
denial for the Variance as stated in Staffs report. For location purposes, Mr. Dimas
proceeded with displaying an aerial view of the subject property and also a site plan. He
mentioned that excluding sidewalk construction was not part of the original requested
deviations for the approved PUD and this waiver is being requested at the plat approval
stage of the development. Mr. Dimas continued with the applicant's statements
supporting the waiver request and Staffs statements weighing against the waiver
request.
The applicant states that they do not believe sidewalk should be required because:
1. There is no sidewalk located in front of the adjacent lots, or in the general area
adjacent to Windward Drive and none of the developed properties within this portion of
Padre Island have sidewalks.
2. Waiver of sidewalk will not be detrimental to the public health. safety, or general

welfare, and adjacent property will not be restricted or rendered unfeasible.
3. Interior sidewalks provide safe access from the parking areas throughout the
development.
4. The Comprehensive Plan will not be substantially affected, and the Bicycle Mobility
Plan does not show any routes through this property. However. there is a bike lane
marked on the pavement along Windward Drive.
5. The adjacent lots are already platted. Therefore. it seems unlikely a sidewalk would be
constructed in the future in front of those lots unless a broad sidewalk construction project
is considered for the area.
Factors weighing against the waiver and in support of requiring sidewalk:
1.The property is zoned "RM-AT/IO" Multifamily AT District with the Island Overlay and
located at a street corner. A street corner is the ideal place from which a sidewalk
network can be provided meeting current standards for a collector street.
2. Both Windward Drive and St. Bartholomew Drive are "C1" Collector Streets as per the
Urban Transportation Plan (UTP) with a sidewalk network on both sides on the streets.
3. The subject property is located on North Padre Island and is one of the busiest tourist
areas in Corpus Christi. Providing the sidewalk facility is paramount to ensuring
pedestrian safety.
4. Both Windward Drive and St. Bartholomew Drive are listed on the Strategic Plan for
Mobility.
5. Windward Drive is listed on the ADA Master plan.
Section 3.8.3.D of the UDC provides factors to consider plat waivers, and states that the
need for the waiver shall be demonstrated to the Planning Commission's satisfaction; the
waiver may be approved, approved with conditions, or denied. Weighing the factors.
Staff recommends denial of the waiver from the sidewalk construction requirement.
After Staffs presentation, Chairman Baugh opened the floor for Commissioner
comments/questions. Commissioner York had questions regarding the layout of the
previously approved PUD and how the sidewalk construction could affect it: where the
sidewalk would be constructed if there were no previous pedestrian dedications. After
Commissioner questions concluded, Chairman Baugh opened the public hearing.
Developer for the subject property. Alex Harris, 5926 South Staples Street, addressed
the Commission in support of the waiver request. He reiterated that this would be a
"sidewalk to nowhere". He mentioned how many of the other developments on Padre
Island and adjacent developments have no sidewalk. He said the PUD layout was not
designed to include a sidewalk. Representing the Engineer. Miguel Torres. Hanson
Professional Services, also addressed the Commission in support of the waiver request.
With no one else coming forward the public hearing was closed. Further comments took
place and Commissioner Schroeder suggested that developers be more involved in
UDC amendments for sidewalk construction as it is evident they do not want to construct
sidewalks in this area. He said Commissioners are faced with the dilemma of making

sidewalk waiver decisions as Staff must present waivers because it is required by the
UDC. He felt that not having sidewalks on Padre Island is a safety hazard. Commissioner
York stated a good option for developers would be to provide cash in lieu of sidewalk
construction: felt that developments in this area are unique and have no room to construct
sidewalk. After discussion concluded, a motion was made by Chairman Baugh to
approve items "11 & 12" and it was seconded by Vice Chairman Dibble. The motion
passed with Commissioner Schroeder opposed to item "12".

As a home owner on Gulfbreeze and a resident of North Beach since 2001, I support the Planned
Unit Development proposed for 4606 Gulfbreeze Blvd.
North Beach is a mix of tall condos on the beach built in the 1980s, hotels, canalfront homes on the
west side of Hwy 181, and several cottages on stilts along Gulfbreeze. I live in one of those single
family homes.
Since North Beach is zoned RM-AT with T meaning "tourism," that means that hotels, townhomes,
condos and single family homes can be built here. This proposed 10-unit development would be
better than a hotel or a high-rise condo as the units will be long-term rental. It is very similar to the
other 2 cottage developments on Gulfbreeze. I welcome new development to North Beach and think
Mr. Awsumb's PUD will fit in well here.
