HomeMy WebLinkAboutC2020-462 - 7/28/2020 - Approved SECOND AMENDMENT TO THE ESG SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND CORPUS CHRISTI HOPE HOUSE, INC. This Second Amendment ("Second Amendment") is made by and between the City of Corpus Christi ("City") and Corpus Christi Hope House, Inc., ("Subrecipient"). WHEREAS, the City and the Subrecipient executed an agreement ("Agreement"), which was approved by the City Council on July 28, 2020, under Ordinance No. 032166, for the purpose of utilizing the City's FY2020 Emergency Solutions Grant ("ESG") Program funds; and WHEREAS, Subrecipient has requested the City to transfer $4,324.52 from the Rapid Rehousing activity component to the Homeless Prevention activity component under the existing FY2020 funding where it is more urgently needed; and WHEREAS, the request is an eligible activity under the FY2020 ESG funding and meets Citizen Participation Plan requirements as set out herein; and WHEREAS,the parties desire to enter into this Second Amendment to express their mutual desire to reaffirm all terms, conditions, and covenants stated in the original Agreement and to transfer funds within the Agreement as provided herein. NOW,THEREFORE, in accordance with the mutual covenants referenced herein and for other good and valuable consideration, the parties agree as follows: Section 1. By execution of this instrument, the parties agree to reaffirm and continue in force all terms, conditions, and covenants stated in the original Agreement, as may be amended by the execution of this Second Amendment. Section 2. The Grant Budget as found in EXHIBIT B-1 is replaced in its entirety with Revised Grant Budget as attached hereto and incorporated herein as EXHIBIT B-1. Section 3. The Payment Schedule as found in EXHIBIT B-2 is replaced in its entirety with Revised Payment Schedule as attached hereto and incorporated herein as EXHIBIT B-2. Section 4. The Schedule of Activity as found in EXHIBIT C is replaced in its entirety with Revised Schedule of Activity as attached hereto and incorporated herein as EXHIBIT C. By execution of this Second Amendment, the parties agree to the reallocation of certain ESG program funds as identified in this Second Amendment and the exhibits attached hereto and incorporated by reference. All other terms, conditions, and covenants of the Agreement not changed by this Secon Arrendment remain the same and in full force and effect.
