CALL TO ORDER, ROLL CALL Chair Jay Gardner called the meeting to order at 5:3 2 pm and City Staff Bonnie McLaughlin called roll . Approval of Minutes from September 14, 2021 Edit Proposed by Chair Jay Gardner: Pg. 8 TIRZ #2: remove word “potential.” Motion by Committee Member Cheri Sperling to approve. Second by Committee Member Charles Duffley. Motion carried by unanimous vote. III. CONSIDERATION OF REQUEST FOR EXCUSED ABSENCES 9/14/21 Absences: Cheri Sperling & Tommy Kurtz Motion by Committee Member Roy Coons to approve. Second by Committee Member Charles Duffley. Motion carried by unanimous vote. IV. PUBLIC COMMENTS Jeff Beynon, Island Resident • Short-term rentals, about 5-6 years ago neighbors started a STR, documented the renters, filed in municipal court with his evidence, city attorney sent out a letter in response to filing with municipal court. Wanted to share that knowledge with island residents. VI. ONGOING BUSINESS for Discussion/Possible Action 1. Watershore & Beach Advisory Committee (Terry Palmer) a. Not in attendance 2. Parks & Recreation (Twila Stevens) a. Not in attendance 3. Nueces County (Bryan Gulley) a. Not in attendance 4. Nueces County Water Control & Improvement District #4 (Keith McMullin) a. Not in attendance 5. Parks Updates (Darren Gurley) a. Lifeguard program: Since 2018, increased preventives by 4000 a year, welfare checks have decreased, shows that the preventives are working, total contacts for 2020 were 15,892 and 22,495 for 2021, lifeguards are more visible, more outgoing, every year is getting better. Contacts are any contact with guests. b. Permit sales 246,848 permits by the end of October, 25,000 more than last year, just beach parking permits. c. Reflectors and enclosed lifeguard stands are complete. Flag warning system now at all entrances, trying to work on visibility, improve it. d. Chair Jay Gardner: question about sand movement. e. DG: Fish and Wildlife supposed to handle it, they are currently waiting, have sand ready to move. Showers are back, they were down for the storm. #1 priority is always trash, sand needs to be moved, no wake signs installed. 6. Convention & Visitors Bureau (Brett Oetting) a. Budget and Plans approved by board, all on website visitcorpuschristi.com to read and see the focus and effort to promote the island. Looking to encourage shopping and visiting local restaurants, spend some money. b. Member Melanie Salinas: Do you have any projections for the holidays? c. Brett Oetting: believes that the numbers should be similar to last year, had an increase due to lull in COVID, after holidays expecting increase, targeting winter Texans campaign (north), actual marketing about CC in those markets starting late November and through spring break. d. Member Bill Uhlarik: concern about the JFK causeway and visitors clogging it up. e. Chair Jay Gardner: JFK concern will be added to future agenda. 7. Island Engineering Updates (Thomas Klein, Engineer IV) a. See presentation for updates. 8. TIRZ #2 & Subcommittee Update (Jay Gardner, Chair) a. Chair Jay Gardner: Will ask Heather about reaching out to the county, brainstorming a list, wants to coordinate with Heather before November meeting. VII. NEW BUSINESS for Discussion/Possible Action. 1. Short-Term Rentals (Tracey Cantu, Neighborhood Services) 1. Code enforcement breakdown, also includes animal services, homeless, grants, etc. Town Hall Meeting, message from island was overwhelmingly against STRs, city is working on a short-term rental ordinance that would make enforcement more effective, currently working under land use violations, code enforcement is out filing charges, but the ability to prove is difficult without them sitting on homes day in and day out, city is working with other departments to improve the process. 2. STRs are not allowed in single family residential areas throughout the city. Defined as less than 30 days, there is no ordinance, using land use violations to enforce. 3. Marvin Jones recognized by Chair Jay Gardner: Requests update on STR Committee 4. Dan McGinn: we are still working on the benchmarking draft, will put something together in the near future. 5. Tracey Cantu: City utilizes notices and plaques, to make it known that there is a violation on the property, changed process, allows the owner and neighbors to know that code enforcement has been to the property. Not going to be an instantaneous response or will stop activity right away but want people to know that the city is addressing the issues. 6. Member Bill Uhlarik: what is the internal process benchmark for code enforcement? 7. Tracy Cantu: 3 days is our benchmark. 8. Member Melanie Salinas: What response is required from the owner? 9. Tracey Cantu: Charges are filed in municipal court, charges are filed. Court decides the result of the violation. 2. ADP/Island Overlay Committee (Jay Gardner, Chair) 1. Chair Jay Gardner: Has volunteers for ADP committee 2. Dan McGinn: Development Services has a consultant, wants to meet with subcommittee about overlay. 3. Island Litter Update & Code Enforcement Briefing (Liza Lopez, Code Enforcement) 1. Code Enforcement does deal with litter and illegal dumping, solid waste compliance has their own code enforcement, CE gets called for most things, usually sends out to the appropriate department/person. Properties violating city ordinances have 7 days to comply, door hanger, education is first and foremost, send notice to properties with tenants and/or owner, have 7 days to comply, failure to comply is a citation. 2. Whether a call is true or false we answer every call, officers take a photo if there is no violation, a confirmed violation also gets photos, CE can only give out so much information, but you can file an open records request for that that is public information. 3. Member Bill Uhlarik: What is the city doing to address overall problem with litter/dumping/not maintaining things properly? Concern that this is not visitors but locals contributing to the trash problem. 4. Liza Lopez: we do speak to the managers of the stores, we have caught people who toss trash, but it is very difficult to have officers watch for that specifically, officers on the island mostly working on STR violations, Liza encourages her staff to keep an eye out. 5. Brett Oetting: asks about process for getting grass mowed or trash picked up. 6. Liza Lopez: Occupied property can be mowed (requires a warrant), repeat offenders will be sent certified notice so they can mow the property and then cite them, bill then sent to property owners. Contractor with city does the mowing and based on the density of the grass charges range from $65-300. Bill due within 30 days or a lien placed on the property. Each time you are in violation you get a citation. VIII.
