CALL TO ORDER, ROLL CALL Chair Jay Gardner called the meeting to order at 5:3 2 pm and City Staff Bonnie McLaughlin called roll . Approval of Minutes from October 12, 2021 Motion by Committee Member Cheri Sperling to approve. Second by Committee Member Melanie Salinas. Motion carried by unanimous vote. III. CONSIDERATION OF REQUEST FOR EXCUSED ABSENCES 10/12/21 Absences: Polly Balzer, Tommy Kurtz, Dotson Lewis, Daniel Brown, & Robert Pruski Motion by Committee Member Cheri Sperling to approve. Second by Committee Member Polly Balzer. Motion carried by unanimous vote. IV. PUBLIC COMMENTS Shirin Delsooz, bike path video submitted via email VI. ONGOING BUSINESS for Discussion/Possible Action 1. Watershore & Beach Advisory Committee (Terry Palmer) a. Not much to report, talked about some of the island parks, concentrating on bay parks along ocean drive. 2. Parks & Recreation (Twila Stevens) a. Not in attendance 3. Nueces County (Bryan Gulley) a. Not in attendance 4. Nueces County Water Control & Improvement District #4 (Keith McMullin) a. No updates 5. Convention & Visitors Bureau (Brett Oetting) a. Not in attendance 6. Parks Updates (Darren Gurley) a. Beaches looking good, good news last week, beach maintenance permit has left fish and wildlife so should be in within a month, allows them to move sand laterally along the beach and in front of the seawall where we need it, no swim zone near the jetty 100 feet to keep swimmers next to the jetty due to rip currents, put up a little higher, surfers can use rip to get out but not swimmers to prevent accidents from rip currents. Also, jetty channel marker lights keep getting broken from fishing weights hitting the solar panels, new ones ordered and up with screen around them, this is the third set of lights so hopefully we can stop this from happening. Also moved the gates at the jetties down to where the worst wave action is, gate can prevent any accidents, can’t really enforce but is a deterrent since it is so dangerous. Still moving sand on Zahn road from Hannah towards the water and clear off the road more. b. Working on replacing the handrail at the JFK causeway boat ramps. Empty trash every three days, pick up along the shoreline by the bridge, Bays & Estuaries had a cleanup and cleaned up (community clean up). c. No wake zones are up, same size as the ones at Packery Channel. 7. Island Engineering Updates (Dan McGinn, Director) a. See presentation for updates b. Member Michael Gonzalez: Asks about Packery Channel dredging. Is it beach sand? Would like to add to agenda. c. Chair Jay Gardner: subcommittee formed in 2019 to add projects (2018 Bond), likes that the city is moving forward with getting them all designed, wants ISAC to talk to their councilmen about getting these items added to the 2022 Bond list, there are negotiations with TXDOT right now to make sure that we don’t reinvent the wheel. d. Member Charles Duffley: project for beach access road on Mustang Island to be added to list, would like updates from Mai or Thomas (Bond 2020 projects) 8. TIRZ #2 & Subcommittee Update (Jay Gardner, Chair) a. Chair Jay Gardner: visited with Heather Hulbert before meeting, moving forward and working on TIRZ #2 VII. NEW BUSINESS for Discussion/Possible Action. 1. Short-Term Rentals (Dan McGinn, Director of Planning) 1. Daniel McGinn: staff has benchmarked other STR policy/ordinances from other cities, staff is researching STR court cases in Texas to understand potential issues and how they could impact ord. element. Arlington and Grapevine have ongoing litigation which are the primary TX cases, Austin has also had several over the last few years. Legal team looking into those cases, so we don’t jeopardize our potential ordinance. 2. Chair Jay Gardner: asked about committee meeting/status 3. Dan McGinn: not ready for committee yet, still in the discovery phase. Looking at cities with successful registration systems and have decent compliance. 4. Member Polly Balzer: how are you measuring the success of enforcement? 5. Member Polly Balzer: how much work are y’all doing without meeting with a committee? Concern that too much work is being done without the committee. 6. Daniel McGinn: Nothing is off the table, still doing research, registration system options are being looked at that can also assist with compliance. 7. Member Polly Balzer: Who will send out notice about committee meeting? 8. Daniel McGinn: We have a team working on it, so it’ll be someone from legal, housing, or myself that will send the invite. 9. Member Dan Brown: Wants to know if the city understands what the island wants from this ordinance? Wants to lead the way, not follow other cities. We should be designing what works for us. 10. Daniel McGinn: The city understands that the Padre Island Property Owners Association doesn’t want STR in single family neighborhoods, generally ok with it in commercial and multifamily areas based on info provide by Marvin Jones. 11. Member Polly Balzer: Miles Riesly attended STR meeting at Docs, lots of concern about enforcement and how the city is dealing with it, concern that the city is going to do the bulk of the work behind the scenes without the committee helping to decide the direction it goes. Feels that she doesn’t see any change from the city, so who is in the high-level meetings? If there is not enough participation by the committee, who do they email/reach out to? 12. ACM Andrea Gardner: Currently reviewing documents supplied by Chair Jay Gardner and is going to schedule a meeting with Peter to discuss, research going on at City Hall but no secretive meetings without the committee are taking place, committee meetings are coming very soon, working on getting up to speed with the progress so far since taking the lead on the project. 13. Member Cheri Sperling: Would like a meeting put together with interested parties so everyone is on the same page moving forward. 14. ACM Andrea Gardner: Will certainly do that, will work with Dan and get that scheduled. 15. Chair Jay Gardner: Concern about municipal court not enforcing anything. 16. Chair Jay Gardner recognizes Marvin Jones: Previously stated that you had a deadline of January 1, 2022. Is it a fair statement that you aren’t going to meet that deadline? 17. ACM Andrea Gardner: Hoping that Mr. Zanoni will extend the deadline based on the transition of project management recently from ACM Steve Viera to ACM Andrea Gardner, but it will be based on council’s willingness to do so, doesn’t want to drag this out any longer than necessary. 2. Island ADP Committee (Jay Gardner, Chair) 1. Movement forward this past week, meeting with TXDOT, one of the projects is moving forward under the JFK. 2. Island Overlay will merge with the ADP committee. 3. Island Mobility Study: recommended that we use HOT funds or TIRZ funds, multi-modal transportation study needs to be completed asap. What do we need to do to get this study done? Recommends TIRZ funding, Chair Jay Gardner to propose to City Council. ISAC membership in agreement with proposal to utilize TIRZ funding for the project. 4. Daniel McGinn: Texas American Planning Association Award for community outreach during the pandemic, big thank you to ISAC for their contributions. 3. ATV/Razors (Captain Brandi Moss) 1. Reviewed ISAC questions, the issue can be very complicated, only in Bravo district for 6 weeks so has compiled as much information as possible. 2. Put a chart together of common things for golf carts and off-road vehicles: i. For operation on a roadway, you must have valid driver’s license, can only be on a public roadway with a speed limit of 35 mph or less, can cross any intersections but can’t drive down any roads, must sit in seats and wear safety belts if they are installed, follow our ordinance because it is stricter than the state laws. ii. If the vehicle is owned by the city and county and operating for duty related job, there are exceptions. iii. State parks and PINS have their own set of rules, city does not have control over that. iv. South of the Packery Channel, on the beach, can cross over to the neighborhood but cannot drive down PR 22 3. Chair Jay Gardner: Have you had issues with people going up and down PR 22? It is a big issue, but it may be a little out of season for the concern. 4. Captain Brandi Moss: No, I don’t think so, especially since the summer is over. 5. Member Dan Brown: An owner of one of the rental places said he supported governors that would restrict the golf carts to 20 mph since some of the vehicles can go up to 40 mph. Concern that people from out of town don’t know the rules. Is there an ordinance to keep them at a certain speed limit? Also, we probably need more golf cart roads on the island. Something to look into, especially since we are building parking lots for golf carts. 6. Member Michael Pittman: Suggests that all vehicles should be registered and insured on the road. Is there a way to add that to the ordinance? Also suggests putting up signs on PR 22 that say “no golf carts allowed” at main access points where people are turning onto the road. 7. Daniel McGinn: City worked with the local grocery store to offer parking and back access road, no rules or regulations but maybe the overlay could require that, good mobility option for people who use them. 8. Member Melanie Salinas: are ATVs and razors the only things that you can rent that can reach those speed limits? 9. Chair Jay Gardner: They added “and other off-road vehicles” to the ordinance. 10. Captain Brandi Moss: The ordinance encompasses quite a bit as “off-highway vehicles.” 11. Captain Brandi Moss: Please email saferoadsforcc@cctexas.com to report unsafe drivers, since its off season there isn’t the same level of unsafe drivers, there is a lot of people on the island that own these things that need to understand that when enforcement comes rolling out that there doesn’t need to be pushback, she wants to encourage education, but she won’t discriminate. 12. Chair Jay Gardner: ISAC definitely wants CCPD to enforce that. Bottom line. 4. Island Recycling (Amy Gazin) 1. See presentation for more information VIII.
