MINUTES - REGULAR MEETING
BOARD OF ADJUSTMENT

I. CALL TO ORDER – ROLL CALL
Chairman Karaca called the meeting to order, and a quorum was established with Mr. McRee absent.
II. PUBLIC COMMENT: None.
III. APPROVAL OF MINUTES: July 28, 2021
A motion was made by Vice Chairman Walker to approve the minutes listed above and it was seconded by Mr.
Robinson. The motion passed.
IV. APPROVAL OF ABSENCES: None.
V. BRIEFINGS - Ordinances adopting text amendments to the Unified Development Code
1. Ordinance of the City of Corpus Christi, Texas adopting text amendments to the Unified Development Code
(UDC) to remove the Planning Commission from historic designation review process and to identify grounds
for undue hardship the Board of Adjustment may consider for a variance.
Mr. Dimas presented briefing item "1" for the record. He began the presentation by giving a brief background
of the 87th Texas Legislature. The first State mandate he explained was Senate Bill 1585 which is in
reference to historic designations for both landmarks and historic districts. If the property owner does not
consent to the proposed designation or inclusion of the owner’s property into a historic district, a three-fourths
vote of approval is required by the Landmark Commission and the City Council (UDC Section 3.4.2.A). This
amendment also refers to tables 3.1.6.A and 3.1.8 of the UDC. Section 3.4.2.B of the UDC has also been
amended to omit “Planning Commission”; Section 3.4.2.C of the UDC has been omitted.
Next, Mr. Dimas explained House Bill 1475 which refers to the Board of Adjustment and the required findings
for hardships when considering a variance to a structure. Section 3.25.3.B of the UDC will omit Insufficient
Finding #2: "There is a financial or economic hardship."; add Section 3.25.3.E Considerations on Variances
for Structures. No action was taken on this item.
2. Ordinance adopting text amendments to the Unified Development Code (UDC) to include the review of the
latest adopted Air Installation Compatibility Use Zone (AICUZ) Maps during a change of zoning request.
Andrew Dimas, Development Services Administrator, presented item “2” for the record as shown above. He
said the purpose of the AICUZ is to uphold the Navy’s mission to protect lives in or adjacent to the AICUZ and
to protect land use compatibility. The fields of study for the new 2020 AICUZ maps include two Naval Outlying
Land Fields (NOLF): Cabaniss and Waldron. He presented the maps for Cabaniss and Waldron, showing the
changes in boundaries for land use and noise impacts; some boundaries grew, and some shrank. Mr. Dimas
went over the next steps which include a proposed UDC text amendment for guidelines to be used for
rezoning cases and compatible districts (UDC Section 4.8). No action was taken on this item.
VI. DIRECTOR’S REPORT
Nina Nixon-Mendez, Assistant Director, informed the Commission that the next Development Task Force meeting
will be on November 19, 2021, and will be held at the Kleberg Bank Community Room at 5350 S. Staples Street
at 9:00 a.m.
VII. FUTURE AGENDA ITEMS: None.

There being no further business to discuss, the meeting adjourned at 2:00 p.m.
