Home My WebLink AboutC2020-465 - 4/21/2020 - Approved SECOND AMENDMENT TO THE CDBG-CV SUBRECIPIENT AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND THE SALVATION ARMY-COASTAL BEND (Mortgage, Rental and Utility Assistance Program) This Second Amendment ("Second Amendment") is made by and between the City of Corpus Christi ("City") and The Salvation Army-Coastal Bend ("Subrecipient"). WHEREAS, the City and the Subrecipient entered into two separate Subrecipient Funding Agreements in FY2019 which were approved by the Corpus Christi City Council on April 21, 2020 ("Agreements"). One Agreement was for the purpose of utilizing theCity's FY2019 Community Development Block Grant Coronavirus Response ("CDBG- CV") funds for a project entitled Mortgage, Rental and Utility Assistance Program and the other was for the purpose of utilizing the FY2019 CDBG-CV funds for a project entitled Quarantine Motel Voucher Program ("Projects"); and WHEREAS, Subrecipient has requested the City to reduce the funding for the Mortgage and Utility Assistance Program by $100,000.00 for FY2019 and to transfer that money to the Quarantine Hotel Voucher Program Budget for FY2019 where it is more urgently needed; and WHEREAS, the City has agreed to approve the transfer of $100,000.00 from the FY2019 CDBG-CV Mortgage, Rental and Utility Assistance Program to the FY2019 CDBG-CV Quarantine Motel Voucher Program as set out herein; and WHEREAS, the budget for the FY2019 CDBG-CV Mortgage and Utility Assistance Program will be reduced by $100,000.00 from $500,000.00 to $400,000.00; and WHEREAS, the parties desire to execute this Second Amendment to express their mutual desire to reaffirm all terms, conditions, and covenants stated in the original Agreement, as amended herein, including an amendment to the FY2019 Budget for the Mortgage, Rental and Utility Assistance Program as depicted in Exhibit "A" to the Agreement. NOW, THEREFORE, the parties hereto mutually agree as follows: Section 1. Section 1.1 Term of Agreement is amended by deleting the original termination date of "September 30, 2021," and inserting the new and extended termination date of "September 30, 2022." Section 2. By execution of this Second Amendment, the parties agree to reaffirm and continue in force all terms, conditions, and covenants stated in the original Agreement, as may be amended by the execution of this Second Amendment. FY2019-20 CDBG-CV The Salvation Army of the Coastal Bend -Mortgage and Utility Assistance Program Second Amendment 'Pa IAN PNED Section 3. Section 9.1 of the Agreement is amended by reducing the amount of the Commitment of Funding for this Project by $100,000.00 making the amended total Commitment for Funding for this Project $400,000.00. Section 4. The total program funds available for this Project as depicted in "Exhibit A" to the Agreement is hereby amended to show $400,000.00 as the total program funds available for the FY2019 CDBG-CV Mortgage and Utility Assistance Program. A revised "Exhibit A" is hereby attached hereto and incorporated herein as part of this Second Amendment to the Agreement between the City and Salvation Army. All other terms, conditions, and covenants of the Agreement not changed by this First Amendment remain the same and in full force and effect.
