Meeting Minutes
Planning Commission
Wednesday, February 9,2022 6:30 PM Council Chambers
I. Call to Order/Roll Call
The meeting was called to order and a quorum was established with Chairman Dibble
and Commissioner Miller absent.
II. PUBLIC COMMENT: None.
III. Approval of Absences: Commissioners Zarghouni and Gonzalez
A motion was made by Commissioner Salazar-Garza to approve the absences listed
above and it was seconded by Commissioner York. The motion passed.
IV. Approval of Minutes
1. 22-0233 Regular Meeting Minutes of January 26, 2022
A motion was made by Commissioner York to approve the minutes listed above and it
was seconded by Commissioner Zarghouni. The motion passed.
V. Consent Public Hearing (Items A& B): Discussion and Possible Action
Vice Chairman Schroeder asked Staff to present the Consent Agenda, items "2 through
8". Andrew Dimas, Development Services, read the Consent Agenda items into the
record. New Plat items "2 & 3" satisfy all requirements of the UDC/State Law and the
Technical Review Committee (TRC) recommends approval. Staff recommends approval
for Time Extension item "4". Staff recommends approval for Waiver item "6" along with
the accompanying plat, item "6" (satisfies all requirements of the UDC/State Law and
TRC recommends approval). Staff also recommends approval for New Zoning items 7 &
8" as stated in Staff's report. After Staffs presentation, Vice Chairman Schroeder
opened the public hearing. With no one coming forward, the public hearing was closed. A
motion was made by Commissioner Gonzalez to approve items "2 through 8" as
presented by Staff and it was seconded by Commissioner Zarghouni. The motion
passed.

8. 22-0232 Public Hearing - Rezoning Property at or near 202 Graham Road
Case No. 0222-03, Graham Office, LLC.: Ordinance rezoning property located
at or near 202 Graham Road (located along the north side of Graham Road,
east of Waldron Road, and west of Laguna Shores Road) from the "IH" Heavy
Industrial District to the "RV" Recreational Vehicle Park District.
VI. Public Hearing (Item C): Discussion and Possible Action
C. New Zoning
9. 22-0231 Public Hearing - Rezoning Property at 5007 Everhart Road
Case No. 0222-02, SCI Wireless & Tillman Infrastructure: Ordinance rezoning
property at or near 5007 Everhart Road (located along the east side of Everhart
Road, north of South Padre Island Drive, and south and east of Mt Vernon Drive)
from the "CN-1" Neighborhood Commercial District to the "CN-1/SP"
Neighborhood Commercial District with a Special Permit for a cell tower
approximately 130 feet in height.
Mr. Dimas presented item "9" for the record as shown above. The rezoning request is to
allow for the construction of a 130-foot monopole cell tower. For location purposes, he
presented an aerial view of the subject property. Next he went over the zoning pattern and
adjacent development for the surrounding area. He informed the Commission that of the
13 public notices mailed, zero were returned in favor and one notice was returned in
opposition. Mr. Dimas proceeded to explain Staff's analysis:
• The proposed rezoning is consistent with the adopted Comprehensive Plan (Plan CC)
and the Southeast (Midtown)Area Development Plan (ADP).
• The proposed wireless telecommunication facility will increase data availability in an
area where it is needed to prevent a degradation of services.
• Construction of the wireless telecommunication facility will increase coverage in areas
that are currently underserved.
• The proposed tower does not meet the minimum required setback to a residential
dwelling as per Section 5.5.3.E.3. of the UDC.
• The proposed tower does not meet the minimum required setback to a state
right-of-way as per Section 5.5.3.E.2. of the UDC. However, the proposed tower will be
designed to withstand a wind speed of at least 130 mph and therefore qualify for a
variance according to Section 5.5.3.E.5. of the UDC.
Mr. Dimas informed the Commission that the original layout submitted showed that the
cell tower did not meet the minimum required setback to a residential dwelling. Thus, the
reason for Staffs recommendation of denial. The applicant has since submitted a revised
layout and is in compliance with Section 5.5.3.E.3. of the UDC. The revised layout shows

a 198-foot setback to a residential dwelling (195 feet is required). Planning Commission
may choose to approve the request with a condition that the special permit will be bound
by the new site plan.
After Staffs presentation, the public hearing was opened. Representing the applicant,
Greg Ferris, addressed the Commission in support of the request. He stated he was
unaware that the original submittal did not meet code requirements and was informed
after public notification had already occurred. He said this tower is being removed from
an existing site and relocated to the subject property. With the revised site plan, the tower
meets code requirements (including wind load) and he is amenable to an approval with
conditions.
With no one else coming forward, the public hearing was closed. A motion was made by
Commissioner York recommending approval of the request with the condition that the
tower is in line with the 150% setback requirement when adjacent to a residential
dwelling. The motion was seconded by Commissioner Salazar-Garza and the motion
passed.
VII. Future Agenda Items
VIII. Director's Report
Nina Nixon-Mendez, Assistant Director, informed the Commission on upcoming events.
Input is needed on the Uptown Corridors Revitalization Strategy. The survey for this
project ends on February 20, 2022. The Planning Department is hosting an evening
lecture regarding Small Scale Development via Zoom. Registration is required for the
event being held on February 17, 2022.
IX. Adjournment of Planning Commission Meeting
There being no further business to discuss, the meeting adjourned at 7:10 p.m.
