FY 2022 Second Quarter Financial Report City Manager Zanoni presented the FY 2022 Second Quarter Financial Report as follows: presentation overview; general fund revenues; general fund expenses; general fund initiatives; water fund revenues and expenses; wastewater fund revenues and expenses; HOT tax revenue; development services revenue; Capital Improvement Program; summary; and next steps. b. Cole Park and Labonte Park Master Plans Update City of Corpus Christi Page 1 Printed on 5/13/2022 City Council Meeting Minutes May 10, 2022 City Manager Zanoni presented an update on Cole Park and Labonte Park Master Plans. The Cole Park Master Plan is being designed to replace the splash pad, ampitheater, the boardwalk along the water, and improve walking trails and signage. The Labonte Park Master Plan is being designed from 40 to 80 acres to include additional trail circulation, improved signage, kayak launch, and additional camping grounds. c. Recognition of Billy Delgado (Emergency Management Coordinator), recipient of the League of United Latin American Citizens 2022 Outstanding Community Leader Award and the Westside Business Association's Torchbearer Award City Manager Zanoni recognized Emergency Management Coordinator Billy Delgado as the recipient of several awards and his 33 years of service with the City. d. Saturday, May 14: Safe Fun -Fit Mental and Physical Awareness month 5k/10k Event sponsored by State Representative Todd Hunter City Manager Zanoni discussed the Safe Fun -Fit Mental and Physical Awareness 5k/10k event sponsored by State Representative Todd Hunter to be held on Saturday, May 14 at Cole Park Pier, 2600 Ocean Drive, at 7:30 a.m. e. Consent - Second Reading Ordinances 3. 22-0610 Ordinance authorizing acceptance of a grant in the amount of $75,000.00 from the State of Texas Body -Worn Camera Grant Program with a City cash match of $25,000.00 for the purchase of replacement Panasonic body cameras and related equipment for the Police Department; and appropriating $75,000 in the Police Grants Fund. This Ordinance was passed on second reading on the consent agenda. Enactment No: 032748 Consent - Public Safety First Reading Ordinances 5. 22-0727 Ordinance authorizing the acceptance of $725.49 from the State of Texas - Law Enforcement Officer Standards and Education account; and appropriating $725.49 into the Fire Grants Fund. This Ordinance was passed on first reading on the consent agenda. Consent - Contracts and Procurement 6. 22-0634 Motion authorizing a two-year service agreement with CAP Fleet Upfitters, LLC, of Houston for an amount not to exceed $662,223.39, through the BuyBoard cooperative, for the purchase and installation of parts and equipment for Police marked units, with FY 2022 funding of $487,105.61 from the Fleet Equipment Replacement Fund and $117,066.28 from the Corpus Christi Crime Control District Fund. This Motion was passed on the consent agenda. Enactment No: M2022-066 7. 22-0681 Resolution authorizing the acquisition of nine vehicles and equipment by various departments, of which seven units will be outright purchases and two units will be lease purchases through JP Morgan, for a total of $1,824,907.19, with such items to be acquired in the manner, at the amounts, and from the sources stated with FY 2022 funding in the amount of $1,523,850.99. This Resolution was passed on the consent agenda. Enactment No: 032749 8. 22-0248 Resolution authorizing a six-month service agreement with Scruggs Distribution, LLC, of Houston in an amount not to exceed $79,276.05 for the purchase and installation of actuators at the Mary Rhodes Pipeline pump stations for the Utilities Department, with FY 2022 funding available from the Water Fund. Enactment No: M2022-067 10. 22-0632 Motion authorizing the purchase of four traffic signal poles and four mast arms from Consolidated Traffic Controls, Inc. of Arlington, through the HGACBuy Cooperative, to support traffic and pedestrian travel at the Kostoryz Road and Masterson Drive intersection, for $68,075.00, with FY 2022 funding from the Street Maintenance Fund. This Motion was passed on the consent agenda. Enactment No: M2022-068 Consent - Capital Projects 11. 22-0679 Motion authorizing Amendment No. 2 to a professional services contract with Hanson Professional Services, Inc., for the design, bid, and construction phase services for the off-site drainage ditch improvements on North Lexington Boulevard from Leopard Street to Hopkins Road in the amount of $170,470.25, for a total contract value not to exceed $602,448.25, located in City Council District 1, with funds available from the FY 2022 Stormwater Funds. Mayor Guajardo referred to Item 11. Council Member Pusley asked to pull this item to recuse himself because he owns property on North Lexington Boulevard. A Council Member thanked staff for bringing this item to Council to address the drainage issue. Council Member Barrera made a motion to approve the motion, seconded by Council Member Lerma. A Council Member asked to pull this item to recognize the great work that Coastal Bend Bays & Estuaries does for the City; and a request for staff to reach out to them about park planning. Council Member Pusley made a motion to approve the resolution, seconded by Council Member Hunter. ("AEP") to Amend its Distribution Cost Recovery Factor; finding that AEP's application to increase distribution rates effective September 1, 2022 within the city should be denied; authorizing participation with the cities served by AEP; authorizing hiring of legal counsel; and finding that the City's reasonable rate case expenses shall be reimbursed by AEP. A Council Member and City Manager Zanoni discussed the following topics: a Council Member stated that the council is opposed to these rate increases; and these rates have nothing to do with the cryptocurrency issue raised during public comment. Mayor Guajardo referred to Item 17. Assistant City Manager Neiman Young and Financial Advisors Estrada Hinojosa representative Paul Jack presented information on the following topics: general obligation (G.O.) debt capacity; G.O. debt capacity FY 2022 model summary of results; G.O. debt capacity model: assumptions; recent G.O. bond programs; bond 2022 program overview; guiding principles; rough proportionality; and key dates for bond 2022. Council Members, Assistant City Manager Young, City Manager Peter Zanoni, Director of Finance Heather Hurlbert and Mr. Jack discussed the following topics: when the parks and recreation advisory committee would be engaged in the planning for the parks bond; a Council Member's concern that the proposed use of Certificates of Obligation (COS) to City of Corpus Christi Page 8 Printed on 5/13/2022 City Council Meeting Minutes May 10, 2022 fund the police academy project circumvents voter approval; a Council Member's concern about the rough proportionality for the parks fund; a Council Member's concern that the City is behind on residential street repairs; a request for information regarding new Legislative requirements for use of COS; and if the police academy project is put in the bond program, it will delay the start of construction. Mayor Guajardo referred to Item 18. Council Member Lerma requested to table this item until the Hunden report is received regarding convention hotel (approximately 45 days). Council Members, Director of Engineering Jeff Edmonds, City Manager Peter Zanoni and Assistant Director of Engineering Brett Van Hazel discussed the following topics: Council Members' desire to keep the Water Garden; the estimated completion of the design phase is August; a Council Member's concern about keeping the Water Garden and wasting water during a drought; and the high costs of maintaining the Water Garden. Council Member Lerma made a motion to table this item, seconded by Council Member Hunter. Mayor Guajardo referred to Item 21. Director of Intergovernmental Relations Tammy Embrey presented information on the Defense Economic Adjustment Assistance Grant (DEAAG) project. A Council Member thanked Ms. Embrey, City staff and the legislative delegation for making the DEAAG funds possible. Mayor Guajardo opened public comment. Commanding Officer of Naval Air Station Corpus Christi Captain Christopher C. Jason stated that Cabanis Field is the primary field for training, and protecting clear zones is very important for public safety and training. Council Member Barrera made a motion to approve the ordinance, seconded by Council Member Hernandez. This Ordinance was passed on first reading and approved with the following vote: Aye: 9 - Mayor Guajardo, Council Member Barrera, Council Member Hernandez, Council Member Hunter, Council Member Lerma, Council Member Martinez, Council Member Molina, Council Member Pusley and Council Member Smith Abstained: 0 N. BRIEFINGS: (ITEM 22) 22. 22-0863 Fees and rate schedule recommendations for Corpus Christi Fire Protection Services to customers who live outside the City of Corpus Christi city limits. Mayor Guajardo referred to Item 22. Fire Chief Robert Rocha presented information on the following topics: background; summary; methodology; next steps; and conclusion. Council Members, City Manager Peter Zanoni and Fire Chief Rocha discussed the following topics: staff will bring this item to Council for consideration of approval on Tuesday, May 24, 2022; this is a way to bill persons that live outside the city limits, but benefit from city services without paying property tax; in order to collect payment, the fire department would submit the bill to the resident; and Corpus Christi averages about 280 to 310 structure fires a year. O. EXECUTIVE SESSION: (ITEMS 23 - 25) Mayor Guajardo referred to Executive Session Items 23 and 25. The Council went into City of Corpus Christi Page 11 Printed on 5/13/2022 City Council Meeting Minutes May 10, 2022 Executive Session at 1:44 p.m. The Council returned from Executive Session at 3:18 p.m. 23. 22-0765 Executive Session pursuant to Texas Government Code § 551.071 and Texas Disciplinary Rules of Professional Conduct Rule 1.05 to consult with attorneys concerning legal issues related to the purchase, exchange, lease, or value of real property rights for desalination and water treatment, transmission, and storage facilities, including areas at or near the (1) the Inner Harbor Ship Channel Seawater Desalination Site at or in the vicinity of Nueces Bay Blvd, Summers St., Palm Dr., John St., and Broadway Street, Nueces Bay Heights Subdivision, Sunset Place Subdivision, and the Industrial Canal and (2) the La Quinta Channel Seawater Desalination Site involving various properties between Highway 361 and the La Quinta Ship Channel and areas in and adjacent to said locations, and pursuant to Texas Government Code § 551.072 to deliberate the purchase, exchange, lease, or value of real property (including, but not limited to, property rights at or in the vicinity of the aforementioned locations) because deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person, including, but not limited to Flint Hills Resources, Occidental Chemical Corporation, Chemours Company and affiliates thereof. This E -Session Item was passed after executive session. The following motion was considered: Motion to authorize preparation of final contract documents for the purchase of approximately 12.5 acres of property and 11 acres of easements from Flint Hills Resources Corpus Christi, LLC and related entities in the vicinity of Nueces Bay Boulevard, Broadway Street, and the Inner Harbor for a seawater desalination plant in an amount of $5,455,000, which will include an option period of 3 years and potential additional option time to allow for permitting and prerequisites related to a development agreement pursuant to Texas Local Government Code Chapter 212, a right to repurchase in the event of termination of the project, and requirements related to insurance, soil management, environmental sampling, and limits on use of the property. Council Members and City Manager Zanoni discussed the following topics: this motion opens the door to the next steps for the desalination project; two sites are still being negotiated for the desalination project; and this motion moves forward with the desalination project, but does not authorize the City to approve a contract. Council Member Smith made a motion to approve the motion, seconded by Council Member Barrera. Needless to say the noise level will increase with so many people & vehicles in this area. It will no longer be a nice, quiet, safe neighborhood as the hotel, condos, & townhomes will bring in lots of people from all over the country. The lights will constantly give off a glow limiting visibility at night & that could also be harmful to certain migrating birds depending on the time of year. The appraisal value & therefore the property taxes of our homes has already skyrocketed & this will only increase them more! Please don't ruin our island by allowing this type of development to be built with the only benefit going into a few pockets! You have the citizens and small business held hostage to these people and you not in moving the industrial district closer to homes a church and a junior high school. You repeatedly disregard public input at our public comments and you give differential treatment to Industry. We reject desal plants and you ignore well you're not going to be able to keep ignoring us. You have become part of the national conversation congratulations.
