Meeting Minutes
Planning Commission
Wednesday,June 29,2022 5:30 PM Council Chambers
I. Call to Order, Roll Call
The meeting was called to order and a quorum was established with Chairman Dibble
and Vice Chairman Schroeder absent.
II. PUBLIC COMMENT: None.
III. Approval of Absences: Commissioner Gonzalez
A motion was made by Commissioner Miller to approve the absence listed above and it
was seconded by Commissioner Munoz. The motion passed.
IV. Approval of Minutes
1. 22-1133 Regular Meeting Minutes of June 15, 2022
A motion was made by Commissioner Salazar-Garza to approve the minutes listed
above and it was seconded by Commissioner Miller. The motion passed.
V. Consent Public Hearing (Items A& B): Discussion and Possible Action
Commissioner York asked Staff to present the Consent Agenda, items "2, 3, 4, 5, 6 & 7".
Andrew Dimas, Development Services, read the Consent agenda into the record. New
Plat items "2, 3, 4, 5 & 6" satisfy all requirements of the Unified Development Code
(UDC)/State Law and the Technical Review Committee (TRC) recommends approval.
Staff also recommends approval for New Zoning item 7" as stated in Staff's report. After
Staffs presentation, Commissioner York opened the public hearing. With no one coming
forward, the public hearing was closed.
A motion was made by Commissioner Gonzalez to approve item "2" and it was
seconded by Commissioner Mandel. The motion passed with Commissioner Zarghouni
abstaining. A motion was made by Commissioner Miller to approve item "3 through 7"
and it was seconded by Commissioner Gonzalez. The motion passed.

Case No. 0522-02, City of Corpus Christi: Ordinance rezoning property at
or near 1525 Morgan Avenue, located along the south side of Morgan
Avenue, east of South Brownlee Boulevard, and west of 12th Street from
the "CG-2" General Commercial District and the "RS-TF" Two-Family
District to the "CN-1" Neighborhood Commercial District.

VI. Public Hearing (Item C): Discussion and Possible Action
C. Appeal
8. 22-1129 21 PL1086 -Appeal from a Staff Determination of Plat Expiration
RUSSELL INDUSTRIAL AREA, BLOCK 12, LOT 7A (FINAL - 0.780 ACRES)
Located north of Savage Lane and east of Savage Lane.
Mr. Dimas presented item "8" for the record as shown above. He informed the
Commission that The final plat was approved on August 4, 2021, and expired on
February 4, 2022, after 6-months. If the Planning Commission approves appeal, the plat
will be extended for 12-month from the original expiration date. The client chose to
submit an application for an appeal to the expiration date, instead of resubmitting a new
plat application for review and paying an additional plat application fee. The applicant
asserts the following:
• Due to setbacks and financial burden caused from the COVID-19 pandemic, the taxes
for the property were not able to be paid with the time limit of January 31 st of this year
imposed by Nueces County. Payment to surveyor and plat development fees were also
to be made by owner.
• Nueces County Tax Collector accepted a payment plan to be completed by May 2022.
• Plat development fees were paid and processed prior to the plat expiring on February
4th of this year.
• Owner seeks approval of the plat appeal based on the reasons above and based on
the consideration of the recent change to the plat expiration time limit to 12 months.
Plat requirements did not request for any construction; existing improvements were
sufficient for the replat. Staff recommends approval of the appeal. With approval the
applicant can submit the plat for recording as Tax certificates meeting the County Clerk's
requirements have been submitted. With denial the applicant can resubmit a plat
application. During the preparation of this appeal, City staff confirmed with the applicant's
surveyor the information listed above. After Staffs presentation, the public hearing was
opened. With no one coming forward, the public hearing was closed. A motion was made
by Commissioner Gonzalez and it was seconded by Commissioner Miller. The motion
passed.

There being no further business to discuss, the meeting adjourned at 5.52 P.M.
