AMENDMENT NO. 2 TO THE
AGREEMENT
BETWEEN CITY OF CORPUS CHRISTI AND NUECES COUNTY
REGARDING PARKER POOL SWIM ADMISSION FEES FOR 2022
This Amendment No. 2 to the Agreement between City of Corpus Christi and Nueces
County regarding Parker Pool Swim Admission Fees is made and entered by and
between the County of Nueces, hereinafter referred to as "County", and the City of Corpus
Christi, a Texas home-rule municipal corporation hereinafter referred to as "City";
WITNESSETH:
WHEREAS, in December 2018, the City of Corpus Christi and Nueces County
entered into the Agreement between City of Corpus Christi and Nueces County
Regarding Parker Pool Property For Utilities, Use of and Transfer of Property, ("the
Agreement") providing for payment for utilities, and the use of and transfer of property
located at or near 654 Graham Road: the swimming facility known as "Parker Pool",
from the City to the County;
WHEREAS the Agreement provided for the County to provide a general public
swim program at Parker Pool;
WHEREAS, the City has enacted free general swim program for the pools owned
and operated by the City, and is promoting similar free general public swim program for
the Parker Pool;
WHEREAS, 2022 is the last year in which the City will participate in funding free
public swim at Parker Pool and the City acknowledges that the County may reinstate
fees for public swim at Parker Pool in future years to cover the associated costs;
WHEREAS, Section 12 of the Agreement provides that amendments which do
not change the essential purpose of the Agreement may be agreed to by the City
Manager for the City and the County Judge for the County;
NOW THEREFORE, this Amendment No. 2 to the Agreement is made and
entered into by County and City for the mutual consideration stated herein.
The parties agree to amend Section 2 DUTIES OF THE COUNTY of the Agreement by
adding subsection E as follows:

2. DUTIES OF THE COUNTY
E. The County shall not charge any fee for the free public swim program during
2022. The general public swim program will be free to the public throughout
2022. The free admission shall expire when Parker Pool closes for the 2022
season or on December 31, 2022 whichever date occurs first. The County may
reinstate fees for public swim for the 2023 season. If the County chooses to
continue offering free public swim after December 31, 2022, the City will not
provide any funding to cover that cost.
The parties agree to amend Section 3 of the Agreement by adding subsection D as
follows:
3. DUTIES OF THE CITY
D. In consideration of the free general public swim program in 2022 for minimum
of 20 hours per week as described above in Section 2 subsection E, the City
agrees to pay the County a one-time payment of$18,250 for 2022. All payments
made in accord with Amendment No. 2, will be made from current revenues of
the paying party. Payment shall be issued to the County to the following

The parties agree that all other terms of the Agreement and all previous amendments,
previously amending the original Agreement, remain in full force and effect except as
amended by this Amendment No. 2.
This Amendment No. 2 takes effect on date of last signature.
