532nd CIVIL SERVICE COMMISSION MEETING

Chairperson, Dr. Beth Rauhaus called the meeting to order at 2:04 p.m.
Eyvon McHaney reads agenda item #1.
Item #1:Review and approve the minutes of the 53 1st Civil Service Commission meeting
held June 30, 2022.
Member, Gerald Avila made a motion to approve the minutes and Chairperson, Dr. Beth Rauhaus
seconds the motion. All members agreed.

Item #2:Appoint three physicians for review of Fire Cadet pre-employment physical
disqualification appealed by candidate per City of Corpus Christi Rules and
Regulations of the Civil Service Commission for Firefighters and Police Officers
Article V, Section B 'Examinations for Eligibility Lists".
Amelia Allen explains the purpose of the meeting. She further explains to the commission
members that two of three physician CV's can be found on Tabs 1 and 2, while she attempted to
have all three, one physician's office Human Resources personnel was out of the office; therefore,
the third CV was not available prior to the meeting to be added to the booklet for their review.
Commission Member, Dr. Sibila raised the question if another meeting will be required to approve
a third physician. It was discussed that if a third physician will be required, another commission
meeting would be scheduled either in-person or virtually for the commission members to review
and approve the third physician.
Commission Member, Dr. Sibila, inquired if these physicians were found by the city or the
applicant. Amelia Allen responded that these physicians were found by the city as per the Civil
Service Commission Rules and Regulations, and yes, they do have contracts with the city but to

provide different services other than our pre-employment testing. Pre-employment testing is
conducted by the city's designated city physicianlclinic, Alliance Health Resources. Alliance
Health Resources conducted Mr. Acosta's pre-employment testing in which Mr. Acosta failed to
be certified to perform all essential functions, with or without accommodation, without restriction
of the job of a Firefighter.
Amelia Allen explained that Tab 4 shows Mr. Acosta's Medical Surveillance Certificate from
Alliance Health Resources which indicates the applicant has a Category II restriction, meaning
Mr. Acosta, the applicant, is restricted to the utilization of respiratory equipment for a maximum
of two (2) hours per day. Additionally, Mr. Acosta's FVC percent of 64.7% is cause for restriction,
which prevents the applicant from being certified as meeting the medical requirements of the
National Fire Protection Association (NFPA). A less than 70% prevents the safe use of Self-
Contained Breathing Apparatus (SCBA) due to increased minute ventilation requirements leading
to the earlier that expected depletion of air in the SCBA cylinder.
Dr. Deborah Sibila makes a motion to approve to appoint Dr. Dennis Urn, M.D., and Dr. Guy
Racette M.D. to conduct further examination of applicant. Commission Member, Gerald Avila
seconds, the motion. All members agree.
Chairperson, Dr. Beth Rauhaus adjourned the meeting at 2:12 p.m.
Minutes Amendment:
On December 22, 2022, Chairperson, Dr. Beth Rauhaus virtually approved Dr. Thomas Nguyen,
M.D. to conduct further examination of applicant. Commission member, Dr. Deborah Sibila
seconded the motion.
