Call to Order; Roll Call Chairman Zarghouni called the meeting to order at 5:30 pm and a quorum was established to conduct the meeting. II. PUBLIC COMMENT: NONE. III. Approval of Absences: Commissioners Mandel and Salazar-Garza A motion was made by Commissioner Munoz and seconded by Commissioner York to approve the absences. The motion passed. IV. Approval of Minutes 1. 23-0268 Regular Meeting Minutes of January 25, 2023 A motion was made by Commissioner York to approve the minutes listed above. The motion was seconded by Vice Chairman Miller. The motion passed. V. Consent Public Hearing: Discussion and Possible Action (Items A & B) Mark Orozco, Development Services, read the Consent agenda into the record as shown below; new plat and zoning items "2 through 9". The plats satisfy all requirements of the Unified Development Code (UDC)/State Law, and the Technical Review Committee (TRC) staff recommends approval. Commissioner York asked staff to explain the Conditions for the Whitecap Preliminary; the main conditions are the individual lift stations that had to be approved by Public Works. After Staff's presentation, Chairman Zarghouni opened the public hearing. With no one coming forward, the public hearing was closed. A motion was made by Commissioner York to approve the Consent Items "2 through 9" as presented by staff. The motion was seconded by Commissioner Salazar-Garza. The motion passed. A. Nina Nixon-Mendez, Assistant Director, read into the record Carmelite Home Tract Block 1 Lots 1 R, 2, 3, 4, 5 (Replat-6.18 acres) item "10", Plat with a Variance (Waiver), and "11" Sidewalk & Off-Road Multi-Use Trail Construction. Bria Whitmore, Development Services, presented the Plat with a Variance (Waiver), and Sidewalk & Off-Road Multi-Use Trail Construction. The subject property, known as the proposed Carmelite Home Tract Block 1, Lots 1 R, 2, 3, 4 & 5 (6.66 acres +/-), located to the Northwest of the intersection of Everhart and Alameda. The current lot is vacant. Only lot 3 currently has plans for development, which is for a corner store. 1,200 feet of sidewalk is required along Everhart. The Mobility Plan calls for an off-road multi-use trail along Carmel Parkway drainage ditch. This plat waiver request is for the construction of the 1,200 feet of sidewalk along Everhart and the construction of an off-road multi-use trail along the Carmel Parkway drainage ditch. Staff analysis and findings: UDC Sections 8.1.4 and 8.2.2 require construction of sidewalk as part of the platting process. UDC Sections 3.30.1 and 8.1.4 require construction of sidewalk as part of the platting process. UDC Section 8.21 requires construction in accordance with Mobility Plan. The UDC also states, under Section 8.2.2.8.1, that a waiver may be granted, in accordance with the waiver procedure in Section 3.8.3.D: The waiver may be approved, approved with conditions, or denied after consideration of the following factors: The granting of the waiver shall not be detrimental to the public health, safety or general welfare, or be injurious to other property in the area, or to the City in administering this City of Corpus Christi Page 3 Printed on 2/23/2023 Planning Commission Meeting Minutes -Final February 8,2023 Unified Development Code; The conditions that create the need for the waiver shall not generally apply to other property in the vicinity. Application of a provision of this Unified Development Code will render subdivision of land unfeasible; or The granting of the waiver would not substantially conflict with the Comprehensive Plan and the purposes of this Unified Development Code. The enumerated conditions in UDC 3.8.3.D for a sidewalk waiver are not fully met on this subject property. Staff recommends Disapproval of the waiver request for the construction of sidewalk. Staff recommends Approval of the waiver request for the construction of off-road multi-use trail. Commissioners questioned if the portion of Everhart was on the Public Works five-year plan since the city is not planning on reconstruction soon. There are curb, gutter, and inlets along the road as well as underground storm infrastructure. If this waiver was denied, would the developer have to build in the right-of-way? Staff replied it needs to be sidewalk for the entire stretch and would request an access easement. Staff would develop a process how and where the sidewalk would need to be built. In addition, filling in the ditch would not affect anything or disrupt drainage except for the site; therefore, the ditch is not required. Commissioners asked if there are any other mechanisms besides the deferral that could accomplish the developer's request. Staff stated Development Services requires financial security with deferment agreements and the deferment agreement allows them to record their plat. Staff has provided information on deferments to the developer. Commissioners asked if the manholes in the swale would require relocation and staff stated only if the flow of the water was changed. Discussions have been held with the Park Department and the PRAC. The reason for approving the waiver on the Multi-Use is because there is not a plan in motion to put in Multi-Use on either side of the street and park renovations are not currently in process. Andrew Dimas, Development Services, stated when the plat was submitted, it was with one owner. Since submission, portions of the property have been sold and now has multiple owners. The plat would eventually need to be updated. If the plat is approved, at the time of recordation, each owner would have to sign. At the time of submission, the plat met all requirements. After staff presentation, Chairman Zarghouni opened the Public Hearing. James Pool, 2627 Tiller Street, Ft. Worth, TX; on behalf the developer, outlined the City of Corpus Christi Page 4 Printed on 2/23/2023 Planning Commission Meeting Minutes -Final February 8,2023 project asking for the waiver since they do not own all the property and were proposing construction on the Stripes project only. The right-of-way is not feasible to put a sidewalk in at this time, however, the next phase will include the sidewalk. The field view of the dip shows significant dirt work and drainage capacity requirements would need to be completed. The city code does allow for the waiver. After there were no other public comments, Chairman Zarghouni closed the public hearing. A motion was made by Commissioner York to approve Item "10 and 11" as presented. Commissioner Munoz seconded. Roll Call Vote: Aye: Chairman Zarghouni, Commissioners York, Salazar-Garza, and Munoz. Nay: Vice Chairman Miller, Commissioners Mandel and Motaghi. The motion passed. VII. Director's Report: NONE.
