I. Call to Order, Roll Call
Chairman Zarghouni called the meeting to order at 5:30 pm and a quorum was
established to conduct the meeting.
II. PUBLIC COMMENT: None.
III. Approval of Absences: None.
IV. Approval of Minutes
1. 23-0997 Planning Commission Meeting Minutes May 31, 2023
A motion was made by Vice Chairman Miller to approve the minutes listed above and
seconded by Commissioner Hedrick. The Vote: All Aye. The motion passed.
V. Consent Public Hearing: Discussion and Possible Action. (Item A , B, and C)
A. Plats
Andrew Dimas, Development Services, presented item 6.
Item 6: Zoning Case No. 0623-01, MPM Development, LP, Corpus Christi Independent
School District, and the City of Corpus Christi (District 5).
Proposed Use: To allow for a mixed-use development to include retail pads (-9.2 acres),
multifamily (-27.3 acres), single-family (-51.5 acres), and a school site (-40 acres).
Area Development Plan: Southside
Future Land Use Map: Floor Plain Conservation, Medium-Density Residential
Existing Zoning: "FR" Farm Rural, "RE" Residential Estate
Adjacent Land Uses:
• North: Vacant, Agriculture, Public Semi-Public, Zoned "CG-2"
• South: Conservation/Preservation, Water, Zoned "Water"
• East: Conservation/Preservation, Water, Zoned "RS-6"
• West: Vacant, Low-Density Residential, Zoned "RS-4.5"
• The proposed rezoning is inconsistent with the Future Land Use Map which calls for
most of the land to be preserved for environmental reasons as the property lands within

the 100-year flood pain. However, the area has been home to a shooting range for past
decades. Large portions of the subject property are owned by the City of Corpus Christi
and were to be home to a proposed wastewater treatment plant.
• The subject property is consistent with many broader elements of the City of Corpus
Christi Comprehensive Plan such as transitions between land uses and locational needs
for public/semi-public uses.
STAFF RECOMMENDATION: Approval of the change of zoning from the "FR" Farm
Rural District and "RE" Residential Estate District to the "RS-4.5" Single-Family 4.5
District, "CN-1" Neighborhood Commercial District, and the "CG-2" General Commercial
District.
Commissioner Salazar-Garza stated the City of Corpus Christi had proposed a
wastewater treatment plant, and where would that be located.
Mr. Dimas stated originally that was the plan. As part of a land swap, we are no longer
pursuing the wastewater treatment plant; there will be two schools, commercial
development, and single-family development.
Vice Chairman Miller stated this development is technically inconsistent with the
Southside Area Development Plan and future land use map, but from a timeline
standpoint, was the future land use map adopted prior to the land swap.
Mr. Dimas stated, yes. The fabric and the character of the corridor will be maintained.
Vice Chairman Miller stated for the designation of the floodplain conservation area, what
are the earmarks for a future land map.
Mr. Dimas stated we would start with the shoreline and areas that may have undulations
or a shallower slope as you approach a body of water; it's typically around the Oso
because that is your outfall. Floodplain conservation might be done on a FEMA map, but
this was done before the new FEMA maps were adopted. This is a good safety
mechanism to have certain portions designated as floodplain conservation.
Vice Chairman Miller stated the drainage for this area is the Oso.
Mr. Dimas stated yes, as part of the platting process, they have to process a stormwater
quality management plan. They may have some water that goes to the right-of-way, they
may have to retain some, depending on what the system can accommodate.
Chairman Zarghouni asked for clarification on the road closure of Starry Road.
Mr. Dimas stated he has heard of an application to traffic engineering to close the
right-of-way to Starry Road.
Chairman Zarghouni asked what would happen to the properties on Starry Road.

Mr. Dimas stated if there are existing property owners and that is their sole means of
access, it will be in high consideration of even attempting to close the right-of-way. In the
State of Texas, you cannot create landlocked properties, the city could not approve if the
property owners did not have a new means of access to their properties.
After Staff's presentation, Chairman Zarghouni opened the Public Hearing.
Hearing no Public Comments, Chairman Zarghouni closed the Public Hearing.
A motion was made by Vice Chairman Miller to approve Consent Item 6 as presented by
staff and seconded by Commissioner Salazar-Garza. The Vote: Aye: Chairman
Zarghouni, Vice Chairman Miller, Commissioners York, Salazar-Garza, Motaghi, and
Lerma. Commissioner Hedrick abstained. The motion passed.
Mark Orozco, Development Services, read Consent Agenda items 2, 3, 4, 5, and 7 into
the record as shown below; plat items 2, 3, 4, 5, and 7. The plats satisfy all requirements
of the Unified Development Code (UDC)/State Law, and the Technical Review
Committee (TRC) staff recommends approval.
After Staff's presentation, Chairman Zarghouni opened the Public Hearing.
Rick Trevino, 3301 Cresthill Drive, approached Commissioners and asked how is this
going to preserve his neighborhood with the chaotic traffic on Kostoryz. A group of
neighbors called to find out what will be built. The property line comes all the way to their
fence. Area homes are dealing with trash and over population. His neighborhood is an
older, quiet neighborhood, please keep as a residential, family neighborhood.
Hearing no more Public Comments, Chairman Zarghouni closed the Public Hearing.
A motion was made by Commissioner York to approve items 2, 3, 4, 5, and 7 and
seconded by Commissioner Motaghi. The vote: All Aye. The motion passed.

the "CN-1" Neighborhood Commercial District. Providing for a penalty not to
exceed $2,000 and publication (Staff recommends approval).

Item 8: Zoning Case No. 0623-02, Ron and Vanessa, LLC III, and TRR Development,
LLC (District 4).
The applicant requested this item be tabled.
No notices were received on this zoning case.
Chairman Zarghouni asked why the applicant did not know about the staff
recommendation.
Mr. Dimas stated they distribute the Friday before the planning commission date but

sometimes additional time is needed.
Chairman Zarghouni opened the Public Hearing.
Chip Urban, Urban Engineering, 2725 Swantner, on behalf of the applicant, approached
the Commissioners and stated if there was notice sent to them about the recommended
denial, they didn't catch it until yesterday and were unable to reach staff and would like to
table to the next meeting. There are not any major issues, may be application issues.
Hearing no more Public Comments, Chairman Zarghouni closed the Public Hearing.
A motion was made by Commissioner York to table item 8 to June 28 and seconded by
Commissioner Motaghi. The vote: All Aye. The motion passed.
8. 23-0994 Public Hearing - Rezoning for properties located at or near 15821,15825
South Padre Island Drive (Park Road 22) and 15822, 15826 Palmira Drive.
Zoning Case No. 0623-02, Ron and Vanessa, LLC III, and TRR Development,
LLC (District 4). Ordinance rezoning properties at or near 15821, 15825 South
Padre Island Drive (Park Road 22) and 15822, 15826 Palmira Drive from the
"CR-2/10" Resort Commercial District with the Island Overlay to the
"CR-2/10/PUD" Resort Commercial District with the Island Overlay and a
Planned Unit Development; Providing for a penalty not to exceed $2,000 and
publication. (Staff recommends denial).
