Planning Commission
Wednesday,July 12,2023 5:30 PM Council Chambers
I. Call to Order, Roll Call
II. PUBLIC COMMENT: None.
III. Approval of Absences: Commissioner York
A motion was made by Commissioner Mandel to approve the absence and seconded
by Vice Chairman Miller. The Vote: All Aye. The motion passed.
IV. Approval of Minutes
1. Regular Planning Commission Meeting Minutes 6-28-23
A motion was made by Vice Chairman Miller to approve the minutes listed above and
seconded by Commissioner Mandel. The Vote: All Aye. The motion passed.
V. Consent Public Hearing: Discussion and Possible Action (Item A and B)
Mark Orozco, Development Services, read Consent Agenda items 2, 3, 4, 5, 6, and 7
into the record as shown below. The plats satisfy all requirements of the Unified
Development Code (UDC)/State Law, and the Technical Review Committee (TRC)
staff recommends approval.
Chairman Zarghouni stated he had a question about the reason for the time
extension; has the builder confirmed a start date?
Mr. Orozco stated the public improvements were approved in March. The applicant
stated they want a future date, and there is no confirmed start date.
Chairman Zarghouni opened the public hearing for items 2, 3, 4, 5, 6, and 7. Seeing
no one to speak, the public hearing was closed.
A motion was made by Commissioner Salazar-Garza to approve the Consent Agenda
as printed and seconded by Commissioner Motaghi. The Vote: All Aye. The motion
passed.

VI. Public Hearing: Discussion and Possible Action (Item C and D)
Bria Whitmire, Development Services, presented Items 8 and 9:
UDC 3.30.1.A: requires installation of improvements, or financial guarantee, during
platting
UDC 8.1.4: During platting, the "developer shall provide":
A. "Streets, including but not limited to pavement, curb and gutter, sidewalks ...."
UDC 8.2.2.A.4: "Sidewalks shall connect to existing adjacent sidewalks or be
designed and placed to allow connection to future adjacent sidewalks"
• Need for waiver shall be demonstrated to Planning Commission's satisfaction
• The waiver may be approved, approved with conditions, or denied after
consideration of the following factors:
1. Not detrimental to public health, safety, or general welfare, or be injurious to other
property in area, or to the City;
2. The conditions that create the need for the waiver shall not generally apply to

other property in the vicinity;
3. Application of the provision will render subdivision of land unfeasible; or
4. The granting of the waiver would not substantially conflict with the Comprehensive
Plan and the purposes of the UDC
Factors in support of the waiver:
1. The Subject Property is Industrial in Nature. The granting of the waiver is not
detrimental to the public health, safety, or general welfare, nor is it injurious to other
property in the area, or to the City in administering the UDC.
2. The granting of the waiver would not substantially conflict with the Comprehensive
Plan or the purposes of the UDC.
3. There is currently a ditch along Holly Road. Which is an allowable exception Per
UDC.
4. The Subject Property in Proposed Lot 3A is full developed and will stay as is with
no alterations.
5. The Subject property is currently Zoned IL and the conditions that created the
need for the waiver shall not generally apply to other property in the vicinity.
Factors against the waiver:
1. Holly Road is an A2 and Los Robles Drive is a Cl; Not having sidewalks along
arterials and collectors typically leads to pedestrians walking in roadways, an unsafe
situation.
2. The property backs up to a single-family residential area along Los Robles Drive,
and one intersection to the east is Greenwood with another single-family residential
area.
3. There is a beaten path to the south along Los Robles Drive that includes access
over a nearby drainage ditch. All other ditches/swales in the area are minor and not
impractical to build a sidewalk near to.
4. City Council approved TIRZ 5 for the corner of Holly and Greenwood, which is
planned for a mixed-use development called Bohemian Colony.
5. There is a bus stop on Greenwood at Holly Rd.
6. Construction of sidewalk, even unconnected sections, promotes construction of
sidewalk throughout the community.
Staff recommendation:
Staff recommends disapproval of the waiver from the sidewalk construction
requirement Planning Commission may choose to follow or decline Staff's
recommendation, and Planning Commission may approve, approve with conditions,
or deny the waiver request.
Commissioner Munoz asked if there were plans to widen Holly Road from Greenwood
to Los Robles.
Ms. Whitmire stated there is not. Holly will remain as is.

Commissioner Hedrick asked if there would be a sidewalk on Holly and Los Robles.
Ms. Whitmire stated yes, on both. The area is an industrial zone; there is more
connectivity on the south side.
Chairman Zarghouni opened the Public Hearing for Item 8 and 9.
Francisco Medrano, project manager for Urban Engineering, approached
Commissioners and stated there is a residential subdivision on the south end and
doing the sidewalk all the way to the industrial would promote children in a residential
area to go to the industrial area. There is no curb and gutter where the sidewalk is
being proposed.
Seeing no one else to speak, Chairman Zarghouni closed the Public Hearing.
Vice Chairman Miller asked what the current base zoning is; it is IL. West and North
are both IL.
A motion was made by Vice Chairman Miller to approve the waiver and the plat for
Items 8 and 9. Commissioner Munoz seconded. The Vote: All aye. The motion
passed.

VII. Director's Report
Assistant Director Nixon-Mendez stated the July Task Force meeting is Friday, July
21, 9:00 am in the 6th floor conference room at city hall. The city secretary sent
information regarding the supplemental ethics report that is due July 28. The planning
commission meetings will continue to be in chambers through the 9th of August and
will then be held in the 6th floor conference room while chambers are remodeled.
