F. CITY MANAGER'S COMMENTS / UPDATE ON CITY OPERATIONS: (ITEMS 1-2)
1. 24-0123 Staff Announcement: Drew Molly, P.E., Chief Operating Officer of Corpus
Christi Water
City Manager Peter Zanoni introduced Drew Molly as new Chief Operating Officer of
City of Corpus Christi

Corpus Christi Water, highlighting his experience and achievements in water
management. Drew spoke about the importance of water for the regional community.
2. 24-0124 January 15 - January 17, 2024 Extreme Weather Event Debrief
City Manager Peter Zanoni reviewed the city's preparation and response for the
freezing weather last week. The city opened daytime warming centers and overnight
shelter; 311 was open on the Martin Luther King Jr. Day holiday and received over
300 calls; wellness checks were performed on seniors that participate in certain
programs; and Animal Care Services brought stray animals to the shelter, and
fostered shelter animals with residents, resulting in several adoptions. The
community collaboration was appreciated.
G. PUBLIC COMMENT
Mayor Guajardo opened public comment.
Shawn Flanagan, 4218 Herndon St., recommends the City does a community
campaign on desalination and present options to the community.
Alycia Kasperitis, 5325 Yorktown Blvd., stated that Coastal Bend Homebuilders
Association supports a sustainable water supply for the community & supports master
plans but not the accompanying cost estimates.
Peter Moore, 15110 Leeward Dr., spoke about the historical significance of the
Hillcrest Neighborhood and against industrial development and desalination in this
area.
Jay Gardner, 3922 Sweet Bay Dr., shared that the City's Island Strategic Action
Committee (ISAC) passed a resolution to extend the no wake zone along Packery
channel for boater safety.
Bob Corbett, 13530 Carlos Fifth Court, shared that ISAC is working on resolution
related to amend the UDC's relative runoff slope requirements to address flooding
issues.
Bryan Gulley, 14202 Playa Del Rey, spoke about concerns for the Inner Harbor plant
location and that desalination is a feasible but costly water source.
Deanna King, 901 Leopard St., asked for support for the Hillcrest community.
Shirin Delsooz, 6030 Tapestry Dr., spoke about applying for a grant for a bike trail.

Mayor Guajardo recessed the Council meeting for lunch at 1:46 p.m. Executive
Session Items 14 and 15 were held during the lunch recess. Mayor Guajardo
reconvened the meeting at 2:42 p.m.
K. INDIVIDUAL CONSIDERATION ITEMS: (ITEMS 3-10)
3. 24-0095 Ordinance by the City Council of the City of Corpus Christi, Texas authorizing
the private placement issuance of its Utility System Senior Lien Revenue
Improvement Bonds with the Texas Water Development Board in one or
more series (as designated by purpose and series) for water, wastewater,
and stormwater utility improvements in an amount not to exceed
$211,050,000, within set parameters; making provisions for the payment and
security thereof by a first and prior lien on and pledge of the net revenues of
the City's Utility System on a parity with certain currently outstanding Utility
System Revenue Obligations; stipulating the terms and conditions for the
issuance of additional revenue bonds on a parity therewith; prescribing the
form, terms, conditions, and resolving other matters incident and related to
the issuance, sale, and delivery of one or more paying agent/registrar
agreements and one or more escrow agreements; complying with the
City of Corpus Christi

requirements imposed by the letter of representations previously executed
with the Depository Trust Company; complying with the regulations
promulgated by the Texas Water Development Board; delegating authority to
the City Manager, the Chief Financial Officer, and the Director of Finance and
Procurement to execute certain documents relating to the sale of each series
of bonds; authorizing the execution and approval of a financing agreement
between the City and the Texas Water Development Board related to the
bonds; enacting other provisions incident and related to the subject and
purpose of this ordinance; and providing an effective date.
Mayor Guajardo referred to Items 3-9.
Chief Operating Officer of Corpus Christi Water Drew Molly, Associate of Freese and
Nichols Jason Cocklin, and PrincipalNice President of Freese and Nichols Charles
Wolf presented information on items 3 through 9 to show how they are all connected
to the Inner Harbor Desalination Plant project.
Chief Operating Officer Molly explained that this is a well thought out proposal that
CCW was asked to complete by Council. The process started over 10 years ago and
has involved multiple councils and public engagement sessions during that time.
Presentation topics included: Explanation of each desalination agenda item, Benefits
to Customers in Coastal Bend, Lead Project Team, CC Water History, Key
Milestones, Project Efforts and Achievements, Inner Harbor Seawater Desalination
Treatment Plan, Water Supply and Delivery Resiliency, Inner Harbor Seawater
Desalination Treatment Plan: 2024 Opinion of Probable Cost Summary, Project
Timeline Going Forward, Master Services Agreement Amendment, SWIFT II Funding,
Budget Outlay for SWIFT II, Bureau of Reclamation Grants, and AEP Power
Agreement.
Council Members, Chief Operating Officer Molly, Mr. Cocklin, and Mr. Wolf discussed
the following topics: concerns about total cost of the project and how those costs were
determined; the difference between high-level project cost estimating models and cost
estimating for a defined project; Freese & Nichols staff is willing to explain the process
to those that want to go into more detail; costs are always a moving target as they
change frequently; frequency of use in Texas cities and costs for new groundwater
sourced water supplies in this area; annual maintenance costs for this project; the
process utilized to model projected water salinity; the possibility of adding a damage
bond or indemnity bond to the project; concerns on water rate increases and modeled
water rate increases; the amount of yearly debt service the project will create;
uneasiness about the time period given to Council to review the information; request
for more specific information on the impact to rates for water and wastewater; the
project will create about 3,500 jobs over its development with an estimated 600-700 at
peak construction times; contractors usually hire from the local area; the City has a
project in process with the goal of increasing the capacity of the Mary Rhodes
pipelines by about 10 million gallons per day; everyone that lives in the Coastal Bend
will pay for the project; there are multiple projects in development to enhance the
water supply and this is part of the plan; appreciation that the plant includes another
water treatment plant so the City has a backup to O.N. Stevens plant; the deadline to

inform the Texas Water Development Board of the City's decision to accept the loan
is February 7; and future water demand is estimated at 15 MGD.
Mayor Guajardo opened public comment for items 3 through 9.
David Loeb, 4771 Ocean Dr., expressed concern about increasing water rates but
acknowledges this project is the most feasible to increase water supply.

purposes; authorizing other matters incident and related thereto; and
providing an effective date.

the purchase of real property to transfer interest(s) in property as required by

Minutes.
Mayor Guajardo referred to the Consent Agenda. The Minutes were approved on the
consent agenda.
K. PUBLIC HEARINGS: (ITEM 12-13)
12. 24-0092 Ordinance adopting Land Use Assumptions and Capital Improvements Plans
relating to the possible future adoption of water, wastewater, stormwater, and
roadway impact fees for the City of Corpus Christi and its extraterritorial
jurisdiction; and amending the Comprehensive Plan of the City of Corpus
Christi by adopting related Water Master Plan, Wastewater Master Plan,
Stormwater Master Plan, and Roadway Master Plan.
Mayor Guajardo referred to Item 12.
Council Members, Director of Development Services Al Raymond, City Attorney Miles
Risley, and Managing Principal of Pape Dawson Engineers Cara Tackett discussed
the following topics: a Council Member would like to postpone the Capital
Improvement Plans (CIP) to a future date for staff to bring back a standard format; the
CIP numbers are high level estimates and based on project definition; changes can
be made to the Plans after approval as long as they stay within the general project
definition; and CIP's need to be approved in order to move forward with calculations
on impact fees.
Mayor Guajardo opened the public hearing.
Ram Munoz, 1608 South Brownlee, stated that the Capital Improvement Advisory
Committee (CIAC) spent hours working on the Master Plans while still considering
impact fees.

Eli McKay, 1008 Marguerite St., CIAC member, stated she attended numerous
meetings and workshops regarding Master Plans and spoke in support of approving
them.
Moses Mostaghasi, 8017 Bar Le Doc, Chairman of CIAC, stated that they spent hours
working with Pape Dawson Engineers and City staff on the Master Plans and in
support of CIP's while still reviewing impact fees.
Mayor Guajardo closed the public hearing.
Council Member Barrera moved to approve the ordinance, seconded by Council
Member Campos. This Ordinance was passed on first reading and approved with the

Oso Parkway and meeting other conditions.

attorneys concerning legal issues related to the potential exchange of
properties owned by the City and Corpus Christi Community Improvement
Corporation at 1208 Peabody Avenue & 1622 Van Loan Avenue with
properties owned by the Port of Corpus Christi at 2011 Palm Drive & 2101
Van Loan Avenue and Texas Government Code § 551.072 to discuss and
deliberate the potential exchange of said properties with the Port of Corpus
Christi.

15. 24-0078 Executive session pursuant to Texas Government Code § 551.071 and
Texas Disciplinary Rules of Professional Conduct Rule 1.05 to consult with

Item 14- In the interest of trust, this item should be in the open meetings part of the meeting. Why swap land without first
being certain the city will be allowed to attempt to construct a desalination facility in the Hillcrest neighborhood? Have you
walked by the 1208 Peabody Ave and 1622 Van Loan Ave properties that the City owns? Have you walked by the 2011 Palm
Dr. and 2101 Van Loan Ave properties the Port owns? I would suggest all Councilmembers do this first. I would also suggest
the City hold public meetings in the neighborhood and ask the residents what they think. Item 15- In the interest of trust,
IDA discussions and negotiations should be done in open meetings and open to public comment.

Enough is enough. Listen to the indigenous protectors of this land: The dredging that will happen if this project happens is
disrespectful to the land & the people. It will bring pollution to the marine animals and the imbalance it will cause to the
ecosystem of the water is going to be catastrophic. The City of Corpus Christi - Government should be ashamed! The water is
not for the people - it is for the fossil fuel corporations. We are in the Climate Change era - please recognize the possible
dividends of PROTECTING instead of DESTROYING.

The desalination plant cannot be constructed by any means, not only will the project only benefit corporate interest as it will
be used solely for industry, but even if it did serve the people of the area we would be investing in projects which only treat
the symptom of clean water insecurities which have been exacerbated by oil and tech industry rather than treating the
illness. We should be investing in local communities and infrastructure which seek to protect and revitalize waterways and
ecosystems through natural means which have been utilized for thousands of years by the indigenous populations of this
land. Additionally the largest downfall of this plant will be experienced by the people living in the site of this plant, which is
historically black, and the ecosystem in the gulf which already have high salinity.

I strongly OPPOSE the desalination plant. This plant will privatize drinkable water and displace a historically BIPOC
community that has lived in the area for decades. This is NOT okay. This plant would cause harm to the local Indigenous

wildlife. It is not natural and has no place in our beautiful bay. Please put the people that live in the community over making

I strongly opposed to the proposed project of desalination at this time for the following reasons: I do not agree with plans to
use the Hillcrest community to build this plant. It is an injustice that the Hillcrest neighborhood is being considered for
building this plant. I strongly believe that other location(s)should be considered instead of breaking up this historic
neighborhood. I understand that it has been proposed that the brine be dumped into the bay. I find this unacceptable. The
bay is already dirty and if brine is dumped into the bay, this will surely kill marine life. I don't want my tax dollars going
towards paying for this project. Our water bills are already higher than other Texas cities. Since industry is the greatest users
of our water, I strongly believe they should pay for it.

As a 4th generation citizen of Ingleside, I oppose the wide coastal desalination projects that have been proposed across out

I oppose the use of bay waters to be turned into commodities for a harmful industry. The act of dredging in the creation of
this project is also harmful and would cause damage and contribute to habitat loss and destabilization of marine species.
Citizens value our area and its precious resources and do not want to risk irreplaceable land and animals by exploiting it all in
the name of money.

No to desal! The historic majority black Hillcrest neighborhood has endured tremendous hardship such as criminal toxic
waste pollution, discriminatory construction projects, etc. Is Hillcrest expendable for the sake of industry growth? It has
higher cancer rates, birth defects, and higher rates of industrial air pollution. We know we're being sacrificed for the sake of
growth which won't benefit us. Water boils are frequent; potholes go unfixed. In 2020 6 refineries had benzene emissions
above the federal action limit. Workers in our refineries, which the city is fighting to achieve desal for, have a higher risk of
cancer. All with industry growth. If the city truly meant to benefit us with desal, it would apply this sentiment to crumbling
wastewater infrastructure. Developing more treatment solutions would even mutually provide grey water for industry, but
that would require the city to care about its residents more than industry. Please vote against funding desal.

I have asked that we vote on whether tax paying citizens fund desalination or not since 2017. I ask that again. Put
desalination project on a referendum and let us have a say. If you're so confident that we need it, then it shouldn't be hard
to win such a vote. We would accept the outcome and be thankful to have been able to vote. Democracy would be the big
winner.
