Home My WebLink AboutC2022-286 - 7/26/2022 - Approved FIRST AMENDMENT TO THE COASTAL BEND CENTER FOR INDEPENDING LIVING FY22 CBCIL HOME FUNDING AGREEMENT This First Amendment ("First Amendment") is made by and between the City of Corpus Christi ("City") and Coastal Bend Center for Independent Living, a Texas Non-Profit Corporation (herein referred to as "CBCIL" or "Subrecipient"). WHEREAS, the City and the Subrecipient executed an agreement dated December 21 , 2022, which was approved by the City Council for the purpose of utilizing the City's FY2022-2023 Home Investment Partnership Program ("HOME") Program funds (the "Agreement"); WHEREAS, the Subrecipient has timely requested an extension of the termination dates in order to complete the project contemplated under the Agreement; and WHEREAS, the parties desire to execute this First Amendment to express their mutual desire to reaffirm all terms, conditions, and covenants stated in the original Agreement and to extend the construction compliance and termination dates of the Agreement. Section 1. By execution of this instrument, the parties agree to reaffirm and continue in force all terms, conditions, and covenants stated in the original Agreement, as may be amended by the execution of this First Amendment. Section 2. Grant period, subsection (a), of the Agreement is amended by deleting the date"September 30, 2024" and inserting the date "September 30, 2025." Section 3. Article 2, Subsection 2.3, of the Agreement is amended by replacing Exhibit "A", with the Updated Project Budget attached hereto and incorporated herein by reference as Exhibit "A". Section 4. Article 2, Subsection 2.4, of the Agreement is amended by replacing Exhibit "B", with the Updated Timeline for Goals and Expenditures attached hereto and incorporated herein as Exhibit "B". Section 5. Article 2, Subsection 2.5, of the Agreement is amended by deleting the date "August 30, 2024" and inserting the date "August 30, 2025." Section 6. By execution of this First Amendment, the parties agree to revise and extend the rental assistance, rental deposit and utility deposit assistance program and termination dates stated in the original Agreement. All other terms, conditions, and covenants of the Agreement not changed by this First Amendment remain the FY22 HOME CBCIL 1"Amendment same and in full force and effect.
