033512 ORD - 11/19/2024
1 One -reading Ordinance canvassing returns and declaring the results of the General Election held on November 5, 2024 in the City of Corpus Christi for the purpose of electing the Mayor and eight Council Members; and of the Special Elections on that same date for the adoption of six propositions Whereas, the City Council of the City of Corpus Christi, by Ordinance No. 033425 on August 13, 2024, ordered and called a General Election for the election of Mayor and eight Council Members to be held on November 5, 2024; Whereas, Ordinance No. 033425 provided that a runoff election shall be held on December 14, 2024, if one is necessary; Whereas, by Ordinance No. 033432 on August 13, 2024, the City Council also ordered and called a Special Election concerning four propositions identified on the ballot as Proposition A, Proposition B, Proposition C, and Proposition D, for issuance of bonds in the aggregate principal amount not to exceed $175,000,000, with priority given to projects identified in each proposition; Whereas, by Ordinance No. 033434 on August 13, 2024, the City Council also ordered and called a Special Election concerning a proposition identified on the ballot as Proposition E, to repurpose the expiring Type A local sales and use tax of 1/8 of 1% (being 0.125 cents per $1) for arena improvements to provide funds for city-wide arterial and collector street projects, and city -owned recreational and community facilities within the Sports, Entertainment and Arts District and the Selena Auditorium, Convention Center, and Arena, for a term of 20 years; Whereas, by Ordinance No. 033433 on August 13, 2024, the City Council also ordered and called a Special Election concerning a proposition identified on the ballot as Proposition F, to repurpose the expiring Type A local sales and use tax of 1/8 of 1% (being 0.125 cents per $1) for seawall improvements to provide funds for infrastructure improvement projects including downtown seawall flood control structures and other city- wide flood control, drainage, stormwater, and coastal resiliency projects, for a term of 20 years; Whereas, the General Election and Special Elections described above are herein referred to as the "Elections"; Whereas, notice of said Elections was given as required by law; Whereas, said Elections were duly held on the 5th day of November, 2024, at which said contests and propositions were presented to all qualified voters as provided in the respective City ordinance calling the applicable Elections and in conformity with the election laws of the State of Texas; and Whereas, it is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by the Texas Open Meetings Act; and Whereas, the City Council has reviewed and investigated all matters pertaining to these Elections, and finds that the said Elections were in all respects lawful; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS THAT: Section 1. The City Council having convened on this the 19th day of November, 2024 to canvass the returns of the Elections held on November 5, 2024, and after canvassing the returns of these Elections, officially finds and determines that these Elections were duly ordered; proper notice of the Elections was given; proper election officers were duly appointed prior to these Elections; the Elections were duly held; the City has complied with the Federal Voting Rights Act, the Texas Election Code, and the City Charter; 033512 SCANNED 2 and due returns of the result of these Elections have been made and delivered, all in accordance with the law and the Ordinances calling the elections. Section 2. The City Council does officially find and declare the results of the General Election (Attachment A) to be as follows: Mayor Joshua Fraedrick 4,554 Isabel Araiza 11,058 Paulette Guajardo 46,759 Michael Hunter 33,966 John Calkusic 848 Anthem Powers 949 Council Member, At Large Rachel Caballero 18,048 Robert R. The results of the canvass of the Special Elections are declared to be: 3 City of Corpus Christi Proposition A (Streets) For 67,453 Against 31,542 City of Corpus Christi Proposition B (Parks and Recreation) For 61,143 Against 37,488 City of Corpus Christi Proposition C (Public Safety) For 73,150 Against 25,404 City of Corpus Christi Proposition D (Cultural Facilities) For 58,340 Against 38,742 City of Corpus Christi Proposition E (Streets — Arterial and Collector; and Recreational and Community Facilities) For 51,813 Against 43,715 City of Corpus Christi Proposition F (City -Wide Flood Control, Drainage and Coastal Resiliency) For 64,961 Against 31,023 Section 3. The City Council accepts and approves the returns for the General Election as received and canvassed, and declares that the following persons are declared elected and may qualify for the office indicated: Council Member at Large: Carolyn Vaughn Mark Scott Roland Barrera Council Member District Two: Sylvia Campos Council Member District Three: Eric Cantu Council Member District Five: Gil Hernandez The Council finds that the candidates who received the highest and second highest number of votes are hereby certified for placement in a runoff election as follows: Mayor: Paulette Guajardo Michael Hunter Council Member District One: Everett Roy Billy Lerma Council Member District Four: Kaylynn Paxson May Nardone Mendoza Section 4. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than $89,500,000 of 4 bonds and the levy and pledge of the tax in payment thereof as provided in Proposition A, the City Council hereby finds and determines that Proposition A carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition A and with law. Section 5. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than $37,650,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition B, the City Council hereby finds and determines that Proposition B carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition B and with law. Section 6. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than $45,000,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition C, the City Council hereby finds and determines that Proposition C carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition C and with law. Section 7. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR the authorization and issuance of not more than $2,850,000 of bonds and the levy and pledge of the tax in payment thereof as provided in Proposition D, the City Council hereby finds and determines that Proposition D carried at the Special Election and that the City Council is hereby accordingly authorized to issue the bonds and to levy the tax in accordance with the authority granted in Proposition D and with law. Section 8. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR Measure E, the City Council hereby finds and determines that Measure E carried at the Special Election and that the City Council is hereby accordingly authorized to levy the tax in accordance with the authority granted in Measure E and with law. Section 9. A MAJORITY of the resident, qualified voters of the City of Corpus Christi, Texas, voting in the Special Election, having voted FOR Measure F, the City Council hereby finds and determines that Measure F carried at the Special Election and that the City Council is hereby accordingly authorized to levy the tax in accordance with the authority granted in Measure F and with law. Section 10. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 11. This Ordinance shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 12. If any provision of this Ordinance or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Ordinance and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Ordinance would have been enacted without such invalid provision. Section 13. It is officially found, determined, and declared that the meeting at which this Ordinance is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Ordinance, was given, all as required by Chapter 551, as amended, Texas Government Code. Section 14. This Ordinance shall be in force and effect from and after its final passage and it is so ordained. 5 Section 15. Pursuant to Section 67.004(a) of the Texas Election Code, two members of the governing body constitute a quorum for canvassing the election results. Section 16. The necessity of making an official canvass of votes and declaring the results thereof immediately in order to meet the requirements of State Law and the City Charter, and the need for efficient and effective administration of the City's affairs, creates a public emergency requiring the suspension of the City Charter rule that no ordinance be passed finally on the date of its introduction but that such ordinance shall be read at two regular meetings of the City Council, and the Mayor having declared that such emergency exits, having requested the suspension of the City Charter rule that this ordinance be finally passed on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 19th day of November, 2024. 6 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, state law supersedes the Charter rule as to consideration and voting upon ordinances at two regular meetings: I/we, therefore, request that you suspend said Charter rule and pass this ordinance finally on the date it is introduced or at the present meeting of the City Council. TC Ayers Aquatic Center — Labonte Park — Sherrill Veterans Memorial Park — Greenwood Sports Complex — St. Andrews Park — Cole Park — Commodores Park - Peary Place Park — Bill Witt Park — Dimmit Pier Boat Ramp and in providing for the above public improvements, the City Council shall have the option to (i) utilize other funds available for such purposes and (ii) abandon such indicated public improvements that are reliant, in part, on external sources of funding that (for whatever reason) do not materialize or because unforeseen changes in fact or circumstance make the anticipated expenditure no longer wise or necessary (as determined by the City Council), and after making due provision for the improvements listed above or determining that the public improvement project will not proceed for a reason heretofore described, the City Council may, in its discretion, use any excess funds for designing, demolishing, constructing, renovating, improving, expanding, and equipping City parks and recreation facilities, and acquiring lands and rights -of -way necessary thereto or incidental therewith (but specifically excluding related City utility costs, which are the responsibility of the City's utility system);and shall the City Council be authorized to levy and pledge, and cause to be assessed and collected, within the limitations prescribed by law, annual ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and sinking fund to pay the bonds at maturity and to pay the costs of any credit agreements executed in connection with the bonds?" 13 CITY OF CORPUS CHRISTI PROPOSITION C PUBLIC SAFETY Shall the City Council of the City of Corpus Christi, Texas be authorized, in accordance with applicable law, to issue bonds of the City, in one or more series or issues and in the aggregate principal amount of $45,000,000 with such series or bonds, respectively, to mature serially or otherwise within not to exceed forty years from their date and to be sold at such prices and bear interest at such rates (whether fixed, floating, variable, or otherwise, but in no case at a rate that exceeds the maximum rate per annum authorized by applicable law at the time of any such issuance), as shall all be determined within the discretion of the City Council, for the purpose of making permanent public improvements or for other public purposes, to wit: designing, demolishing, constructing, renovating, improving, expanding, upgrading and equipping City public safety facilities, and acquiring lands and rights -of -way necessary thereto or incidental therewith (but specifically excluding related City utility costs, which are the responsibility of the City's utility system), with priority given to the following projects: — Corpus Christi Fire Station #8 - CITY OF CORPUS CHRISTI PROPOSITION D CULTURAL FACILITIES Shall the City Council of the City of Corpus Christi, Texas be authorized, in accordance with applicable law, to issue bonds of the City, in one or more series or issues and in the aggregate principal amount of $2,850,000 with such series or bonds, respectively, to mature serially or otherwise within not to exceed forty years from their date and to be sold at such prices and bear interest at such rates (whether fixed, floating, variable, or otherwise, but in no case at a rate that exceeds the maximum rate per annum authorized by applicable law at the time of any such issuance), as shall all be determined within the discretion of the City Council, for the purpose of making permanent public improvements or for other public purposes, to wit: designing, demolishing, constructing, renovating, 14 improving, expanding, upgrading and equipping City cultural facilities to benefit or promote cultural and social enrichment, and acquiring lands and rights -of -way necessary thereto or incidental therewith (but specifically excluding related City utility costs, which are the responsibility of the City's utility system), with priority given to the following projects: — Community/Senior Center Complex (including Dr. Clotilde P. Garcia Library) — Historical Houses in Heritage Park and in providing for the above public improvements, the City Council shall have the option to (i) utilize other funds available for such purposes and (ii) abandon such indicated public improvements that are reliant, in part, on external sources of funding that (for whatever reason) do not materialize or because unforeseen changes in fact or circumstance make the anticipated expenditure no longer wise or necessary (as determined by the City Council), and after making due provision for the improvements listed above or determining that the public improvement project will not proceed for a reason heretofore described, the City Council may, in its discretion, use any excess funds for designing, demolishing, constructing, renovating, improving, expanding, upgrading and equipping City cultural facilities to benefit or promote cultural and social enrichment, and acquiring lands and rights -of -way necessary thereto or incidental therewith (but specifically excluding related City utility costs, which are the responsibility of the City's utility system); and shall the City Council be authorized to levy and pledge, and cause to be assessed and collected, within the limitations prescribed by law, annual ad valorem taxes on all taxable property in the City sufficient to pay the annual interest and sinking fund to pay the bonds at maturity and to pay the costs of any credit agreements executed in connection with the bonds? CITY OF CORPUS CHRISTI MEASURE E STREETS - ARTERIAL AND COLLECTOR; AND COMMUNITY AND RECREATIONAL FACILITIES) Shall the City Council of Corpus Christi, Texas, be authorized to repurpose the expiring Type A sales and use tax of 1/8 of 1% (being 0.125 cents per $1) for arena improvements by the adoption of a Type B sales and use tax at the rate of 1/8 of 1% (being 0.125 cents per $1), with annual sales tax collections being allocable in the indicated percentages to be used for infrastructure improvement projects pertaining to City- wide arterial and collector streets to support new and expanded business enterprises (50%) and the city - owned recreational and community facilities within the Sports Entertainment and Arts District (to wit: Corpus Christi Museum of Science and History, the Art Museum of South Texas, the Texas State Museum of Asian Cultures and Education Center, the Harbor Playhouse, the Water Garden) and the Selena Auditorium, the Convention Center, and the Arena (50%), for a term of 20 years, to be administered by the Corpus Christi B Corporation under Chapter 505 of the Texas Local Government Code? CITY OF CORPUS CHRISTI MEASURE F CITY- WIDE FLOOD CONTROL, DRAINAGE AND COASTAL RESILIENCY) Shall the City Council of Corpus Christi, Texas, be authorized to repurpose the expiring Type A sales and use tax of 1/8 of 1% (being 0.125 cents per $1) for seawall improvements by the adoption of a Type B sales and use tax at the rate of 1/8 of 1% (being 0.125 cents per $ 1), with annual sales tax collections being used for infrastructure improvement projects including downtown seawall flood control structures and other City-wide flood control, drainage, stormwater, and coastal resiliency projects to support new and expanded business enterprises, for a term of 20 years, to be administered by the Corpus Christi B Corporation under Chapter 505 of the Texas Local Government Code?
