A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR
OF THE CITY OF CORPUS CHRISTI TO EXECUTE OWNER'S
CHANGE ORDER NUMBER 26, IN REFERENCE TO CITY OF
CORPUS CHRISTI, TEXAS SEWAGE TREATMENT PLANT AND
SEWER EXTENSIONS, AND DECLARING AN EMERGENCY.
GENCY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI:
SECTION 1: That the Mayor of said City of Corpus Christi be, and he is hereby

authorized and directed to execute Owner's Change Order Number 26 in reference to City of

Corpus Christi, Texas Sewage Treatment Plant and Sewer Extensions, a copy of which Change
Order is as follows, to -wit:

described in detail on the reverse side, and attachments and exhibits made a part hereof.

WHEREAS, it is desirable to make dhanges in the plans and specifications for this project:
THIS AGREEMENT WITNESSETH: In consideration of the mutual advantages gained, the Owner and
the Contractor agree to the changes, as shown herein and in the attached exhibits and data,
and the Owner agrees to pay the Contractor the amount of the increase in the contract price,
if any; and in the event of a decrease, the parties agree that the original contract be-
tween the Owner and the Contractor shall be modified to the extent herein indicated.
IN WITNESS WHEREOF, the Owner and the Contractor hereto have set their hands this the 29th
day of November, 1937.

Give complete detail description of change using revised plans, detail drawings, specifi-
cations, etc., sufficient to enable a careful checking. Attach extra sheets where necess-
ary.
By Chan:;e Order No. 14-A-12 the Contractor was authorized to do additional
work on Pump Station C. This work was necessitated by the failure of a certain influent
trunk line and the cost was estimated at $8000.00 which amount was deposited by the City
of Corpus Christi to the construction, and incorporated in the funds available for con-
struction. This additional work is now completed and it, is found_that the cost as com-
pleted exceeds the estimated cost by the sum of $2,955.87. This excess over the estimated
cost was due to the character of the, ground at the point where the above mentioned failure
occured. The soil at the elevation of minus 14 is'a sand very similar to quicksand and
exceedingly difficult to control and working conditions are very difficult. This work
was accomplished on a time and materials basis with no profit to the contractor. This
work is completed and the total cost is $10,955.87.
SECTION 2: The public importance of this Resolution creates a public emergency
and a public imperative necessity requiring the suspension of the Charter Rule providing
that no Ordinance or Resolution shall be passed finally on the date it is introduced, and
that such Ordinance or Resolution shall be read at three meetings of the City Council,
and that the Mayor having declared that such public emergency and imperative necessity
exists, and requests that said Charter Rule be suspended,.and that this Resolution take
effect and be in full force and effect from and after its.passage, and IT IS ACCORDINGLY
SO ORDAINED.

Gentlemen:
For the reasons set forth 'in the emergency clause of the foregoing Resolution, a
public emergency and an imperative public necessity exists for the suspension of the Charter
Rule or requirement that no,Ordinance or Resolution shall be passed finally on the date it is
introduced, and that such Ordinance or Resolution shall be read at three several meetings of
the City Council, I, therefore, hereby request that you suspend said,Charter Rule or require-
ment and pass this Resolution finally on the date it is introduced, or at the present meeting
of the City Council.
