HomeMy WebLinkAbout033716 RES - 08/12/20251 Resolution confirming compliance with federal rules and regulations including Civil Rights protections with acceptance of the Community Development Block Grant Regional Mitigation Program Projects (CDBG-MIT) administered by State of Texas General Land Office (GLO) and providing for designation of officers required for grant compliance WHEREAS, the City of Corpus Christi, in accordance with Section 109 of the Title I of the Housing and Community Development Act. (24 CFR 6); the Age Discrimination Act of 1975 (42 U.S.C. 6101.6107); and Section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) and for construction contracts greater than $10,000, must take actions to ensure that no person or group is denied benefits such as employment, training, housing, and contracts generated by the CDBG activity, on the basis of race, color, religion, sex, national origin, age, or disability; WHEREAS, the City of Corpus Christi, in consideration for the receipt and acceptance of federal funding for the grants, agrees to comply with all federal rules and regulations including those rules and regulations governing citizen participation and civil rights protections; WHEREAS, the City of Corpus Christi as subrecipient in accordance with Section 3 of the Housing and Urban Development Act of 1968, as amended, to the greatest extent possible, must provide training, economic, contracting and other economic opportunities to low and very low-income persons that provide economic opportunities; WHEREAS, the City of Corpus Christi, in accordance with Section 504 of the Rehabilitation Act of 1973, does not discriminate on the basis of disability and agrees to ensure that qualified individuals with disabilities have access to programs and activities that receive federal funds; WHEREAS, the regulations implementing Section 504 of the Rehabilitation Act of 1973 require at 49 CFR 27.13 that recipients designate at least one person to coordinate efforts to comply with Section 504 of the Rehabilitation Act; WHEREAS, the City of Corpus Christi, in accordance with Section 808(e)(5) of the Fair Housing Act (42 USC 3608(e)(5)) that requires HUD programs and activities be administered in a manner affirmatively to further the policies of the Fair Housing Act, conducts at least one activity during the contract period, to affirmatively further fair housing; WHEREAS, the City of Corpus Christi, in accordance with Section 104(1) of the Housing and Community Development Act, as amended, and State's certification requirements at 24 CFR 91.325(b)(6), must adopt an excessive force policy that prohibits the use of excessive force against non-violent civil rights demonstrations; and WHEREAS, the City of Corpus Christi will maintain written standards of conduct covering conflicts of interest and governing the actions of its employees engaged in the selection, award, and administration of contracts; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Council specifically finds that the foregoing statements included in the preamble of this resolution are true and correct and adopts such findings for all intents and purposes related to the authorization of this Resolution. 03371 SCANNED 2 SECTION 2. That the City of Corpus Christi has enacted the codes and policies referenced in Table 1 to address compliance with federal rules and regulations including Civil Rights protections as required with acceptance of the Community Development Block Grant Mitigation Program Projects (CDBG-MIT) grant. Table 1- Corresponding Corpus Christi Codes and Policies Federal Statute/ Executive Order Description City Ordinance/Policy Reference Title VI of the Civil Rights Act of 1964 Prohibits exclusion from participation, denied program benefits, or discrimination, based on race, color, national origin. Corpus Christi Code, Chapter 24 — Human Relations Section 24-21 Section 504 of the Rehabilitation Act of 1973, as amended Requires agencies to provide individuals with disabilities an equal opportunity to participate in their programs and benefit from their services. Corpus Christi Code, Chapter 24 — Human Relations Section 24-90 The Age Discrimination Act of 1975, as amended No person shall be excluded from participation, denied program benefits, or subjected to discrimination based on age. Corpus Christi Code, Chapter 24 — Human Relations Section 24-21 Americans with Disabilities Act (ADA) Legislation that prohibits discrimination and guarantees that people with disabilities have the same opportunities as everyone else Corpus Christi Code, Chapter 24 — Human Relations Section 24-94 Architectural Barriers Act of 1968 Requires that buildings and facilities designed, constructed, altered, or leased with certain federal funds after September 1969 must be accessible to and usable by persons with disabilities. Corpus Christi Code, Chapter 24 — Human Relations; Section 24-94 Housing and Community Development Act, as amended, and States certification requirements at 24 CFR 91.325(b)(6) Requires an excessive force policy that prohibits the use of excessive force against non-violent civil rights demonstrations; and a policy of enforcing applicable State and local laws against physically barring entrance to or exit from a facility or location which is the subject of such non-violent civil rights demonstrations within its jurisdiction. City's Police Department Policy # 506 SECTION 3. That the Director of the City department administering the CDBG-MIT grant or that Director's designee is designated as the Civil Rights Officer as required by the GLO- CDR Implementation Manual of the awarding agency of the State of Texas. SECTION 4. That the City Manager is delegated authority to designate a replacement Civil Rights Officer and any other officers necessary for grant compliance.
