HomeMy WebLinkAboutC2024-324 - 6/11/2024 - Approved FIRST AMENDMENT TO THE OPTION FOR SALE OF REAL PROPERTY This FIRST AMENDMENT TO THE OPTION FOR SALE OF REAL PROPERTY (the "First Amendment") is made and entered into effective upon the date of final execution by the parties (the "First Amendment Effective Date"), by and between Habitat for Humanity -Corpus Christi, Inc, a Texas Nonprofit Corporation exempt from federal taxation under Section 501(c)(3), Internal Revenue Code of 1986, ("Optionee"), and City of Corpus Christi, a Texas home-rule municipal corporation ("City"). WHEREAS, Lot 2, Block 9 of Patrick Webb subdivision cannot be reasonably developed due to the narrowness of the lot; and WHEREAS, Optionee will not be required to develop Lot 2, Block 9 of Patrick Webb subdivision. NOW, THEREFORE, for and in consideration of the mutual covenants set forth herein, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged and confessed, Optionee and City hereby agree to amend Section 2. Option Period as follows: Section 2. Option Period The option to purchase the property, hereinafter referred to as the "Option," shall commence upon the final execution of this contract and will expire on June 30, 2026, without notice to the Optionee. This option may only be exercised by Optionee after the construction of single- family dwellings on Lots 6, 7, 8, 11, and 12, Block 9, Patrick Webb Addition Subdivision, City of Corpus Christi, Nueces County, Texas, located at or near 2304, 2312, and 2324 Mary Street. This Amendment is effective upon the date of final execution by the parties. To the extent that the provisions of this Amendment conflict with any provisions of the Agreement and prior amendments, if any, the provisions of this Amendment shall prevail and govern for all purposes and in all respects.
