HomeMy WebLinkAbout033945 RES - 06/23/2026Resolution authorizing a three-year service agreement with Rotork Controls, Inc., of Rochester, New York, with an office in Houston, in an amount up to $509,352.00, for the purchase of five replacement actuators, preventative maintenance, repairs, and parts at various wastewater treatment plants (WWTP) for Corpus Christi Water, with FY 2026 funding of $169,800.00 from the Wastewater Fund. WHEREAS, replacement actuators, preventative maintenance, repair services, and parts are needed at five wastewater treatment plants, all items and services of which are critical in sustaining and ensuring Corpus Christi Water's operational reliability for service to the citizens and community; WHEREAS, State law provides that such procurements, as described above, are subject to statutory procurement requirements, including competitive bids, unless an exemption applies; WHEREAS, there is a statutory exemption for this procurement in Texas Local Government Code, Sec. 252.022(a)(2), as this purchase is necessary to preserve or protect the public health or safety of the City's residents; WHEREAS, there is also a statutory exemption for this procurement in Texas Local Government Code, Sec. 252.022(a)(7)(A), as this purchase is available from only one source due to patents, copyrights, secret processes, or natural monopolies; and WHEREAS, there is also a statutory exemption for this procurement in Texas Local Government Code, Sec. 252.022(a)(7)(D), as this purchase includes captive replacement parts or components for equipment; therefore, Be it resolved by the City Council of the City of Corpus Christi, Texas: Section 1. The City Council specifically finds that the foregoing statements included in the preamble of this resolution are true and correct and adopts such findings for all intents and purposes related to the authorization of this procurement. Section 1. The City Manager, or his designee, is authorized to execute all documents necessary to secure a three-year service agreement with Rotork Controls, Inc., for goods and services to be provided in an amount up to $509,352.00, with FY 2026 funding of $169,800.00 from the Wastewater Fund.
