pertaining to Special Condition 5.B., Certificate of Adjudication No. 21-3214. related to
freshwater inflows and releases associated with the City's reservoir system, and Initiate Review
of Potential amendments to the Agreed Order
WHEREAS, the Agreed Order establishes operational procedures pertaining to Special Condition 5.B., Certificate of
Adjudication No. 21-3214. related to freshwater inflows and releases associated with the City's reservoir system;
WHEREAS, current drought conditions, reservoir levels, regional water demands, and changing water -supply conditions
warrant a careful evaluation of whether temporary relief may be available and appropriate under the existing regulatory
framework;
WHEREAS, City staff have conducted due diligence regarding a potential temporary application to the Texas Commission
on Environmental Quality (TCEQ);
WHEREAS, any temporary relief granted by the Texas Commission on Environmental Quality is anticipated to be limited
in duration and would not resolve the need for a longer -term review of the existing Agreed Order;
WHEREAS, the City Council desires to formally express its support for staff's ongoing efforts to evaluate and pursue
temporary regulatory relief while continuing to protect the Nueces Estuary and comply with applicable law; and
WHEREAS, the City Council further finds that the Agreed Order should be reviewed in light of new water supply
infrastructure, hydrological conditions, water -supply investments, operational realities, and regional needs to maximize the
amount of stored water for the City of Corpus Christi in our reservoir system.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
1. The City Council supports City staffs efforts to evaluate and pursue an application to the TCEQ related to a temporary
suspension of Special Condition 5.B requirements under the aforementioned Agreed Order.
2. Following completion of the necessary technical, legal, operational and review, City staff are authorized to proceed with
submission of the application to the TCEQ, subject to all applicable legal requirements and required approvals.
3. City staff and its technical experts will initiate the process necessary to evaluate and pursue appropriate permanent
amendments to the Agreed Order, including the development of technical, scientific, legal, operational, and environmental
analyses necessary.
4. City staff will provide periodic updates to the City Council regarding the status of the temporary application, discussions
with regional partners, and the process for evaluating and pursuing potential amendments to the Agreed Order.
