McDonald called the meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Motion by Barnard, seconded by Maldonado and passed that the absence of Commissioners Swantner and Roberts be excused for cause. Mayor McDonald announced the purpose of the special meeting was to hold a joint hearing with the Zoning & Planning Commission on a zoning application and explained the procedure to be followed. Mayor McDonald announced the public hearing to be held jointly with the Zoning & Planning Commission on the application of Woodlawn Properties, for a change of zoning from "R -1B" One -family Dwelling District and "R-2" Two-family Dwelling District to "B-4" General Business District on the Southwest 250' of Lot 4, all of Lots 5, 6, 7, 8, 9, 10 and 11, and the Southwest portions of Lots 12, 13, 14 and 15, Woodlawn Addition #1; being that property located at the intersection of Up River Road and Highway 9, beginning at a point 783.97° Northwest of the South- west corner of the intersection of Up River Road and Old Robstown Road, extending in a Northwesterly direction and including all of that property fronting on Up River Road and Highway 9 between the said point and the intersecting point of High- way 9 and Elmore Drive; this property is adjacent on the Southwest to Saxet Heights No. 2. William Anderson, Director of Planning, located the property on the map and pointed out the zoning and land use of the area. Joseph Hans, architect, representing Woodlawn Properties, explained the plans for the proposed development, stating that approximately $800,000 will be spent in such development; that a large portion of the area to be developed has already been spoken for; that the development will give employment to 75 to 100 people; and that there will be a 2k to 1 parking ratio. Phillips, 3756 MacLeod; A. J. Cloud, 3764 MacLeod; and Dr. Leonard J. Svajda, 3749 Highway 9, who also felt it would benefit the area. The following appeared in opposition on the basis of certain objection- able uses permitted in the "B-4" zoning detrimental to the surrounding property uses, the number of vacant tracts zoned for business, and the proximity of the existing shopping center and various businesses in the area which can more than adequately serve the area: Gus Heinemann, spokesman, representing Woodlawn Presbyterian Church, comprised of W. R. Hollinger; S. B. Burke, Jr.; C. H. Black; and Olive Bush. Othem objecting were Frank Moore; Will Fry; Julian Gray; and Mrs. Cox. In rebuttal, Joseph Hans stated that alcoholic beverages are not to be consumed on the premises. Mayor McDonald declared the hearing closed. Mayor McDonald commended the Zoning & Planning Commission for the work done during the past two years. Mr. Wenzel requested that action be taken as quickly as possible in the matter of the site requested by the Corpus Christi Arts Council. The Zoning & Planning Commission retired to the Committee Room to con- sider the foregoing application, and Mayor McDonald recessed the Council meeting for a brief period. After a short recess, Mayor McDonald reconvened the meeting, and received the recommendation of the Zoning & Planning Commission that the request by Woodlawn Properties for "B-4" General Business District be denied but that "B-3" Shopping Center District be approved subject to construction of a 6 -foot solid fence where this property abuts private property and that the required plot plan under "B-3" Shopping Center District regulations may be amended with the approval of the Zoning & Planning Commission. Motion by Barnard, seconded by Young and passed that the recommendation of the Zoning & Planning Commission be concurred in verbatim with the further City of Corpus Christi, Teams Special Council Meeting February 18, 1963 Page 3 conditions that parking ratio be in accordance with Article 22 of the Zoning Ordinance, and that the owner file a covenant to run with the property for 25 years that alcoholic beverages will not be consumed on premises, and that a satisfactory traffic pattern be devised meeting the requirements of the Traffic Engineering Department. There being no further business to case before the Council, the special meeting was adjourned.
