Wallace, Jr. Mayor James L. Barnard called the meeting to order. The Invocation was given by the Reverend Doyle Holmes, Assistant Pastor, Second Baptist Church. Mayor Barnard announced he would entertain a motion for the adjourn- ment of the special meeting of April 16, 1963. Motion by de Leon, seconded by Wallace and passed that the special meeting of April 16, 1963, at 7:30 p.m., now in recess, be adjourned. City Secretary T. Ray Kring called the roll of those in attendance, and Mayoi Barnard declared the regular meeting of April 17, 1963, competant to proceed. Mayor Barnard recognized Phil Ridgeway who introduced Jim Davis and Lloyd Sessions of the Board of Directors of the C.C. Tennis Association, who in turn presented a membership and copy of the Official Tennis Magazine to each member of the Council, and two gavels made of native mesquite in the shop of one of the Tennis Association members and inscribed to Mayor Barnard and to Mayor Pro Tem Young on behalf of the C.C. Tennis Association in appreciation of the assistance and cooperation the Council has given to the Association in fur- thering its aims and purposes. Mayor Barnard welcomed and introduced Mr. Jorge Alcocer, C., Mexican Consul, and -exchanged greetings and assurances of a continuation of the spirit of goodwill and cooperation that has been established between this City and Mexico. Mayor Barnard recognized and introduced Ricky Donnaho, a student at Mary Carroll High School, who has been chosen to represent the Texas Future Farmers of America as one of fifteen representatives of the Future Farmers of America in a 21 -day, informative, educational, and goodwill tour of several European countries in connection with the People -to -People Program between the • City of Corpus Christi, Texas Regular Council Meeting April 17, 1963 Page 2 United States and Europe. Mayor Barnard said that Ricky Will also be officially representing the City of Corpus Christi and will carry letters of greeting from the Mayor and City Council to each of the Mayors of the cities he will be visit- ing, and wished him a very successful and enjoyable trip. In acknowledging the Mayor's remarks and introduction, Ricky expressed his pride at having been chosen for these honors and his hope that the purposes of the mission will be accomplished for an informed und..rstanding and goodwill relationship between the people of America and Europe. Ricky was accompanied by Mr. Jim Summers, Assistant Principal of Mary Carroll High School. Mayor Barnard read and signed a proclamation proclaiming Wednesday, May 1, 1963, as LOYALTY DAY in Corpus Christi, and urging every member of the community to join in a demonstration of undivided allegiance to the government of the United States and the ideals Which it defends and preserves. The proc- lamation was accepted by Charles Clark, Commander of the Nueces County Council of Veterans of Foreign Wars. Mayor Barnard called for the opening of bids, and City Manager Whitney explained that bids to be received had been advertised for in compliance with the City Charter provision that the City Manager shall, immediately after each biennial election of the Mayor and Commissioners, advertise for bids for City Depository to be opened and read by City Council and City Manager and awarded at the next regular meeting. The bid of Corpus Christi State National Bank, the only bid received for City Depository, was opened and read, and tabled for 48 hours as required by the City Charter, and referred to the City Manager for study and recommenda- tion. Mayor Barnard announced that relative to the pending zoning applica- tion of Mrs. Dorothy Wilkie that the recommendation of the Zoning & Planning Commission was that the request for "B-1" zoning on Lots 41 and 42, Block 817, Port Aransas Cliffs, be denied, but that in lieu a Special Permit for a needle- craft center and the sale of knitting and needlecraft supplies under Article 25, Section 25-4, Subsection (12) of the Zoning Ordinance, be approved subject to the following conditions: (1) That the first floor area of the existing build- ing be used for a needlecraft center and the sale of knitting and needlecraft supplies only; (2) That the second floor area of the existing building be used • • City of Corpus Christi, Texas Regular Council Meeting April 17, 1963 Page 3 in compliance with those use regulations of the "AB" Professional Office Dis- trict; (3) That outdoor advertising be restricted to one circular sign two (2) feet in diameter attached flat to the building and that it not protrude above the eave line of the building; (4) That one lighted display window be permitted in the south portion of the front wall of the existing building; (5) That off- street parking be provided as required for a retail establishment under Article 22 of the Zoning Ordinances (6) That all other regulations of the "AB" Profes- sional Office District be complied with. Motion by de Leon, seconded by Maldonado and passed that the recom- mendation of the Zoning & Planning Commission be concurred in, and the request for "B-1" zoning on Lots 41 and 42, Block 817, Port Aransas Cliffs, be denied, but that in lieu a special permit for a needlecraft center and the sale of knitting and needlecraft supplies be granted subject to the following condi- tions: (1) That the first floor area of the existing building be used for a needlecraft center and the sale of knitting and needlecraft supplies only; (2) That the second floor area of the existing building be used in compliance with those use regulations of the "AB" Professional Office District; (3) That outdoor advertising be restricted to one circular sign 2, in diameter attached flat to the building and that it not protrude above the eave line of the build- ing; (4) That one lighted display window be permitted in the south portion of the front wall of the existing building; (5) That off-street parking be pro- vided as required for a retail establishment under Article 22 of the Zoning Ordinance; and (6) That all other regulations of the "AB" Professional Office District be complied with. Mayor Barnard announced the Council would hear any pertinent informa- tion relative to the public hearing recessed from April 10th on the application of W.C.B. Construction Co. for a change of zoning from "R -1B" One -family Dwell- ing District to "I-2" Light Industrial District on a 10 -acre tract of land out of Lot 4, Section 9, Bohemian Colony Lands, located between Kostoryz and Weber on Saratoga, about 1225' NW of the intersection of Saratoga and Weber. City Manager Whitney presented and read letters of protest from the following; Mr. & Mrs. H. R. Harrod, owners of a 10 -acre tract between Kostoryz and Weber; John D. and George S, Hawn, Hawn Bros., owners of 80 --acres across Saratoga from the subject property; and Del Starr Realty Co., Inc., developers • • City of Corpus Christi, Texas Regular Council Meeting April 17, 1963 Page 4 of the residential area south of Lexington Blvd. known as Schanen Estates. Milton Walton, attorney, and the applicant, Mr. Burnett, spoke in support of the request on the basis that the existing nonconforming industrial use of the property will continue since it vas so used prior to its recent an- nexation; that it seems likely that in future development of the area, Saratoga Blvd. will become a major traffic artery unsuitable for abutting reeidencee; that there are other similar light industrial nonconforming uses in the area; and that the applicant is willing to agree to provide suitable fencing or plant- ing for screening purposes at such time as the area becomes developed. City Manager Whitney displayed large aerial photo maps of the area and pointed out various properties and land uses referred to during the hear- ing. Mayor Barnard declared the hearing closed. Motion by Young, seconded by Blackmon and passed that the recommenda- tion of the Zoning & Planning Commission be concurred in, and the change of zoning from "R -1B" to "1-2" Light Industrial District on the 10 -acre tract of land out of Lot 4, Section 9, Bohemian Colony Lands, described in the appli- cation, be granted. Mayor Barnard asked for a motion relative to the pending application of Mr. & Mrs. Eusebio Deases, Jr. for a change of zoning from "R -1B" to "B-1" on Lot 11, Block A, Maretta Terrace, on which public hearing was held March 27, 1963, and briefly identified the property, the proposed use, and the recommenda- tion of the Zoning & Planning Commission. Motion by de Leon, seconded by Young and passed that the recommenda- tion of the Zoning & Planning Commission be concurred in, and the change in zoning be denied. Mayor Barnard asked for a motion relative to the pending application of -J. M. Benkendorfer for a change of zoning from "B-5" and "R -1B" to "I-2" on Lot 5, Block 1, Alfred Barthlome°s Acre Tracts, on which public hearing vas held March 27, 1963, and briefly identified the property, the proposed use, and the recommendation of the Zoning & Planning Commission. Motion by Wallace, seconded by Maldonado and passed that the recom- mendation of the Zoning & Planning Commission be concurred in, and the request for "I-2" be denied but that a special permit for a bottling plant be approved • • City of Corpus Christi, Texas Regular Council Meeting April 17, 1963 Page 5 subject to the following conditions: (1) That the management comply with all sanitary rules of the City -County Health Dept.; (2) That the property be main- tained in a manner acceptable to the City -County Health Dept.; and (3) That parking and off-streetloading requirements be in compliance with the regulations of the "1-2" District. Mayor Barnard asked for a motion relative to the pending application of Arturo Mendoza for a change of zoning from "R-1B".to "B-4" on Lot 17, Block 6, El Rey Addition, on which public hearing Was held March 27, 1963, and brief- ly identified the property, the proposed use, and the recommendation of the Zoning & Planning Commission. Motion by Roberts, seconded by Young and passed that the change of zoning be denied but in lieu a special permit be granted for the operation of a body repair and paint shop for automobiles on Lot 17, Block 6, El Rey Addi- tion. Mayor Barnard asked for a motion relative to the pending portion of the application of W. J. Kosarek, Rudolph Polasek, Modern Homes Supply Co.,Inc., Joseph Muras, Edward Quaile, Marian Hall McArdle and John A. Wailer for change of zoning from "R -1B" and "R-2" to "B-4." on Lots 1, 2, & 24, Block 3; Lots 1, 2 & 24, Block 4; Lots 1, 2 & 24, Block 5; Lots 1, 24 & South 30' of Lot 23, Block 6; Lots 1, 24 & South 30° of Lots 2 & 23, Block 7, of Lexington Estates; and briefly identified the property on which public hearing was held March 27, 1963, and the recommendation of the Zoning & Planning Commission. Motion by Young, seconded by de Leon and passed that the recommenda- tion of the Zoning & Planning Commission be concurred in, and the request for "B-4" zoning be denied, but that the zoning on Lots 1 & 24, Block 3, Lots 1 & 24, Block 4, Lots 1 & 24, Block 5, and Lots 1, 24 & the South 30° of Lot 23, Block 6, Lexington Estates, be changed to "AB" Professional Office District, and the zoning on Lots 1, 24 & the South 30' of Lot 23, Block 7, Lexington Estates, be changed to "B-1" Neighborhood Business D1 trict. Mayor Barnard called for the City Manager's Reports. Motion by Maldonado, seconded by Roberts and passed that the City Manager's Reports be accepted, and the recommendations and requests approved and granted as follows: a. That authority to advertise for bids to be received on May 1, 1963, • • City of Corpus Christi, Texas Regular Council Meeting April 17, 1963 Page 6 for estimated 12 -months' supplies of the following items be granted: (1) Com- mercial oxygen and Acetylene for Garage, Shops, and Utilities; (2) Pipeline Enamel and Pipeline Felt for coating gas lines; (3) Flashlight Batteries for all departments; and (4) Regular and Premium Gasoline, Diesel Fuel, Kerosene, and Lubricating Oils; b. That the sum of $360.00 be appropriated for the purchase of a certain small tract of land, containing 599.47 sq. ft. out of Block 20, J. C. Russell Farm Blocks, on Navigation Boulevard as part of the acquisition of right-of-way for the Savage Lane -Whelan Drive Street Project; c. That acceptance and final payment of Estimate #2 in the amount of $6,751.76 to T. H. Lee, contractor, for construction of Section 6, Unit V, Westside Sewer System, be approved. ORDINANCE NO. 6871 AUTHORIZING EMINENT DOMAIN PROCEEDINGS BY THE CITY OF CORPUS CHRISTI TO CON- DEMN JrE. TITLE TO CERTAIN LOTS OR PLACES OF LAND LOCATED IN NUECES COUNTY, TEXAS, DESCRIBING SAID PROPERTIES, IDENTIFYING THE RECORD TITLE OWNERS, SAID CONDEMNATIONS BEING NECESSARY FOR PUBLIC STREET PURPOSES AS A PART OF THE CROSSTOWN EXPRESSWAY WITHIN THE CORPORATE LIMPTS OF TRF CITY OF CORPUS CHRISTI; DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS TO CARRY OUT THE INTENTION OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. ORDINANCE NO. 6872 LEVYING, ASSESSING AND RG -ASSESSING PROPERTY AND THE VARIOUS OWNERS THEREOF FOR THE PAYMENT OF A PART OF THE COST OF IMPROVING AND PAVING PORTIONS OF THE FOLLOWING STREETS AND PORTIONS THEREOF IN THE CITY OF CORPUS CHRISTI, TEXAS, TO WIT: LUM, FmFSA, CHIPPEWA, ELEANOR, RUTH, FRANCESCA AND KENWOOD DRIVE; PRO- VIDING FOR THE TIME WHEN SUCH ASSESSMENTS BECOME DUE AND PAYABLE, THE RATE OF INTEREST AND FIXING A CHARGE AND LIEN AGAINST SAID PROPERTY AND MAKING SAID CHARGE A PERSONAL LIABILITY OF THE PROPERTY OWNERS OWNING PROPERTY ABUTTING ON SAID STREETS, AND PROVIDING FOR THE COLLECTION THEREOF; AND DECLARING AN EMER- GENCY. AND 6:00 P.M., ON TSE NORTH SIDE OF AYERS STREET BETWEEN OCEAN DRIVE AND BALDWIN BOULEVARD BETWEEN THE HOURS OF 4:00 P.M. AND 600 P.M. Mayor Barnard called for petitions or information from the audience on matters not scheduled on the agenda. Mr. Alien Williford, president of C.C. Symphony Orchestra Society, invited the Council and their wives to be guests of the Society at its Pops Concert on Friday, April 19th, at 8 p.m., in the Coliseum. Mrs. Dora Cravens, president of the Corpus Christi Museum, presented and read a letter to the Council requesting permission for the C.C. Museum to locate its new Museum building on a 23 -acre tract of City property bordered by Alameda Street, Parade Drive, Cullen School, and the Municipal Golf Course, under the same terms given the Council of Garden Clubs for their building site on South Staples, in the hope and expectation of the future development of the 23 -acres as a Nature Center to include a Planetarium, Acquarium, Arboretum, Nature Trails and other similar projects, and pledging the cooperation of the Museum in the planning of such a Center. She added that the Museum is anxious to begin its fund-raising drive for the proposed new building. Mr. Albert Heine, Director of the Museum, presented a land use study, including a proposed sketch, of the 23 -acres referred to; explained the pro- posed layout that has been visualized; pointed out the advantages and possi- bilities of the proposed use of the land, details of which would be worked out by a landscape architect if approved; and emphasized the enthusiastic interest the Museum°s'Long Range Planning Committee has received from the Marine Biolog- ical Dept. of the university of Corpus Christi, the Council of Garden Clubs, the Association for Childhood Education, and from organized Corpus Christi ed- ucators. • • City of Corpus Christi, Texas Regular Council Meeting April 17, 1963 Page 10 The following spoke in support of the foregoing request and offered their cooperation: Sam Story, Chairman of Long Range Planning Committee of C.C. Museum, and Mrs. Joanne Thompson; Mrs. Reid Cochran, president of League of Garden Clubs; and Mrs. Virginia Hogan, president of Association for Child- hood Education. Motion by Roberts, seconded by Young and passed that the Park Board be requested to review its previous recommendation for the sale of the 23 acres of park land on Alameda Street in the light of the new information, and that the Park Board be requested to study the request of the Corpus Christi Museum and make further recommendation to the City Council. Mayor Barnard asked Commissioner Maldonado, as Sub -committee of the Council, to assist the Park Board in this matter and report to the Council as soon as possible. Mrs. Levi Xatterne, representing several Flour Bluff residents, re- quested that a gas line be provided by the City down Glen Oak to Laguna Shores Drive to serve the residents in this area. City Manager Whitney explained the City's policy for the extension of gas lines, and following a short discussion of the problem, the matter was referred to the City Manager for investigation. City Manager Whitney presented the application of Nueces Tile Sales, Inc. for en Interim Building Permit, and the recommendation of the Zoning & Planning Commission for its approval. Motion by Blackmon, seconded by de Leon and passed that the follow- ing Interim Building Permit under Article 31 of the Zoning Ordinance be approved: #62-44, Nueces Tile Sales, Inc., for an 18' x 30' addition to existing warehouse on lot, for tile storage & wholesale house, on SW of Tract "0", Lot 16, Lokey Subdivision, at 6018 South Staples St. Mayor Barnard explained the need for assistance in planning and carry- ing out the City's Annual Fourth of .hely Parade and Celebration, and called a meeting of all those interested on April 19th, at 5 p.m., in the Council Chamber of the City Hall. There being no further business to come before the Council, the meet- ing was adjourned.
