Barnard called the meeting to order. The Invocation. was given by the Reverend George Fehl, Pastor of Trinity Lutheran Church. City Secretary T. Ray Kring called the roll of those in attendance. Motion by de Leon, seconded by Maldonado and passed that the minutes of the regular meeting of April 24, 1963, be approved as furnished to the Council. Mayor Barnard, welcomed and greeted Sister Teressa Ann and the 8th Grade students of the Cathedral School who were attending the meeting. Mayor Barnard recognized Mr. Sheridan C. Lexis, president of the Boys' Club of Corpus Christi, who read an invitation to the Council to be present at 10 a.m., Thursday, May 2, 1963, at a 10 -minute groundbreaking cere- mony for the construction of a heated swimming pool on property recently ac- quired by the Boys' Club just West of Crockett School; expressed appreciation for the interest and cooperation of the Council in furthering the Boys' Club activities; and assurance of the ultimate finishing of the entire development of the property as the finest Boys' Club in Texas. Mayor Barnard explained that he and the Mayor Pro Tem would be at Harbor Island greeting the Captain of the "Lexington" scheduled to arrive at the same time, but that he hoped other members of the Council would be able to accept the invitation. Mayor Barnard read, signed, and presented proclamations relative to the following: BUDDY POPPY DAIS, May 23, 24 and 25, 1963, in support of the annual sale of Buddy Poppies by the Veterans of Foreign Wars to "Honor the Dead by Helping the Living" in gratitude to the men of this country who have risked their lives in defense of the freedoms which we continue to enjoy as American citizens; and NATIONAL MUSIC WEEx, May 5-12, 1963, sponsored by the National • • City of Corpus Christi, Texas Regular Council Meeting May 1, 1963 Page 2 Federation of Music Clubs, with the theme, "Let the World Rejoice with Music;" accepted by Mrs. Henry 0. Schlenk, District Chairman of National Music Week, Miss Geneva Jones, Mrs. F. S. Sullivan, and Mrs. Ben Christian, presidents of three local music clubs. Mayor Barnard announced the Council would next consider appointments to boards and committees. Motion by Blackmon, seconded by Young and passed that the following be nominated as the Board of Equalization for the ensuing year: Mr. Sol Green, Mr. Homer Mann, and Mr. Bill Read. Motion by Maldonado, seconded by Roberts and passed that nominations cease, and that Mr. Sol Green, Mr. Homer Mann, and Mr. Bill Read be appointed as the Board of Equalization for the ensuing year by acclamation, Mayor Barnard presented Certificates of Appointment to each of the foregoing. In accordance with the Charter provision, Mayor Barnard nominated 0. E. Cannon and Mre. Jerry Jackson to serve as Corporation Court Judge and Corporation Court Clerk, respectively, for the ensuing 2 -year term. Motion by Wallace, seconded by de Leon and unanimously passed that the Honorable 0. E. Cannon and Mrs. Jerry Jackson be reappointed as Corporation Court Judge and Corporation Court Clerk, respectively, for the ensuing 2 -year term. Mayor Barnard announced the opening of bids. Bids were opened and read on an estimated 12 -months° supply, consist- ing of 20,736 Heavy -Duty Flashlight Batteries, Size "D", from the following: Alamo Iron Works; Auto Center; Fred Collins Supply, Inc.; C. C. Hardware; Gulf Hardware & Supply; Gunderland Marine & Industrial Supplies; Modern Electronics; Norvell-Wilder; Nunn Electric Supply; SAMSCO; Superior Iron Works; Tr pical Sup- ply; and Wallace Co. Bids were opened and read on an estimated 12 -months° supply of Pipe Line Primer, Enamel & Felt from the following: Pipe Line Service Corp.; and Ronson -Richards Co. of Texas, Inc. Bids were opened and read on an estimated 12 -months° supply of 5 lots of Fuel, Oil & Grease, consisting of 636,000 gals. Regular Gasoline, 23,000 gals Premium Gasoline, 66,000 gals, Diesel Fuel, 24,834 glas. Kerosene, and 10 items City of Corpus Christi, Texas Regular Council Meeting May 1, 1963 Page 3 of Enginer 011 Detergent, Chassis Grease, Transmission Fluid, Gear Lubricant, and Hydraulic Oil, from the following: Ada Oil Co.; Benefield's; Crystal Petro. Co.; Gulf Oil Corp.; Humble 011 & Refg. Co.; Key Petro.Co.; Mobile Oil co., Cook Osage Oil Co.; Texaco, Inc.; Supetco; and Texas Star 011 Co. Bids were opened and read on an estimated 12 -months' supply of large and small syl. of Oxygen and Acetylene from the following: Big Three Welding Equipment; Crane Welding Supply; and Welder's E.uipment Co. Bids were opened and read on an estimated 12 -months' supply of Fire Hose from the following: Alamo Iron Works; American La France; Blaze Guard Mfg.; Norvell-Wilder; and SAMSCO. The foregoing bids were all tabled for 48 hours as required by the City Charter, and referred to the City Manager for tabulation and recommenda- tion. Mayor Barnard recognized Mr. Briscoe King, Mr. Bob Finke, and Mr. Roy Olsen, members of the Red Carpet Committee of the Buccaneer Commission, who presented the Mayor with the official white jacket with the red Buccaneer Com- mission shield on the left breast pocket, his name pin as Mayor of the City of Corpus Christi pinned just above it, and. the narrow red bow tie, which is the official costume of the Commission. Mayor Barnard put on the jacket and an- nounced he would wear it during Buccaneer Days ceremonies which begin May 2, 1963. Mayor Barnard called for the City Manager's Reports. Motion by Roberts, seconded by Young and passed that the City Ma.nager's Reports be accepted, and the recommendations and requests be approved and grant- ed, as follows: a. That a franchise to Pharaoh Enterprises to construct and operate an effluent line across public property for watering the golf course, on a five- year basis, be approved; b. That acceptance and final payment of Estimate #7 in the amount of $19,997.65 to T. H. Lee for construction of Section 5 of Unit V of the Westside Sewer System, be approved; c. That acceptance and final payment of Estimate #1 in the amount od $12,000 to Fowco Construction Co. for the completion of the South Beach Sand Fill project, be approved; • • City of Corpus Christi, Texas Regular Council Meeting May 1, 1963 Page 4 d. That the recommendation of the Park Board to renew the monthly use privilege agreement with Harry Stuth, Jr. for use of a slip at the Peoples Street T -Head for the selling and renting of sail boats and related articles be approved; e. That authority to advertise for bids to be received on May 15, 1963, on the following items be granted; Steel Pipe for Warehouse Stock; Sewer Tile & Fittings for Warehouse Stock; Mechanical Joint Gate Valves for Warehouse Stock; Brass Service Fittings for Warehouse Stock; Anodes for Warehouse Stock; Fire Hydrants for Warehouse Stock; and Traffic Signal Equipment for Traffic Engineering; f. That a 5 -year revocable lease to C. C. Mobile Homes, Inc. of a City -owned tract of land on Leopard Street, just West of the Savage Lane rail- road overpass, for the purpose of operating a mobile homes sales center, be approved; g. That the date of May 22, 1963, during the regular meeting, be set for public hearing on the zoning application of Mrs. Hilda Pompa. Celso Moreno, on behalf of the Pastor and parishioners of the Holy Family Catholic Church, presented a petition for the City to exercise its power of eminent domain and condemn such property as is necessary to permit and allow pedestrian and vehicular ingress and egress on Soledad and Nagoles Streets be- tween McArthur and Sarita Streets; explained with diagrams the existing traffic patterns and congestion in the area of the Church and the need for the through flow of traffic from Port Avenue to the Church, particularly in view of the com- pletion of the enlargement of the Church building to accommodate the expanding membership from both the San Diego and Casa Blanca Additions; and stressed the existing dangers in event of a fire in the area during the 20 -minute periods between masses on Sunday. (Petition #3 in File) The foregoing petition was received and referred to the City Manager for recommendation by the Traffic Safety Advisory Board and the City Manager at least by budget time. Mayor Barnard declared the meeting in recess, for the purpose of dis- cussing items of a proposed contract with the San Patricio Water District, and announced the Council would convene at 4 p.m. for a special meeting to conduct public hearings on 4 zoning cases. • City of Corpus Christi, Texas Regular Council Meeting May 1, 1963 Page 5 The regular meeting was reconvened following the adjournment of the special meeting; and it was noted that all members of the Council, the City Manager, City Attorney, and City Secretary were all present. Mayor Barnard asked if the language of the proposed contract for the sale of water to the San Patricio Municipal Water District was now agreeable to both parties. Commissioner Roberts reported for the Sub -committee of the Council with respect to the final compromise made in regard to a main point of difference, which was to insert the words "except as to cities, towns and vil- lages" at the beginning of Section 11, relating to restrictions on resale, and at the beginning of the last sentence of this same section, the effect of which being to forbid the resale of untreated water by any customer of San Patricio Water District, with these exceptions, without prior written consent of the City of Corpus Christi. City Manager Whitney reported that he felt it was a reason- able compromise, and much better than the proposed revision submitted by the San Patricio Water District. There followed considerable discussion, during which Commissioner Blackmon stated that he felt the City had not been given enough time to fully evaluate the terms of the contract for a 30 -year period and was concerned with the possibility that the contract might be changing a permissive use of water over which the City now has control into a provision that could be harmful to the City, particularly in the event of a future water shortage with the necessity for rationing. Assistant City Manager Townsend was concerned with the lack of provisions in the contract relating to the treatment of raw water by San Patricio Water District or any customer of that Water Dis- trict, and the resulting change in priority of use and financial return to the City. Mayor Barnard said he would entertain any motion to amend the contract as now presented at this time. Motion by Blackmon, seconded by de Leon that the proposed contract just presented for the sale of water to San Patricio Water District be amended by restoring Section 11 as it was before the negotiations while this regular meeting was in recess, which forbid the resale of water without the written consent of the City of Corpus Christi, On vote, the motion failed, three "Ayes" to four "Nays". • City of Corpus Christi, Texas Regular Council Meeting May 1, 1963 Page 6 ORDINANCE N0. 6892 RECEIVING AND ACCEPTING THE CONSTRUCTION OF SECTION 5 OF UNIT V OF THE WEST - SIDE SEWER SYSTEM, PROJECT N0. 250-61-24, AS PERFORMED BY THE CONTRACTOR, T. Mayor Barnard requested that the minutes reflect that the request of the Municipal Industrial Commission, made at the Monday Work Shop Session, that the City provide a quantity of brochures for the promotion of industry in the area and look into the matter of the production of a movie in relation to in- dustry, were referred to the City Manager for investigation and recommendation. Paul Vogler complained of the conditions of the building and staffing of the Well -Child & Maternity Clinic, located at Sabinas and Morgan, and it was explained that this Unit is run by the County and complaints and suggestions should be presented to the Commissioners Court. There being no further business to come before the Council, the regular meeting was adjourned.
